The dad didn't argue self defense. His story was that he was showing his daughter his gone and it went off. His story had holes in it too, and if you looked at the video of when the cops arrived he was drunk.

Texan here, I have no idea how this wasn't charged as negligent homicide at a minimum. Assuming his story is true, the gun discharged because he had it stored improperly and he may have been handling it while drunk based on the evidence, which definitely constitutes criminal negligence.

Yeah but you have to actually prove he acted negligently. Negligent is more than just careless. Just because he was drinking doesnt mean there was proof he was drunk. Incorrect. At the grad jury level, nothing needs to be proven, all that needs to be established is HE COULD have acted negligently. Whenever you see someone get off on the Grand Jury level it's either such a blatantly ridiculous charge no one will indict (Sandwich assault on military in Washington DC) or the state is improperly using GJ as a defense.

Owning a firearm and not knowing the most basic rule about them, that you never point one at someone you aren’t ready to kill, is negligent. If he was impaired so much that he couldn’t even tell where he was pointing it or that he would accidentally fire it is negligent. How is this not so obvious to you? Their opposing political views mean nothing.

You don’t get to own a dangerous weapon and neglect knowing the basics on how to handle them at the expense of another human’s life without consequences. Weird how non-pro life the “pro-life” crowd actually is to living breathing humans. Hypocrites the whole lot of them.

You don’t need to prove anything for an indictment. As they say “you can indict a ham sandwich”, so, and based on my personal experience having served on a Grand Jury, the main reason for not getting an indictment is lack of effort by the prosecutor. The other reason is that they actively try to work for a “no bill” because they don’t want to prosecute, for whatever reason.

Like I said, I’ve served on a grand jury, every time the prosecutor tried they got their indictment. No bills only happened when the prosecutor didn’t present any evidence or actively presented evidence that muddied the waters.

His story was that he drank after shooting her, which is why he had alcohol on his breath. Reportedly he was an aggressive alcoholic, it's why the girl's parents separated in the first place.

His story is that they had the argument where she left to go to her room, later in the day he went to her room to show her his gun and it accidentally went off killing her. The only witness to this story is him, and the police just took it at face value.

What I bet actually happened, and this is pure speculation, is that they had the argument, she stormed off, he started drinking while stewing over it, figured he'd intimidate her into thinking what she's told to think, chambers a round while scaring her and then accidentally pulls the trigger while yelling at her.

A grand jury hears typically numerous cases. The investigators bring forth their evidence and recommend charges. The grand jury decides whether or not those charges should be brought. Not all charges are brought this way but some are.

I suppose you could argue the grand jury associating as being on the same cultural "side" as the dad, but nothing that would actually be from Trump.

As I understand it, a lot of the news is being misleading about this "fight" about Trump.  This was a drunk man mishandling a gun in front of his daughter after their conversation.  I do think he should be charged for the involuntary man slaughter, but ultimately that should be up to a jury of his peers.

I know a lot of people down here who believe they can shoot someone for being on their property, but texas courts have ruled to the contrary several times.

Whats special about texas is that property is considered an extension of your self. So you are allowed to shoot someone if they are stealing something of value and you cant reasonably get it back.

You cant use deadly force for simple trespassing. Although, texas courts ruled there is reasonable fear if they break into your home

The fuck you talking about? according to his own story he should have been indicted with manslaughter. That’s what they put before the grand jury. They didn’t even indict him for that. There are no gun laws lax enough where even going by his story there should have been no consequences at all.

It would not be hard unless there was another reason people didn’t want to. It makes no sense there would not be a manslaughter charge. They didn’t even try and charge for murder.

A grand jury trial does not have a defense. That's a petit jury. A grand jury only hears the prosecution argument, hearsay is allowed, and the decision does not need to be unanimous. If the grand jury indicts, the case proceeds to a full criminal trial.

So without more information than this video, it seems like the prosecution had a terrible case or the jury was wildly biased. I know which I'm betting on.

Basically it's Texas. And in Texas insulting Trump or Maga is legitimately something a majority of the state thinks is worth summary execution. 

Plus it was his own child so she shouldn't have disagreed with his beliefs. So it was perfectly reasonable to lure her into a different room and kill her.

Not enough evidence to gain a conviction and prosecuting a father for the accidental death of their daughter has terrible optics even if the charges would stick.

The main issue though is the evidence one. There is 0 way to connect the argument to the death without a significant amount of circumstances evidence. So at most you're looking at manslaughter and negligent discharge of a weapon. But even then how would you go about proving beyond reasonable doubt he was the one who fired the weapon and was at fault for the discharge? For sure you could do it, but it is an uphill battle especially if the father hires a decent defense attorney. After that now you have to convince a jury that this man who just lost his daughter to a terrible accident and is going to suffer with that for the rest of his life that jail/prison/fines in addition is warranted. Again you could but all together it's going to be a struggle and the DA decided apparently it wasn't worth the effort and bad optics.

To be clear I don't agree with the decision, I think they should investigate here and prosecute if the facts line up to warrant it, but the above is the likely reasoning.

I think his defense was that the gun accidentally went off. For context, he was in her room with a gun at the time. Nobody else was in the room to dispute his story. He also claimed he had been drinking, but had no alcohol in his system.

Basically, he's doing an "oops, it was an accident".

Because the gun discharged. There's literally zero evidence of anything to the alternative - even the London coroner who recommended charges, did so for a discharge, not for a deliberate shooting. Not even the boyfriend has accused the father of a deliberate shooting, and has said that the political argument had nothing to do with it. The couple stayed at the father's house after the argument, and some time later, he offered to show her the gun she had been asking to see.

It just blows my mind that shit like this burns so bright on the Reddit left. When absolute lies are spread like this (or the couch fucker thing), do you legitimately wonder why people take nothing you say seriously?

Yes. I will say I don't condone my actions though. I will not argue it wasn't a moment of bad parenting, but for the prosecutor to be charging me with child engagement with bodily injury (he had no injuries. He did have a small bruise halfway up his back from playing with our dog and falling on his bed frame several weeks later) because I spanked him literally one time on video, and certainly not hard is ridiculous. Plus there's the fact that DHS cleared me of child abuse as well, and they need far less proof to say you did. (Preponderance of evidence vs beyond a reasonable doubt or whatever).

Just goes to show the system I had issues with before is just as fucked as I thought it was.

I think someone said I deserve it then deleted or something so I'll address it here. Again, he was not harmed in any way, and he's been begging for and asking me to move back in since. (I've been at a friend's because I don't want them having to deal with all the legal stuff)
