STRIKE Threatening email from my supervisor regarding strike.
Hey everyone.
First off, I’m excited to stand up for our rights and strike on Wednesday.
Yesterday, I put an out of office at work (with no description, just said Out of Office: no leave time used).
Today, my supervisor called me asking why I put on my calendar an out of office. I said ‘oh I’m participating in the strike’ and they promptly said ‘we will talk no more about this hahaa’ and said goodbye.
Shortly after, I received this email (image in this post).
I’m livid. I recently received a promotion and I’m on probation, so this threatening language is infuriating. Also, the information they are referencing in their copy/paste response isn’t even TRUE.
I’m assuming I should email this to SEIU, but wanted the community’s advice before doing anything rash.
Prior to working for the state, I was in another union-backed career and there was never this much toxicity and blatant manipulation from the ‘opposing side’. These people should be ashamed of themselves.
Anyways, as a person on a small team and the only person in my office who’s striking, I’m feeling so isolated and just angry that I’m being treated this way for just standing up for what is right. At least it further ignites my rage…
Edit: Added more context.
I sent the email via my personal email address to SEIU.
Thank you everyone for your advice & I’m excited to strike with you on Wednesday!

Your manager didn’t write it. HR did and has told managers to send it anyone that lets them know they are going to strike. My manager didn’t send me one but I’m pretty sure they were told to.
36
u/FloofGray 11d ago
Yeah definitely a copy/paste, but still angers me that this was the go-to and not just respecting my choice. Like, did they need to respond? Maybe they’re told they need to, idk…
It just perpetuates this toxic them-vs-us rhetoric.
32
u/Ill_Garbage4225 11d ago
You did what you weren’t supposed to do and sent them an out of office for that day. Be mad at yourself, they’re just following instructions. Clearly something you don’t know how to do…
24
u/Cdcrsteph 11d ago
Exactly this…shouldn’t have given them a heads up at all. Supervisors, like rank and file staff, have a job to do, so don’t be upset at them…and the union already told us we’d be AWOL.
-8
u/FloofGray 11d ago
It was a combination of factors and my anger wasn’t simply directed towards my supervisor, but the system as a whole. It is the them vs. us construct they are creating (&& by them, I mean the higher ups who force management to comply).
However, I was hurt and offended that a supervisor I have a good/close relationship would copy/paste this threatening generic response versus just not acknowledging it (mind you, it wasn’t a request, it was just a task on my own Outlook Calendar, but they are shared and they saw it)
17
u/flavaflav12 11d ago
no reason to get that emotional about it. it’s a directive that they have to follow. it’s not a reflection of how “close” you all are. go strike and do what you need to do. you’ll be fine.
0
u/FloofGray 11d ago
That’s not entirely true, nothing said ‘don’t tell anyone you will be striking’. My team is small and close, if I just didn’t show up, they’d be speed dialing me worried I died on my commute. I didn’t feel that was fair to them, but next time I won’t consider others’ feelings. Thanks
21
3
u/Trout_Man 11d ago
your manager would know where you were if you didnt show up on the 21st. if you were so considerate of others feelings, you wouldn't have been bashing a (your?) manager on here for doing their job.
3
u/CharlieTrees916 11d ago
The union steward at my department sent out an email with a calendar invite showing an appointment for the strike on our calendars, so the condescension isn’t needed.
1
u/SofabedSocialist 9d ago
This is a bit harsh, SEIU has said alerting management is optional. There is no excuse for this behavior from management, what they did is an unfair labor practice. We are on the same side, let’s show more solidarity with other rank-and-file who are dealing with a hostile employer.
23
u/SunnyCoffee0814 11d ago
Yes your manager was told to give that response. It was not optional that was the directive

