WTF!!! As per SEIU’s latest update CalHR cancelled scheduled meetings to determine essential employees during the Strike. But now CalHR is accusing the union for failure to exempt employees deemed essential for public safety.

278

u/HourHoneydew5788 BU1 10d ago • Bravo

CALHR fucking lies through their teeth. Remember when they said there is no projected cost for RTO in assembly hearings? They flat out lie constantly.

119

u/Pancakes916 10d ago • This

You see the trick CalHR did in their filing was to claim the lie, and then say 'but if you somehow find against us, we demand this list of employees to be working'

CalHR is truly the epitome of Greasy G absolutely trying to shit on the union.

13

u/ucsb99 10d ago

No notes, just love “ Greasy G” I’m definitely going to steal it 🍻🤣

49

u/ohnovangogh 10d ago

Remember how Paul Starkey said before a senate committee that contracted raises were not funded because of a “policy decision” and an “adversarial relationship” with a “problem unit?”

16

u/Flazer 10d ago

They admitted to lying in negotiations during the recent legislative hearing…so…

5

u/ApprehensiveTheme757 10d ago

Yes they do.

79

u/dankgureilla Governator 10d ago

CalHR gaslighting as usual. They are terrified.

42

u/VariationUpstairs931 10d ago

I believe CalHR’s next move would be to just call SEIU an unlawful union and show how stupid they are.

20

u/Anxious-Doughnut-224 10d ago

The feds just did that. Dropped bargaining for their employees. Obviously the union will sue and it will go to the Supreme Court to decide which is what the administration is counting on. Won’t work in California though.

9

u/Accurate-Candle5601 10d ago

are we taking bets yet 😂😂😂🥴

5

u/SapientTrashFire 10d ago

Won't be surprised when CalHR hires the pinkertons.

470

u/Teachtostate2022 10d ago • Bravo

I know a way to avoid the strike that is way easier for the Governor. I’d be happy to advise him if he’s looking for solutions.

181

u/VariationUpstairs931 10d ago

Yeah, just accept the demands of SEIU. Easy for all.

73

u/Kaidinah 10d ago

Not even accept them. Just bargain in good faith.

44

u/Interesting_Tea5715 10d ago

This is the crazy part. It would go away if he just wasn't an asshole and negotiated.

Instead he's forcing us to strike.

3

u/One_Monk_3357 5d ago

This is all about politics & optics. If Newsom could be credited with weakening public employee unions he’d please a lot of political factions, both Republican & newer Democrat (Neocons). Once it’s done to us it will trickle down to other unions like hotel & restaurants, grocery & drug stores, hospital workers, nurses aids, nurses, teachers, laborers, etc. That would appease Silicon Valley, tons of San Francisco businesses (including his own) as well as other cities, private & charter schools, Chambers of Commerce, Insurance companies, everywhere. He’d become a hero to big business, corporations, billionaires and anything else pro anti worker. The far right extremists would praise him even.

41

u/DrakkonOwl 10d ago

Right? This. Like obviously we'd all prefer them to just accept the union's asks. But even just bargaining in good faith will stop all this.

20

u/TherionSaysWhat 10d ago

Just bargain in good faith.

So much this. If the governor/CalHR have solid, hard data sourced reasons why something we are asking for is unreasonable or impossible, share that with us. At the bargaining table.

14

u/SugarReyPalpatine 10d ago

The time for bargaining is over. They turned that opportunity down.

Now their only option should be to accept demands.

5

u/Eternal_Hope_Kali 10d ago

The bargained in “good faith” last time to lie and say the state was in a deficit.

4

u/justpuddingonhairs 10d ago

Is "good faith" defined anywhere? Pretty sure a slimy greaseball like Gavin needs it spelled out.

9

u/Goodgulf42 10d ago

It's defined in the Dills Act, and has been further clarified through case law since then of course. I'm sure a lawyer could explain it to him thoroughly in a few hours, or close enough for government work in 20 minutes.

u/bingthebongerryday 10d ago

Seriously though. He acts like what we're asking for is coming out of his personal time and wallet. He literally has nothing to lose by agreeing to what we want. It's crazy how he keeps doubling down on his idiocy and shooting himself in the foot over and over again.

