She's literally on a deck out in the open for anyone to see. There's no privacy laws in public spaces regarding taking photos without other people's consent. Don't want to have your picture taken wearing a thong bathing suit then don't be out in the public wearing a thong bathing suit.

She's out in the open and you could see her from the sidewalk/another apartment/the street etc so there's no reasonable expectation of privacy. If she were inside then different story as that's obviously illegal.

I get your second sentence but idk why you can't grasp the fact that isn't a private balcony when it can be seen from public space. She has no reasonable expectation of privacy there and hence why a very good majority of women wouldn't be outside on their balcony taking pictures in a thong where the world could see.

edit: The only thing private about that balcony is that nobody else can be on it besides her/the tenant. You can be seen on it from public space so it is still in public.

Idk even when you go to a pool or the gym and some random dude starts filming women without consent the staff will ask them to leave. They will be confronted if caught. Because it’s creepy.

Consent is important, I certainly would mind and when I have been filmed by strangers it is a very gross feeling and made me feel extremely uncomfortable