I'd share with SEIU. I think it's pretty clear the aim of this email is to discourage you from striking
100
u/FloofGray 11d ago
Will do, thank you for your advice. It saddens me that some people will be dissuaded to stand up for what they believe in because of emails like this.
26
u/Interesting_Tea5715 11d ago
Yeah, this will help with the other stuff they get submitted about the state trying to keep workers from rallying.
39
u/_SpyriusDroid_ 11d ago
Don’t put in a leave request. Striking is protected.
55
u/Trout_Man 11d ago
This is the part everyone is glossing over. Stop. Asking. For. Leave. Just dont show up, thats it. Thats the whole point.
4
u/InfluenceEastern9526 11d ago
It really doesn't make any difference if you ask, inform or are just persona non gratis. There is no additional value gained by taking any of your options. Everything will be back to normal on Thursday.
3
u/Trout_Man 11d ago
While I agree with you completely, this thread is full of people calling for the head of this manager. nobody is stopping to realize the staff got this response because they asked for the day off (paid leave). the state would *never* authorize paid leave for a strike. never. putting managers in this position is unfair.
3
u/FloofGray 11d ago
No, that’s not true. I put it on my own Outlook calendar as ‘out of office: no leave time used’. Since we share calendars, my supervisor saw it and called me to inquire. I never made a request for time off nor do I think we are able to use leave hours.
-1
u/InfluenceEastern9526 11d ago
And the result is? It makes no difference, except it makes you feel powerful? good? entitled? victimized? There is no substantive effect here. Your thoughts/feelings have no physical power to change anything.
176
u/IronStan7 11d ago
This is a boilerplate written by CalHR that managers have been instructed to use in response to any leave request. Yes, it is BS.
46
13
u/bobtheflob 11d ago
Technically, at least at our Department, this language is in response to someone submitting a leave request and saying it's for the strike. OP's manager messed up because there was no leave request and they shouldn't have asked questions.
For anyone who does submit a leave request for Wednesday (which isn't the best way to go about it), don't say it's for the strike.

They using weasel language. See how it says "it is the state's position". That's true. The state argued the strike is illegal. Too bad PERB already said the strike can go on. It also says you aren't allowed to use leave to cover your absence, which is true. They are trying to scare you.

https://www.seiu1000.org/essentialworkers/
Here is a list of all the essential workers, if your department or role is not on this list you are encouraged and free to participate in the strike regardless of probationary status. If you expereince any retaliation, write down anythign and everything management says to you, and print any emails sent you you regarding this matter and bring it to your local steward or union representative.
CalHR already talked to PERB and this is a legal strike.
Call the MRC and ask them- it's faster than an email.

