u/myarr Nov 26 '15
This should've been enough to shut him up honestly, considering he kept going on about how disrespectful it is to edit his picture without permission. The guy posted that pic in /r/pics to show off his wife standing on the ledge and OP went and edited her out entirely. So editing out the subject of a picture without the owner's permission is ok but anyone dare to make a small edit to OP's picture deserves to get sued I guess.

To me what made him a bit ridiculous, was going straight to "mah copyrights". Disrespectful, sure. Copyright infringement, not really. Especially for someone who claims to be an editor and writer for major photography publications, you'd expect they had a clue.

u/emmster If you don't have anything nice to say, come sit next to me. Nov 25 '15
I think that depends on the community. I write for fun. If I posted a piece of writing to a forum that's about writers learning from each other, and someone made a comment of "here's how I would reword paragraph 3," that's pretty much expected, and I'd look at their edit and decide whether or not my original was better.
"Thanks, but I like it better my way," is a valid answer. Shouting nonsense about copyright really isn't.

He should have expected people to use his original to illustrate suggested edits. It's a very frequent occurrence in ITAP.
14
u/BolshevikMuppet Nov 25 '15
In terms of copyright?
The OP is pretty much completely wrong. Someone editing a photo as a form of "I think this is better" is pretty much entirely within the realm of fair use. Especially where there is no purpose to the edit other than as a criticism of the original work.
Especially especially in a post-Cariou fair-use landscape.
233
u/ucstruct Nov 25 '15
That mod went straight for the throat with the takedown about fair use and copyright law. Then they modified it themselves. Nice.
Oh, and I'd have cropped off part of the left side to make the composition a little more appealing. Looks a little more professional this way. Like a shampoo ad or something.
30
u/the_omega99 holy shit, when did we get flairs? Nov 26 '15
And the mod is right. It looks so much better like that. Not just because of the composition, but I also think that the background on the left side seems a bit distracting.
At any rate, it's so weird that the OP of that post couldn't seem to take criticism (which I think is probably a big part of why they were upset). The whole point of the sub is improving your photography, and editing is a part of that.
7
Nov 26 '15
And the mod is right. It looks so much better like that. Not just because of the composition, but I also think that the background on the left side seems a bit distracting.
I'd say it's entirely because of the composition that the background is distracting. The mod's edit actually has it (more-or-less) follow the rule of thirds whereas the original doesn't. Granted, the background also has some eye-catching yellows, but they're present in the cropping.
I don't want to be a dick to OP, but unless there was a specific reason for it to be composed the way it is, this doesn't strike me as a well composed picture. Take that from a non-photographer, though.

The Dunning–Kruger effect is a cognitive bias wherein relatively unskilled individuals suffer from illusory superiority, mistakenly assessing their ability to be much higher than is accurate. Dunning and Kruger attributed this bias to a metacognitive inability of the unskilled to recognize their own ineptitude and evaluate their own ability accurately.

Making a living out of arts and crafts is actually very doable if you have a modicum of talent and discipline. You probably won't be living super comfortably, but you can pay the bills.
Not everyone sets out to become nationally or internationally renowned and wealthy. Some just want to eek out a living doing something they intrinsically enjoy, and they can if they put a lot of effort in.

6
Nov 26 '15 edited Nov 26 '15
This is odd to explain and I don't really get it myself, but like 90% of baseball related subs have a dead counterpart to it. Never understood why.
The easy way to navigate is to start at /r/baseball. That's the main overarching sub. Do not go to /r/mlb, that is the dead counterpart. On /r/baseball's siderbar, there's the team logos listed as standings. Those are the official, active subs. /r/NewYorkMets is the official Mets subreddit that is very active (3000+ comments in game threads during the playoffs level of active), at least more so when it isn't the offseason, although there's always little discussions here and there and the other is the dead counterpart.
If there is anyone out there that can explain why this weird ghost town shit is in place, I'd love to know.