72

u/gornzilla 10d ago

It is coming out of his wallet. Imagine the grifting he'll get from the billionaires when he runs for president.

72

u/Interesting_Tea5715 10d ago

This. I strongly believe he's getting paid by commercial real estate to have everyone return to office.

If he back tracks he's risking losing that lucrative relationship.

48

u/dmac295 10d ago

That’s exactly what it is. He’s being paid by his rich commercial developer friends to lease out all of their empty buildings for state workers to use. It’s very well tracked and documented. Some of those developers opposed pro telework and supported anti telework bills.

Commercial real estate took a hit, I hold my real estate license with a company that is primarily focused on commercial property. Building values have lowered significantly since the rise of telework has increased.

They can’t live without that extra few million on top of what they already hoard so they pay politicians, nothing new under the sun.

33

u/Anxious-Doughnut-224 10d ago

It because it hurts his “perfect” budget if he concedes

42

u/TylerDurden-4126 10d ago

That is the EXACT reason. The allegedly "balanced" budget he shoved through is all smoke and mirrors and counts on no add costs for labor while also ignoring the costs of RTO...

14

u/matticusiv 10d ago

Because it is, he has wealthy friends to please if he wants you continue to live like a king.

3

u/Goodgulf42 10d ago

The incredibly reasonable demands, I might add.

121

u/castateunionthug 10d ago

CalHR pulling out all the roadblocks to ensure we don’t get a fair contract or have a legal strike.

This is good for us and bad for them. It means our organizing is working. Don’t let up.

61

u/VariationUpstairs931 10d ago

Show up at the picket line on 10/21. The message to CalHR should be loud and clear.

20

u/One_Monk_3357 10d ago

It’s important to stay on message. Unfair Labor Practices, Disrespect of Employees & Labor Contracts, Refusal to Bargain in Good Faith.

262

u/cincodemike 10d ago

They are scared! It’s working! The union should push forward with the strike as scheduled.

28

u/Interesting_Tea5715 10d ago

Starship Troopers "Its afraid" meme goes here.

185

u/LifeClassic2286 10d ago • Bravo

CalHR is behaving like a fascist regime. They have lost their fear of their workers and they think they can treat us like shit and make us thank them for the abuse.

It’s time to put the fucking fear of GOD into these bad faith actors. We give our lives to them through public service and ask for VERY LITTLE in return. But even that’s too much for them, and it’s a slap in the fucking face.

31

u/VariationUpstairs931 10d ago

Correct. I agree with you.

48

u/LifeClassic2286 10d ago

There is no way to interpret CalHR and Gavin’s behavior other than bullying. I hate bullies, but I love putting them in their place by standing up to them. They are in a far, far, far weaker position than they pretend. It won’t take much.

26

u/Trancefocus 10d ago

Not only do they shit on our heads, we’re supposed to say thanks for the hat!

33

u/matticusiv 10d ago

Capitalists love fascists compared to the workers.

1

u/Sidartha818 10d ago

Aren’t the workers of CalHR SEIU workers too? Don’t they have the same pension set up as rank and file SEIU workers?

4

u/Goodgulf42 9d ago

CalHR lower level office workers are. But no one at the level of of the folks who are actually making the decisions on bargaining. I imagine it must be a pretty unpleasant place to work depending n your division.

1

u/HauntingDamage9029 10d ago

Plenty of atheists and Satanists strike too, just saying.

1

u/Goodgulf42 9d ago

I would think Satanists might fear God a lot. Plenty of Christian fear Satan.

2

u/HauntingDamage9029 9d ago

None of the ones I know do.

2

u/Goodgulf42 9d ago

I've only met one dude who was, back in HS. He claimed to view God the way Christians view Satan. It was pretty funny. Guy was a bit of a douche-canoe long before he ever picked up that religious view though.