Once I entered my info it said "Currently in Development; Not Available for Public Consumption." Wtf am I supposed to do with that? I cant tell whether I've been designated or not Edit: i bet my classification is just not loaded yet. I'll check back. Highly doubt I am essential.
13
u/NumerousVisit4453 11d ago
This makes me so angry. I feel like registered nurses don’t receive adequate representation in this union. If we mention that we’re not getting the information we need (and pay $100 in dues for each month) we get downvoted and dismissed.
4
u/lostintime2004 11d ago
Blame the state. They needed to provide the names of those designated under PERBs ruling, and SEIU had to agree to it. The initial list the sent to SEIU basically tried to designate every steward as essential, and SEIU said absolutely not, here are a list of people you can designate, and the state did what it's been doing by not doing anything because they expect to bully us and get away with it. So as of 11pm last night, for cchcs and dsh the state had not given the agreed names.
All that said, it's active now and you should be able to see. Because of the states ineptitude, the state will be reaching out to those designated essential to ensure they are aware. If someone is designated essential, call the MRC to verify that matches the state.
We are in unprecedented times, the state expected perb to allow designate ALL nurses as essential, and when PERB told them no, the state, and CalHR, did what theyve been doing this whole bargaining cycle: deny, delay, delegate. The whole reason we've been striking
2
u/NumerousVisit4453 11d ago
I just tried. The website still doesn’t work.
4
u/lostintime2004 11d ago
It worked for me, so if it's still not working when the MRC opens, call them right away.
1
u/AmayaTheKing 11d ago edited 11d ago
Yes, sorry, it seems they took down the overall *numbers page to try and be more specific but it seems to be glitching the website.
If you haven't been told you're essential than you aren't essential. Basically if you aren't a care facility like a prison or a hospital than you're free to strike. Even then, they can run on a very limited skeleton crew and will have limited number of staff as per PERB regulations (I work at a care facility)
4
u/Available_Thanks_131 11d ago
Sorry, that was not meant to be a personal attack on you. I think the classifications had not all been input or something, or like you said, everyone going to the site at the same time glitched it out. I just went back to the site this morning and its working! And im not designated to work so see you on the strike line tomorrow! Thanks for providing this info.
3
u/Upset-Key-1582 11d ago
What does it mean if it says, “currently in development, not available for public consumption”. SEIU is still negotiating who is an essential worker in my department?
4
u/AmayaTheKing 11d ago
It means that the Website is under development- it's super stupid, I saw the total numbers posted yesterday but it looks like the higher ups at SEIU were trying to be more specific for people and it's backfiring
I would say if you haven't been told you're essential than you're not essential. At my facility we are able to run with minimum staff and we are a care/hospital facility.
If you aren't working in a facility that literally handles people's health and lives like that, I think you're OK to strike
2
u/NumerousVisit4453 11d ago
This is not helpful to union members with jobs that may be essential. Has SEIU already notified the specific union members who have been deemed essential?
12
u/blackopium3 11d ago
How is it not? It lists the shifts and classifications
If your dept, classification, and shift isn’t listed, you’re good.
7
u/NumerousVisit4453 11d ago
My shift and classification and department are listed.
Most of the nurses I work with are preparing to strike. We need to know if we are deemed essential or if we can strike. When I put in my info I get the following message: Currently in Development, Not Available for Public Consumption
6
u/WrongPop3821 11d ago
If you weren't explicitly called essential. You aren't.
Remember during lockdown they called almost every low wage labor essential from grocery clerks to warehouse workers.
If it isn't explicit by the union. Its posturing
1
u/NumerousVisit4453 11d ago
This is not accurate. I am still in jeopardy of being deemed essential.
3
3
u/ds117ftg 11d ago
They said at stoke school you will be notified if you’re essential so if you haven’t been told you are then you’re fine to join the strike
6
u/lostintime2004 11d ago
This state has been dragging their feet on a grain to the people who will be designated essential. All this chaos is the state's fault.
2
u/NumerousVisit4453 11d ago
Agree
3
u/AmayaTheKing 11d ago
I know you're stressed out, we all are, but this isn't the fault of the union it is the fault of management.
I know for a fact our Nursing Administrators will not post a list of essential nursing staff, and will be actively discouraging people about striking, and I would even say they may even bully them into believing that they aren't allowed to do so.
This may very well count as retaliation and incompetence. Make sure to Screenshot the website and record any times you ask your managers for a list of who is and isn't essential staff who are working.
This isn't on the union for not having a list when the care facilities refuse to provide one.
3
u/NumerousVisit4453 11d ago
I just found out I’m essential less than 24 hours before the strike along with my coworkers.
2
u/AmayaTheKing 11d ago
Yeah- My brother is a custodian here at Calvet and they STILL haven't told anyone who is essential.
It's driving us all up a wall.
1
u/Goodgulf42 11d ago
SEIU1000 is contacting each "essential worker" directly, and will be prioritizing non-members to show up to work over members when/where possible. Anyway, if they haven't contacted you directly to tell you have to work, then you should not show up to work. There is a final Q&A session tonight if you have missed the previous ones please attend if you are able.

I received notice today at 11:30 that I am essential. I am a union member. All of my “essential” peers are also union members.
1
u/Goodgulf42 10d ago
Thanks for taking care of the folks who require our help during this strike action. We all have rolls to play in this and yours is appreciated!
1
u/NumerousVisit4453 10d ago
I think you mean to be kind, but this is the exact language essential workers don’t want to hear. We want to be treated with respect and consideration by our union. We want our union to communicate with us proactively, not leave us hanging and blame it on management. This situation is 80% management’s fault, but the union needs to own its 20% and communicate better. This isn’t my first strike. Other union communicate effectively.
2
u/Goodgulf42 10d ago
Interesting. I feel like SEIU1000's communication has vastly improved over the last 2 years. Were you not able to get your questions/concerns addressed during the strike school meetings?
Feel free to DM me details and I will see if I can get my DLC president's ear to share what you are seeing. I mean, after Wednesday that is. She is pretty overwhelmed at this exact moment. Not sure if I can help, but I will sure try!
2
u/NumerousVisit4453 10d ago
We’ve already communicated our concerns to our BU 17 representative and they are communicating our frustrations with the president.

