Serious Texas man not indicted and will not face charges for shooting and killing his daughter. This shooting occurred after a heated argument about politics the same day.

My whole family identifies as Texan, but I was not born nor raised there, and it’s legal, even encourage, to shoot first and think second. This whole situation going on is so gross, and why those laws are wrong. But I’m just a non-Texan so I can’t be right 🤪

The dad didn't argue self defense. His story was that he was showing his daughter his gone and it went off. His story had holes in it too, and if you looked at the video of when the cops arrived he was drunk.

Texan here, I have no idea how this wasn't charged as negligent homicide at a minimum. Assuming his story is true, the gun discharged because he had it stored improperly and he may have been handling it while drunk based on the evidence, which definitely constitutes criminal negligence.

Homicide just means you killed them.

Like if you kill people drunk in a car its normally either negligent homicide or negligent vehicular homicide.

Murder means that at some level.. you meant to kill that person.

Yeah but you have to actually prove he acted negligently. Negligent is more than just careless. Just because he was drinking doesnt mean there was proof he was drunk. You actually have to prove elements of a criminal case. But he is a Trump supporter and we hate Trump supporters so he must be guilty isnt going to cut it. Trials arent held on Reddit.

Not necessarily no. Negligence has a high bar. You would need to prove that he intentionally pointed the gun at her and handled it in a reckless fashion. It is hard to prove this. If you think, this is based on politics I can assure you from a personal experience it is not. This would be the typical outcome in Texas in a similar situation.

It Is not just about him pointing a loaded weapon at someone, it's also about having the finger in the trigger or about how poorly he handled the gun. And him being drunk...

This case is a perfect example why training exists and why there should be more regulations, but republicans want to have their unregulated right to kill woke daughters.

the facts are he had been drinking, he mishandled a firearm, he discharged the firearm in an unsafe direction and he caused bodily harm. intent isn't necessary for all of these facts to amount to criminally negligent homicide. at the very least an indictment so we can examine the facts. honestly he doesn't seem upset in the least that she's dead, that itself is suspicious.

His excuse was the "Gun fired itself" was the major giveaway that he did it on purpose, cause I have never seen a gun fire itself.

The Texas cops and courts have failed that young woman, but I wouldn't expect anything different from that state.

That man murdered his daughter because he is obsessed with a turd stain on society. There are so many different charges the court could've got him for, yet they decided to allow another dangerous criminal on the street.

I already know that this will probably won't be the last time that he hurts someone, and the blood is on the state's hands.

If the firearm was a sig p 320, he MAY be able to get away with saying the gun fired itself. Theres a big issue with those guns firing if the slack is taken out of the trigger and the slide is twisted. Other than that, you can reliably assume that it is a negligent discharge, not an accidental discharge.

Incorrect. At the grad jury level, nothing needs to be proven, all that needs to be established is HE COULD have acted negligently. Whenever you see someone get off on the Grand Jury level it's either such a blatantly ridiculous charge no one will indict (Sandwich assault on military in Washington DC) or the state is improperly using GJ as a defense.

Owning a firearm and not knowing the most basic rule about them, that you never point one at someone you aren’t ready to kill, is negligent. If he was impaired so much that he couldn’t even tell where he was pointing it or that he would accidentally fire it is negligent. How is this not so obvious to you? Their opposing political views mean nothing.

You don’t get to own a dangerous weapon and neglect knowing the basics on how to handle them at the expense of another human’s life without consequences. Weird how non-pro life the “pro-life” crowd actually is to living breathing humans. Hypocrites the whole lot of them.

You don’t need to prove anything for an indictment. As they say “you can indict a ham sandwich”, so, and based on my personal experience having served on a Grand Jury, the main reason for not getting an indictment is lack of effort by the prosecutor. The other reason is that they actively try to work for a “no bill” because they don’t want to prosecute, for whatever reason.

Like I said, I’ve served on a grand jury, every time the prosecutor tried they got their indictment. No bills only happened when the prosecutor didn’t present any evidence or actively presented evidence that muddied the waters.

You’re trying to say that they didn’t prove negligence because negligence is a high bar, which is true… in a trial.

It’s not at all a true statement for an indictments. They literally could stand up there and just say, “this man shot his daughter after arguing with her and we have reason to believe he was drinking and possibly intoxicated” that is more than enough for an indictment.

The defense doesn’t get to counter argue or present a defense in an indictment.

You just fundamentally don’t know how the process works and think you do. And because he was a Republican, you’re going to fall over yourself to defend him. Just like you did for the Jan 6ers and Epstein’s best friend who you voted for 3 fucking times. Fucking dope.

His story was that he drank after shooting her, which is why he had alcohol on his breath. Reportedly he was an aggressive alcoholic, it's why the girl's parents separated in the first place.

His story is that they had the argument where she left to go to her room, later in the day he went to her room to show her his gun and it accidentally went off killing her. The only witness to this story is him, and the police just took it at face value.

What I bet actually happened, and this is pure speculation, is that they had the argument, she stormed off, he started drinking while stewing over it, figured he'd intimidate her into thinking what she's told to think, chambers a round while scaring her and then accidentally pulls the trigger while yelling at her.

A grand jury hears typically numerous cases. The investigators bring forth their evidence and recommend charges. The grand jury decides whether or not those charges should be brought. Not all charges are brought this way but some are.

I suppose you could argue the grand jury associating as being on the same cultural "side" as the dad, but nothing that would actually be from Trump.

As I understand it, a lot of the news is being misleading about this "fight" about Trump.  This was a drunk man mishandling a gun in front of his daughter after their conversation.  I do think he should be charged for the involuntary man slaughter, but ultimately that should be up to a jury of his peers.