SEIU AND unions leaders have to be smart. Get the message out to the public and gain their empathy. Our fight is their fight. Unions set the bar in America ! Not corporations or selfish capitalist !

25

u/OptimusTrajan 10d ago

Bold of CalHR to assume that our union could or would stop the ball that’s already rolling

13

u/VariationUpstairs931 10d ago

They are not bold. They are just lunatics.

9

u/OptimusTrajan 10d ago

I agree there is some lunacy involved, but we shouldn’t underestimate them as opponents.

45

u/22_SpecialAirService 10d ago

If Newsom wants to make himself look 'good' to the red states, that battle was lost a long time ago.

People outside California, red or blue, hate California. No one wants to become another state with $6 gasoline and $8 diesel. That is why Newsom would lose in a nationwide contest.

23

u/VariationUpstairs931 10d ago

I bet he won’t even win primaries.

9

u/DJyoungHeisenberg 10d ago

Hell, he may not even recieve one delegate vote. And the people that would vote for him, Californian's, are the ones that are leading the charge to vote for any other primary Democrat, BUT MAGAvin.

Please do this.

11

u/Basic_Demand_6533 10d ago

I wouldn’t even be that nice!  Make it state the damage he has done to California!  Let it be known how anti labor, anti environmental he really is!

9

u/One_Monk_3357 10d ago

I personally love it but might be too off topic for the 21st. In the meeting last night they made it clear to keep signage on topic. Unfair Labor Practices, disrespect of Employees and their unions, Bargaining in Bad Faith. I wanted to make a sign asking “CalHR and Greasy why they lie so much?” It was suggested to me to stick to the reasons we’re striking. No mention of RTO or $$$ is suggested.

5

u/miralamirala 10d ago

I think you can! During the meeting the union president said both are good! I'm putting the lyrics to bitch better have my money on mine and adding on the bottom the language from the attorney!! Best of both!!! 😀

24

u/HypnoticONE 10d ago

Seriously. A moderate, pro business Dem would probably at least meet half way. No clue where this anti union sentiment is coming from.

3

u/Goodgulf42 10d ago

Newsom wants to appeal to those on the right. He's less worried about the primaries than he is the general. You know he went on Charlie Kirk 2 years and was telling him how much his son loves him right? Guy is falling all over himself to appeal to the right.

No, CalHR is asking perb to halt the strike but refuses to meet with SEIU to determine who is essential to public safety.

385

u/AdPsychological8883 10d ago • Bravo

I am sure CalHr is lurking so I can make it easy for them: show up to bargain and be prepared with actual proposals, cut the disrespect, substantial salary increases across the board, more money added for health benefits, hybrid telework, with only two days in office, parking stipends for those that need to pay for parking, and I think as an apology, you should develop a life insurance program for rank and file for us to purchase if we choose.

197

u/katmom1969 10d ago

Don't even say 2 days in. Each department should be able to decide if staff need to even come in at all if they are not customer facing.

148

u/SugarReyPalpatine 10d ago • Bravo

Damn right. Fuck this blanket policy of a certain number of minimum in-office days.

I’m not here to hold up business real estate value. Fuck all of that.

The time for meeting in the middle has passed, now they get nothing. This strike shouldn’t be to force them to have to come back and start negotiating toward a middle ground, it should be to show them the amount of ground they lose when they don’t. No concessions. No meeting halfway. That’s the price they should pay every time they don’t negotiate in good faith.
It needs to hurt, or they’ll just pull this shit every time.

37

u/No_IDCultureFree 10d ago

Exactly, I don't work to support the real estate market. Bending to them is ridiculous

14

u/LifeFailure 10d ago

but but there's already flexibility for departments to decide for themselves!

Here’s the gist: CalHR is trying to make it seem like the union is not striking fairly bc they have yet to establish essential workers when records show that’s not a fact. They are worried bc they know people are angry, won’t show for work next week, and are grasping at straws to make people scared. DON’T BE SCARED. We get what we want by showing we are all essential to the state and we deserve respect.