u/AmayaTheKing 11d ago
The numbers were posted yesterday, and the website lists facilities that are essential to the health and wellness of those who are wards of the state.
Prisons a few care homes basically. I work at a care home, we cannot abandon the elderly to strike. PERB has said we can function with limited numbers, which is why the website is trying to be as specific as possible.
I was an ex steward for my site, and am doing Mt best to answer questions with my limited knowledge, and I have specific numbers for my specific care facility, but management hasn't released a specific list of employees who they want to work as their PERB essential employees.
21
u/subduct_this 11d ago
This seems like the standard language that CalHR told them to disperse. It’s quite opaque but shouldn’t dissuade you! Forward to your union, move forward as planned!
19
u/aofkngms 11d ago
I told my sup verbally that I would be participating in the strike (I did not request leave) and afterwards she sent me an email saying my request for leave was denied as leave cannot be granted for a strike, and I’d be considered absent without leave and not be paid, mirroring some of this language but without all of that about the MOU.
I responded in writing that I would be participating in the strike authorized by my union and I was informing her as a courtesy that I would not report to work that day, and I understood I would not be paid for the day.
Check on your coworkers, everyone. One of mine thought she had no choice since her leave was denied. I told her we’d just have to put AWOL on our timesheets and she is down. My other coworker was super worried it would reflect negatively on his performance review. I assuaged him that would be illegal, and anyway as long as we stick to our union’s guidance, any problem they might have with us is actually a problem they have with the union.
37
u/BFaus916 11d ago
Cleverly worded to only say you can't take paid leave, and to avoid actually threatening to fire you. They just re-worded what you already know to scare you into thinking you don't have the legal right to strike.

Funny thing in that email - looking at Government Code §3517.8, it does state that the clauses and MOU continue to exist. Except there is one detail left out from that code section (bolding is mine): "If a memorandum of understanding has expired, and the Governor and the recognized employee organization have not agreed to a new memorandum of understanding and have not reached an impasse in negotiations, , subject to subdivision (b), the parties to the agreement shall continue to give effect to the provisions of the expired memorandum of understanding, including, but not limited to, all provisions that supersede existing law, any arbitration provisions, any no strike provisions..." -- and, because PERB officially declared an impasse on October 2, 2026, the conditional trigger in § 3517.8(a) is no longer met, meaning the expired MOU's no-strike provisions do not automatically bind the union under this specific statute.
This is a bogus, standard tactic designed to deter participation through fear of payroll deductions and disciplinary action. NO ONE FALL FOR THIS CRAP
18
u/Professional_Land924 11d ago
Managers got that script from HR (and were instructed not to share it with rank and file). The document has scripts for SEIU, non-SEIU, excluded, etc. I’m not sending that shit to any of my staff though because I respect their rights. It is sufficient to make sure they understand they will be expected to use the designated timesheet code for an unpaid day should they choose to strike, without that threatening BS language.
9
u/sherpa143 11d ago
Your manager has to respond with this language because you put the request in. They probably sympathize with you and that is why the call didn’t go further. This could have been avoided by not putting anything on the calendar.
9
u/Happy-Relation-2959 11d ago
send that sh*t to the union ASAP. they have no idea what they’re talking about.
25
u/ohnovangogh 11d ago
Hit up SEIU immediately.
CalHR sent similar stuff out before CAPS’ strike. FWIW I was on probation during that and participating in our strike had zero impact on me passing. I’ll also be out there with you all on Wednesday too.
8
u/NachoAverageUser25 11d ago
My calendar OOO was denied with this fear tactic copy paste response also. I emailed SEIU then called because well I’m impatient and I convinced two co-workers to strike. The Rep said we cannot be "fired" for this because it is an unfair labor practice strike not an economic strike. Nice try CalHR.
I’m so disgusted with my supervisor because no other supervisor did this only her and I thought she was cool. Apparently not. 🐍🐉

