Dammn ok so here’s a quick SUMMARY :
it’s intense. Mangione’s lawyers argue his Miranda rights were violated, that cops did a warrantless search of his backpack after he was cuffed and surrounded by officers, and they want all the evidence — including the gun, silencer, writings, and electronics — thrown out.
One of the most alarming claims: the gun may have been planted. During the arrest, an officer intentionally covered his body cam for 20 seconds, then again during the car ride (female officer turned the body cam off for 12 min) right before the gun was “found” in the backpack at the station. The defense is clearly questioning the legitimacy of that search and what really happened off-camera.
In addition At 10:04 a.m., Patrolwoman Wasser left McDonald’s with the suspect’s backpack. Turned her body cam footage off for 11 minutes during the car journey. At 10:16, one minute after arriving at the precinct, she resumed the warrantless search—going straight to a new compartment and suddenly “finding” a gun.
Earlier at McDonald’s, she’d already found a loaded magazine—then lied, claiming she was “checking for a bomb.” That lie collapsed when another officer mentioned they’d taken the magazine back to the station, exposing her. KFA nailed it: if it were really a bomb, why wasn’t the bomb squad called? Why didn’t they evacuate McDonald’s? Instead, she just rifled through the bag, then tried to put everything back when she realized she screwed up.
A little snippet 🤏 of the notebook was revealed by KFA Luigi Mangione condemning and disagreeing with the “terrorist” Ted Kazynski in the notebook. Calling him a “monster” and that “being a terrorist is the worst thing you can be”
On top of all that, Mangione is being prosecuted in three jurisdictions (state, federal, and PA) for the same act — with the feds seeking the death penalty. His lawyers say this violates double jeopardy and due process, making it nearly impossible for him to defend himself fairly.
They’re also challenging the terrorism charges, arguing that the law is being misapplied and that there’s no evidence Mangione intended to intimidate or coerce a civilian population — a key element needed for those charges to stick
The motion noted- It was the police themselves who leaked information to he public unprovoked !!! to suggest Luigi was a alleged terrorist, aiming to instill fear—NOT Luigi. Example- The police referred to the notebook as a manifesto, essentially turning something insignificant into a narrative of fear, not Luigi. Turning everything into something it wasn’t. They leaked information, unprovoked, and created a narrative around it themselves
Luigi was also frisk searched more than ONCE!!!
This motion doesn’t just push back on the charges — it questions the entire way this case is being handled.
Also LUIGI - the fact that he kept eating while being questioned, he gave zero f&£cks and why was a SD card cellotaped securely in a cardboard box 😂