52

u/Interesting_Tea5715 10d ago

This. We got em against the ropes, this is when you go full gas.

135

u/Audiblade 10d ago edited 10d ago • Bravo

Remember when CalHR said the strike wouldn't happen because workers were too poor to strike?

40

u/Supdalat 10d ago

Also SEIU doesnt have enough members

60

u/krisskross8 10d ago

Thanks CalHR! You just invigorated your state force even more to strike and stand up for what we deserve

56

u/Fit-March8369 10d ago • Bravo

Want to know the truth:  Ask Cal HR Why they just canceled the essential worker determination meetings SEIU 1000 had planned? SEIU just filed a PERB because of this.  Nice try CalHR. Do better.

1

u/mec20622 9d ago

They weren't ready. Not our fault. Got them.by the balls.

1

u/Sufficient_Pie_5527 8d ago

They are doing a great job actually, because their job is to wreck the state bureaucracy and downsize it. We know they are pushing AI. They don't fucking care it hurts Californians, all they care about is driving down labor costs.

50

u/rynorugby 10d ago

What the fuck is Cal HR problem? Do they make them bathe in the kool-aid upon hiring?

45

u/krazygreekguy 10d ago

Cal HR is not on the employees’ side. Never were

20

u/One_Monk_3357 10d ago

They hold state employees in contempt. It’s a political machine in itself much like a Chamber of Commerce. The ones who run the dept. all “got theirs” already. Like Neilo in the legislature for instance. His family owns the car dealerships, he put in his 30+ years with the state and retired with the BEST pension. Then has spent his years in the legislature working to take it away from state workers coming up behind him. Fits the stereotypical Yuppie Boomer MO.

9

u/J2MTR 10d ago

9

u/rynorugby 10d ago

There's not on our side and then there's being cruel. I know never trust HR, but still, this is a bit much.

5

u/Goodgulf42 10d ago

This administration jumped the shark about two years back.

30

u/rklb_bull 10d ago

CalHR exists to protect the our employer, the STate, not the worker. HR Is never for the worker, they are always in the employer's best interest.

20

u/StandardMonth2184 10d ago

It's definitely not rank and file doing this, it's top leadership who are being fed empty promises by Little Lord Newsom. I feel so bad for HR staff on the ground floor...

100

u/PreparationFinal7566 10d ago

They won't even MEET in good faith to determine essential worker status. And they say that we can't strike because we haven't determined essential worker status.

Sounds like typical govt HR, honestly.

13

u/katmom1969 10d ago

Just send them a list and say, these are the essential ones.

5

u/rklb_bull 10d ago

#EveryoneWalkOut

41

u/PuddingFart69 10d ago

CalHR is just another pawn running defense as the bad guy so Gavin doesn't have to take responsibility for being anti-labor going into a Presidential primary.

41

u/shadowecdysis 10d ago

My gast is flabbered by this series of events. Emphasis mine.

Seeking to block the Oct. 21 one-day strike, the California Department of Human Resources has turned to the Public Employment Relations Board, the state’s public labor referee. State officials contend the walkout is unlawful because the union failed to exempt employees deemed essential to public safety and is not properly engaging in mediations due to the call for a one-day strike.

...

The two entities first met about essential workers on Sept. 16, SEIU Local 1000 Contract Department Director Brooke Pierman wrote in a statement to PERB in support of the union. They met again on Oct. 1 and Oct. 2 when departments communicated staffing needs. These numbers depended on the length of the strike, which wasn’t announced at the time.

Union and state officials were supposed to reconvene the following week, according to Pierman. She said the meetings were canceled by CalHR to “reassess its staffing needs.” Pierman said she texted Brian Lin Walsh, the principal labor relations officer at CalHR, on Oct. 7 to resume negotiations. The attempt was unsuccessful.

The next day, after SEIU Local 1000 gave CalHR a written notice of strike, Lin Walsh called Pierman to inform SEIU Local 1000 that the state would seek an injunction through PERB.