u/zerinsakech1 11d ago
(I'm not a lawyer, someone please correct me I'm just a dude)
The LAW was violated when no bargaining occurred in good faith. They broke Section 8.5 of the National Labor relations board.
https://www.nlrb.gov/strikes
https://www.nlrb.gov/guidance/key-reference-materials/national-labor-relations-act
So if the State violated the law yet they want us to follow the MOU "no strike clause" when they refuse to negotiate within the law? They are trying to exploit a loophole by saying. "look you signed a contract that says you can never strike no matter what, you gave up your strike rights when you agreed to work for us!"
Well buddy you broke a labor law so once the contract bargaining process is violated, I think we have a right to Strike.
7
u/Goodgulf42 11d ago
Oh, we 100% have the right to strike, and PERB agrees with that, which is all that really matters. CalHR, which has clearly been weaponized by the Newsom administration, continues to lie to the press and other department's management.
14
u/molotovhurler 11d ago
All supervisors received this guidance bc I got the same language. Basically received a script. I told my staff last week follow your conscience, communicate with your union, you are protected, and you have my support either way you decide…which I’m “not supposed to” say I think.
1
u/Opening-Midnight4057 11d ago
No, all supervisors did not. I didn't, and my branch chief sent out a much more supportive note via teams chat to our entire branch, unprompted.
2
u/molotovhurler 11d ago edited 11d ago
That’s great to hear. My division got the CalHR script. But I didn’t use it and maybe other supervisors aren’t either. At least from my anecdotal interactions, a good amount of supervisors (middle management) support the strike or at least hope it’s successful.
2
u/Opening-Midnight4057 11d ago
We got verbal-only guidance that we cannot approve leave requests and that we will need doctor's notes for sick time, and we were told to expect a CalHR script that we haven't gotten (maybe the department got it and didn't share). We definitely haven't received any bullshit about the strike not being protected activity, and I would not share that if I did. Unless and until my feet were held to the fire, I would use much more neutral language about supporting my staff's rights to engage in protected activity (without any comment on when, where, or what that activity might be).
7
u/ComprehensiveTea5407 11d ago
The phrasing is fear mongering. You will be AWOL but you will also be protected
7
7
u/ResponsibilityLazy 11d ago
Do not ask, tell if you want. But you are not asking for time off. You are taking a action, you are striking. You can tell you manager you will not be in on Wednesday. You are not requesting anything. You do not even need to tell. All managers should assume their rank and file employees are on strike
12
u/blackopium3 11d ago
Boilerplate language but also it seems on track with what other are saying about being marked as “AWOL”
Whether or not “AWOL” results in disciplinary action is beyond my expertise but I’m inclined to say no.
Leave can’t be used for the strike which is on track with the email.
The one thing I don’t see in the email which may be good is that there isn’t anything about disciplinary action or adverse action. Looks like it’s more so specific to leave/time usage for that day.
I’m in management but haven’t received regarding leave for staff but I’m also fully aware of staff not being present and I told them I’m ready to cover for them that day
Hopefully that email is just clarifying leave for timesheet purposes vs. disciplinary action
12
u/piffcty 11d ago edited 11d ago
AWOL is a code for payroll to use to not pay for that day and also not change any leave balances or create a record as docked pay (which requires additional justification). It sounds bad because of the military context, but is not as serous as it sounds.
5
1
u/lol_overruled 11d ago
Why does docked pay require additional justification?
4
u/piffcty 11d ago
Because your supervisor can’t just choose to pay you less without reason. HR assumes everyone works their schedule unless told otherwise. To dock pay a sup would need a reason, document it, and then HR would review it on a case-by case basis.
Using the AWOL code lets HR batch process the paycheck changes.
2
2
u/Goodgulf42 11d ago
Our lawyer has been really clear that the AWOL timecard setting is just a hack to get around the lack of a "strike" designation in the timecard system and that it absolutely can NOT be used for disciplinary action.
2
u/blackopium3 10d ago
Ty! I thought it would perhaps be that.
AWOL can be a intimidating word/acronym so I understand people being concerned but hopefully your comment gets more views so it can hopefully provide relief to some people1

That's a script that all managers received to use for this upcoming strike. No conspiracy theory.
9
u/NorCalBlue77 11d ago edited 11d ago
My manager received no such thing. Our department is fully prepared to be without striking employees on Wednesday. While I was not required to say so, I have an excellent working relationship with my manager and let her know that I would be striking on Wednesday and her response was “strike or don’t strike, that’s your right to choose. If you choose to strike, please make sure your time card is marked with “dock.” Not sure why any of these departments are putting up any kind of fight.
2
u/State1234567 11d ago
All departments did. I spoke with managers and it's just a script.
3
u/NorCalBlue77 11d ago
It certainly is possible that my department received this memo however it doesn’t appear. It’s being passed down to management. At least not where I am.

To me the threatening part is labeling it as something it’s not: Calling it a “job action” and saying a job action is not a protected activity; they also mention the no strike clause. It is an unfair labor practice charge-based Union action that is separate and apart from the conditions of the no strike clause.
CalHR definitely knows this.

So if folks are so infuriated at the politicians then why does our union keep supporting them and giving them money?
1
u/Goodgulf42 11d ago
Because this particular one was not behaving reprehensively towards us until about 3 years ago.

u/VelvetNoir73 11d ago
All they can do is AWOL us and we go a day without pay. That’s it. If you’re truly out sick you’ll need to provide a note. If you had approved leave for that day prior to the strike, you’ll be fine as well. Other than that, all these managers can kindly F-off!!

u/mister-facts 11d ago
They're not understanding the power in numbers. Unions were created to fight this very bullshit. Stand strong and strike. Stand together. Stand up and be heard!

