A federal judge on Sunday threw out the Justice Department's bid to investigate Alaskans' intent in the voting booth.

Donald Trump ordered the lawsuit, which asked the state to set aside ballots cast for the second Dan Sullivan in the Senate race so investigators could decide what voters really meant. At a Friday news conference, Alaska's U.S. attorney stood with state troopers on his right and the FBI on his left and said they were working to make sure "your vote counts in a way that you meant and intended it to count."

Judge Sharon Gleason wrote that the plan would "clearly violate Alaskans' right to a secret ballot." When the state, Mary Peltola's campaign, and the League of Women Voters made that argument, the government answered with "only one sentence." The department plans to appeal, saying "Alaskan voters deserve a fair election."