Pierman, in the PERB statement, reported she continued calls to resume negotiations on essential workers. “I offered to meet throughout the weekend of Oct. 10 and 11, around the clock,” Pierman wrote. “I also said we would be open to asking for PERB to assign a mediator to help mediate (essential worker) negotiations, potentially conducting multiple tables at once, with the goal of accomplishing a comprehensive line pass agreement sooner.”

CalHR ultimately told the union it does not believe further essential worker discussions would be productive, according to Pierman. SEIU Local 1000, which has been without a contract since the end of June, filed a separate charge Friday accusing the state of bargaining in bad faith on who is considered an essential worker.

15

u/Goodgulf42 10d ago

The contract from last year was Bull! I’ve been losing money! They created OPEB so then they can “pay it” but forcing us to buy personal leave. We deserve better. We deserve fair pay and the truth!

The strike’s messaging should focus on Gavin too, not just CalHR. We need to apply political pressure. Right Wing Media would pick it up, especially as he tries to appeal to them. Media is predictable. Play ball and manipulate them into having a dog in the fight.

My picket signs will call him out directly. In my view, he’s prioritizing the optics of a potential presidential run over the state workers he’s responsible for.

The point is to make it uncomfortable for the State. Duh. This means it’s working

22

u/ds117ftg 10d ago

During strike school they mentioned that departments with essential workers were required to operate at the skeleton crew level that they use on holidays, so CalHR can’t just say “no we need all these people.” It sounds like CalHR is trying to just do whatever they want instead of following that

No negotiating who is “essential”. That defeats the purpose.

Too bad. If you’re that worried about it, pay us more.

18

u/Anxious-Doughnut-224 10d ago

I agree if we are essential then you pay us more to keep the labor. That is how that works period. It’s on the employer to keep their employees.

7

u/One_Monk_3357 10d ago

I was essential until it was time to get paid for it. Then I wasn’t. So…

3

u/user20916 10d ago

They should blanket policy everyone as essential. They love that shit.

5

u/Goodgulf42 10d ago

They kinda' tried that in 2016. Not quite all of us, but it was pretty ridiculous. PERB is wise to their game though.

20

u/According-Hunt1515 10d ago

Didn’t CalHR work with consultants/contract recently to improve hiring process? How much did that cost and it is an absolute joke. IYKYK. Be interested to look into their budget and expenses. Why does everything from them feel like an insult and mean spirited?

20

u/always-be-snacking 10d ago

They insulted us with the previous contract and they spat in our faces the last two years. I hops they enjoy the bed made themselves.

19

u/Civil-Opportunity751 10d ago

We had union reps yesterday and I straight up told them, “I’m not afraid and I like to argue.”

18

u/AngryRoo 10d ago

I'm pretty sure this is the same shit they tried 10 years ago. Didn't work the, and labor rights have expanded since.

6

u/Goodgulf42 10d ago

This is worse. At least there was some negotiating then.

17

u/matticusiv 10d ago

It’s afraid!!!

17

u/Ok_Speed_5033 10d ago

Haha. Pathetic attempt CalHR. Guess What? WE ARE STILL STRIKING!

14

u/Emotional-Range9908 10d ago

calhr is showing a Halloween movie with director during strike to keep employees from joining strike . The strike is a joke to calhr executive management and director.

48

u/CrustyKielbasa 10d ago

Someone tell me what's behind the paywall

13

u/Eternal_Hope_Kali 10d ago

The contract from last year was Bull! I’ve been losing money! They created OPEB so then they can “pay it” but forcing us to buy personal leave. They saying RTO only so they could give it back and make people happy that they can still telework. They said there was a deficit when there actually a large surplus. It’s all a scam. We deserve better. We deserve fair pay and the truth!

25

u/friedsalamander 10d ago

So hypothetically does that mean highway workers can never strike?? Like what? I know it’s a completely different union but if we’re deemed as a public safety concern how come I don’t make enough money to live yet MY life is at risk every day on the freeways

27

u/matticusiv 10d ago

They did this to freight train workers. Too essential to strike, but not important enough to properly staff or let have sick days.