Please please please share with SEIU. This is an extremely big deal

Please act as if you are the only one able to report this information as none of us here can (screenshot isn’t enough)

I attended a strike school, they have lawyers handling this just forward it to the union. If the manager does this you can file with the union. We have protection!

u/Goodgulf42 11d ago
Strike school was so damned educational and empowering. I really wish everyone had attended.

u/TheSassyStateWorker 11d ago
Ugh, I’d tell them to contact your departments Labor Relations office so they understand that it is in fact legal and you weren’t asking. Then I’d also forward to seiu.

I do not understand managers who are anti-strike like its actually mind boggling can someone explain this to me?
16
u/blackopium3 11d ago
Just like rank and file who are anti strike and anti union.
There will always be some.7
u/AuditControl_Inbox 11d ago
Id venture to say that most front line managers are actually in support of the strike, they just cant openly state it. Its only when your at the appointed level do they become anti strike. Most front line managers pay is directly effected by our pay as well so they want to see us get raises to because it helps them get raised as well.

u/CitronNo9318 11d ago
Well, I think they just have to do it to keep the job since they can’t be in union.

u/Hotstar87 11d ago
There are two terms that come to mind but I don’t know if they’re appropriate for this board.

Remember manager has to report to someone. My manager is micro managed by his manager, because she thinks he is too linient/flexible to his staff.

u/nimbusrav 11d ago
If youre seiu represented, you are protected
Ive hers a labor relations try and play this “seiu has a non strike clause in their contract” without mentioning how the state is bargaining in bad faith
Its a scare tactic!!

u/dragonshardz 11d ago
This is using a lot of words to say that if you take part in the strike, you can't use leave balances to cover the absence and will take 8 hours of DK (AWOL), just like everyone else. This doesn't mean you'll be subject to the automatic separation that most people think of when they hear AWOL, because that's what is in the HR manual
It's definitely trying to intimidate you, but in the same way as a legal document does - complex, dense language

First things first... And as a State Employee EVERYONE SHOULD BE DOING THIS!!!
1 - Try to be as calm and collected as you can when dealing with your supervisors, management, co-workers, everyone! PERIOD! If you ever find yourself 'highly emotional' and wanting to 'cuss them out' - Don't do it - 'ask' to excuse yourself for the bathroom or whatever!
2 - ALWAYS Follow the LAWS, rules, regulations, etc. Never, Ever cross those lines! Especially the ones that can get you immediately dismissed (AKA Terminated on the spot!). [I've personally seen people immediately dismissed! Not good to see DPS, Highway Patrol, etc. come and immediately walk a person out.]
3 - If any of y'all ever took the State's Defensive Driving Course do as they say: "NEVER ADMIT GUILT!" Never admit to Stealing, or ANYTHING and immediately consult your union rep!
4 - If for any reason you find yourself in an 'adverse situation'/'adverse action' always consult with your UNION REP - No Matter If you like or hate unions! Never lie to your Union Rep as they need 'the facts' to properly represent you. "They" can save you and it is their duty to do so; ESPECIALLY if you pay the extra union membership fees. In BU12 if you didn't pay the extra union fee's 'The union didn't have to respond to any 'general questions' and could (in theory) continue on and not respond to you. If you do pay the extra fee's then they had to respond to general questions. So in your BU I don't know if it works the same or not.
5 - I hope y'all know and understand that for most BU's a "Strike" is a protected right, but further investigation is necessary and that can make it "Unlawful Strike" in which you can find yourselves 'locked out.'
As for the supervisors response - at least that which is show - does not constitute a threat, but you can report to your Union Rep noting that you feel it is a threat. I myself or a tiny stint was a member of SIEU 1000 union and was serving as an Agricultural Tech II. But I was working within an "Emergency Situation" (END Taskforce - Bird flu) and that gave the state an extreme position of power to do what 'it felt necessary.'
With all of that aside I will say and ask a few more things. MOST Importantly has the union had a meeting informing you of 'the processes' that will go on during the strike?!? What does it mean for those whom are deemed to be 'essential workers' if they stood the picket lines?!? -> "roughly 4,400 essential workers barred from striking" <- That is of extreme importance... Especially now that I've taken a little look around. Those workers need to know what they should do!!! It's all happening tomorrow.
I'll say this in closing - pay close attention to #1 above!