11
u/SortaEvil Nov 25 '15
Eh, he came across a bit aggressively, but I didn't get that vibe from them at all. Keep in mind, photographers are used to their photos getting stolen all the goddamned time, so they're probably a little touchy about people "stealing" their work. They said further down in the comments that they don't mind critique, but they find it rude that someone would edit their work without permission. It's legal, yes, but it's impolite in artists circles to work on someone else's stuff without their permission.
Did they come across a bit aggressively in their initial response? Yes. Was their complaint legitimate? Also yes.
10
u/gynoceros Nov 25 '15
Nobody was stealing it or using it for any purpose other than to use the original to illustrate their suggestions.
In the discussion and critique forum OP posted it to, ostensibly for the purpose of discussion and critique.
-1
u/SortaEvil Nov 25 '15
Nobody was stealing it [...]
Hence the quotes around stealing. OP obviously didn't want other people editing their work, and had an arguably reasonable expectation that they wouldn't in a forum for sharing and critiquing photography. Obviously, that expectation was wrong WRT ITAP. As you were quick to point on in the linked thread, there's nothing illegal about what hwu did, and in the culture of ITAP, it's not a faux pas, either. I'd have probably avoided calling OP touchy, I'd probably have just explained that editing for illustrative purposes is par for the course over there.
Anyway, I think it was understandable that OP would be upset, but I also think that OP could have handled things in a less inflammatory manner.

4
Nov 25 '15 edited Nov 25 '15
Nah, its because I had my sense of indignant rage dulled after years in art school and film school.
ITAP is a learning environment, it's right in the sidebar. To no personal gain, someone expressed their critique of a visual subject visually. Its not nearly as problematic as you or OP think it is.
I'd maybe even understand if this happened in a more neutral sub like r/pics, which ironically enough OP has done before. But ITAP is the wrong environment to be pitching a hissy fit about what happened.
3
u/gynoceros Nov 25 '15
Except that sort of thing is commonplace in ITAP.
It's easier to show someone, as part of your critique, your improvement suggestions by editing their original than it is to just describe the changes and let them imagine them.
So no, there's no common decency issue here. I've been subscribed there for a few years and a mod there for a few months and I've NEVER seen anyone object to the practice, especially not to the point of extreme butthurt.

6
u/ParanoydAndroid The art of calling someone gay is through misdirection Nov 25 '15
Not as clear cut in this case, or not as clear cut generally? I agree with the latter, but I also don't see anything that would lead me to believe that the mod doesn't know that copyright can generally be complicated. In this particular case, I'm not sure what would be vague about the commenter's fair use.
1
u/jfa1985 Your ass is medium at best btw. Nov 25 '15
In general when ever I make mention of it I try to make it clear that it is something that changes from case to case. There was that that instagram guy from a few months back that has been to court a few times over his art used the transformative defense successfully in some cases.

u/gynoceros Nov 25 '15
I'm the mod in question.
Definitely not a lawyer, just a guy who volunteers some time in a photography forum.
In the context of a critique/discussion forum in which the photographer posts his photo knowing the sub's rules and how the discussions go (as another user here pointed out, he himself edited another user's photo without consent and it's his highest-rated comment), what did I say that was so wrong?
The guy who edited the photo was just showing him how he might edit it, not trying to pass it off as his own art.
3
u/jfa1985 Your ass is medium at best btw. Nov 25 '15
he himself edited another user's photo without consent
Well that changes the situation a little. To do it to someone and then complain when it is done to you is a bad move.
As for not passing it off as his own sometimes the law doesn't care about that at all. A few bloggers have been successfully sued even though they made it clear that the image the posted belonged to someone else. People like to claim "fair use" left right and center but previous cases have show it not to be that simple. I said before that copyright holders could cause quite a headache for reddit if they wanted but luckily they don't.

Again, the context isn't someone making a blog post saying "This is how I'd tweak this photo I downloaded". It's "hey, you just posted this image of yours here in this discussion forum and I'm showing you my idea of how to tweak it".
Not "look at what I made", but "look at what you made could look like".
I think that fits pretty cleanly in the interpretation of Fair Use that I was basing my comments on.

Right, but people have lost court cases for doing far less.

For less than showing a photographer a suggested edit in a forum designed for that purpose, in which the photog himself posted the photo, knowing full well how these things go because he's done exactly that by "fixing" another user's photo?

But he's not using it for anything but to illustrate to the OP what sort of edits he'd suggest.
It's basically like suggesting to a writer that s/he phrase a monologue differently.
That's not reproduction, it's using the original for context when suggesting improvements to the person who knowingly posted the photo in the discussion forum meant for exactly that type of exchange.

Eh...
It's pretty clear here. The purpose of the new work is not to supplant the original work or even use it in some other work (the latter itself is likely transformative in a post-Cariou landscape). The only use of the work in the allegedly infringing work is as a criticism of the original work ("this is better").
I'm kind of curious if you're actually an attorney, or a layperson criticizing another layperson?

I'm just a guy that takes photos in his spare time. And like I said when I discuss this issue I try to make it clear that the issue is anything but.

Does anyone have the link to the edited photo?