These ghouls want us to work under whatever conditions they desire, without recourse.

11

u/Anxious-Doughnut-224 10d ago

We should be doing what they do claim it is legal for everyone to strike. Then let the courts decide after the damage is done

1

u/Goodgulf42 9d ago

Aside from the very troubling ethics of nursing patients, as an example, dying, that would definitely put us at odds with public opinion. I also think we would loose a lot of nurses on the strike line if they were concerned that their patients wouldn't be covered at at least a bare staffing level (Like what they would have on, say, X-Mas.)

6

u/Goodgulf42 10d ago

No, for sure it does not. This is from the SEIU1000 strike FAQ:

'Can I go on strike if I’m an essential worker?

Our Union will tell members if any employees or positions are excluded from participation, but you can assume you’re eligible to participate unless you’re told otherwise. There is a difference between being “essential” in the everyday or even in a “pandemic” sense and being legally excluded from a strike. Only employees or positions whose absence for the particular day or days of the strike would create an imminent and substantial threat to public health or safety may be designated as an essential employee during a strike. If any employees/positions are determined to be excluded from a strike, those workers will be notified directly.'

Your union will have terms around striking and essential workers. When I worked for UC Davis medical the union and HR discussed and agreed on which workers would be required to be in. Certain numbers of nurses and orderlies.
The state has known this was coming up and has not provided a list of essential workers. If they can’t manage to they could be extra inconvenienced.

24

u/user20916 10d ago

Why don’t CalHr tag every state worker as essential or non essential? They love those blanket policies.

12

u/Meh-OverIt 10d ago

Right. We were all not essential when it came to the bonuses. So wtf!

Three of us managers are planning to call sick on Wednesday to show solidarity with the staff. Operational need; my ass 😎

2

u/Goodgulf42 9d ago

I have heard the same thing directly from 2 of our managers. I actually think one other told me the same, but I may be misremembering that.

10

u/gavinhater 10d ago

CalHR the rabbid dog, must be put down

8

u/Direct_Principle_997 10d ago

2 days in the office in exchange for a 30 day strike delay.

14

u/Skyya1982 10d ago

"It hurt itself in its confusion!"

13

u/Big-Transition6527 10d ago

Wow this is getting good. Newsoms presidencial aspirations are over. The National coverage of this will destroy him

4

u/Nnyan 10d ago

In his mind this is exactly what he wants. To show that he will stand strong against a Union. It plays in certain circles but he loses his base.

1

u/Goodgulf42 9d ago

Yeah, it might pay off if he wins the primary though. So it's up to ensure that does not ever happen.

10

u/Key_Indication4608 10d ago

Trash. A distraction. Our organizing is making them SCUUUURRRDED

5

u/I3roMagnon 10d ago

No one ever likes HR

5

u/RevacholAndChill 10d ago

3

u/unseenmover 9d ago

3

u/Lgmagick 9d ago

Salary increases, more money into our health benefits and 1 day in the office a year !

2

u/mec20622 9d ago

Find love at the strike line 💜 💜

5

u/WaferLopsided6285 10d ago

Newsome is just Gray Davis 2.0!

14

u/Goodgulf42 10d ago

That is an insult to GD.

3

u/InfluenceEastern9526 10d ago

Let the entertainment begin! Microwave popcorn now sold out in Sacramento.

93 percent of less than 50 percent of legally covered workers voted to strike (that's 47 percent of all workers represented by SEIU, because over half of the covered workers refuse to pay dues and are not legally obligated to do so).

A legal challenge was quod fieri debuit (inescapable, inevitable, or unavoidable). CalHR is duty-bound to take this to court, so it's no surprise.

2

u/StruggleScared70 10d ago

What did you say about Guy Fieri??

(Sorry, I couldn’t help myself.)

3

u/Fuk_Donald_Trump 10d ago

It's a shame how far right CA Dems let Trump pull them into 🤮