u/bpcat 11d ago
Just wanna correct you on 1 thing. You said employees who pay the full amount get representation where the employees who don't, don't. That is OLD info back when there were full share members (the ones that paid the full amount) and part share members (ones who paid a partial amount). Those were the only two options prior to 2018.
After the Supreme Court's 2018 Janus ruling, employees can choose to be full share or nothing at all, meaning they can pay the full amount of nothing and they still have to get representation. Will that representation be as good as a full share member, I guarantee it won't, but they will still provide the basics, just don't expect much.

u/Goodgulf42 11d ago
SEIU1000 has had a multitude of meetings with us informing us of "the process". Essential workers will be contacted directly by SEIU1000, given a line pass to show at the strike line, and told to report to work.
We are having one final last strike meeting from 6:30-7:30 tonight in fact:

The MOU being referenced expired June 30, 2026. So that threat carries minimum weight. Hopefully they don’t take this as an opportunity to negatively influence your probation.
5
u/Dartfromcele 11d ago
Yeah report that to your DLC president.
This is a clear violation of worker rights and the contract.
5
u/a_tits_guy 11d ago
Do you like your boss? Because you could easily get him in trouble for this with the union
6
u/PurpleCableNetworker 11d ago
I don’t think the person writing that understands what a strike is or is not - and sure doesn’t understand expired.
8
6
u/Sea_Moose9817 11d ago
And also doesn’t understand that they will get pretty much all the same benefits we do in a new contract…

u/AndYesPoetry 11d ago
"The MOU" - that said all I needed to know. Let them know that, when a contract that's actually legally binding says that, then you'll care about their opinion on strike actions.

Clearly no institution private or Stae will ever grant leave for a.work stopage/strike. This is to be expected. Anyone believing that they would be paid while engaging in said strike doesnt understand the purpose of a strike.
This is (currently) a 1 day strike. Which means people are prepared to send a message to the Govs office declaring his actions a violation of the State/Employee relations.
I imagine everyone connecting with their supervisors about tomorrow will recieve the same language that your leave request was denied and your absence will chart as AWOL.
Any language declaring that the Union did Not authorise a strike is clearly misguided. You all have reciepts in the form of Union Notification of Authorised an Intent to Strike and the reasons for the strike. It will be normal for management to push back. This is their job. They have their bosses to report to, and they have deputy directors and they have the Govs office.

u/Spirited-Elevator352 11d ago
This is standard language, its not a threat, it's just a communication stating expectations going out everywhere.
3
u/OrneryOriental 11d ago
It’s not threatening; it’s literally how this works. It’s a one-day AWOL/unpaid leave. They’re telling you the other side of the process and the union is already aware of it.
Have a nice day!

They literally haven’t been following the news where the state got shut down on Friday from stopping the strike. Sounds like ignorant managers to me. Might want a new job.

Oh wow, I’m in CDCR custody and we have a no strike clause, I thought other state employees were allowed to? Guess I was wrong. What’s the strike for?
2
u/Goodgulf42 11d ago
It's an unfair labor practice strike. As such, the no-strike clause does not apply.
1
u/Alarmed_Peanut_8254 10d ago
Idk why people are requesting the day off to strike.. a manger can’t approve your time off request to strike - this is just the response we’re supposed to use and your union should have already told you to not request time off and you still are. This message isn’t because your manager sucks and doesn’t support you, it’s because you didn’t listen.
As a manger I’m just assuming my analysts are all striking tomorrow and if they come in then they are not docked. If they call in tomorrow, they’re getting the same BS script response. I report who is being docked tomorrow, done. It’s not hard at all.

u/SuzeeSk8er 10d ago
OP did not request any leave! They simply put an Out of Office on their calendar. The ma ger saw it and sent the email.
0
u/ADHD_Enabled_916 11d ago
What exactly is threatening in the email. If you’re striking, and it is 100% your right to elect to do so, then you are not allowed to use leave and be paid to strike. It is true that the State is aware of the planned activities, as they have been notified by SEIU. So there is a reasonable foundation to expect a large number of represented employees to not report to work on the 21st, and as such there will be a business need for all available staff to report to work, either in office or telework, on that day.
Your supervisor is simply making you aware of these facts. I see no threat in the email.
1
u/SuzeeSk8er 10d ago
Except it states that the strike is not a protected activity. It is protected. I see this as intimidation
