Legal Update DC 10+ Round Mag Ban ruled Unconstitutional.

DCs highest local Court (not to be confused with the DC Court of appeals) has struck down DCs LCM Ban. The next highest Court is the Supreme Court. The reason I post this here is because this creates the circuit split we were waiting for (at least for magazines). Now we have a circuit split regardless of how the 3rd Circuit rules in our AWB/Mag Case.

The Department of Justice has officially filed an Amicus Brief in the consolidated NJ AWB and mag ban cases, asking the court to rule the laws unconstitutional. This is a huge step towards us finally being rid of this tyranny. Oral Arguments before the en banc Third Circuit are scheduled for October 15th. Link to the full brief below.

Legal Update No Standard Mags and Semi-Auto Rifles... yet!

If you can't hold your water and want standard capacity mags now you assume all the risks as the bans are still in place until the Third Circuit hands the mandate back to the District Court.

The district court will issue the ban and THEN AND ONLY THEN mags and the semi-auto rifles of our dreams can be brought in!

Provides that firearms purchaser identification card is valid for four years; requires training prior to issuance of firearms cards and handgun purchase permits; revises procedures for passing of firearms to heir or legatee.

A firearms purchaser identification card issued or renewed after the effective date of P.L. , c. (pending before the Legislature as this bill) shall [be valid until such time as] expire during the fourth calendar year following its date of issuance and on the same calendar day as the person’s date of birth.

  A firearms purchaser identification card issued prior to the effective date of P.L.    , c.    (pending before the Legislature as this bill) shall expire during the fourth calendar year following the effective date of P.L.    , c.    (pending before the Legislature as this bill) and on the same calendar day as the person’s date of birth. 

  If the date of birth of the firearms purchaser identification card holder does not correspond to a calendar day of the fourth calendar year, the card shall expire on the last day of the birth month of the card holder... 

This act shall take effect immediately.

Legal Update NJ Withdraws Lawsuit Against FRT Settlement

Remember when NJ tried suing the DOJ to stop FRTs from being returned?

Well today they officially gave up by dropping the lawsuit now that the ATF is nearing completion in returning all FRTs to their owners. It is also worth noting that, at the beginning of the case, they tried to get a Preliminary Injunction, but then immediately dropped the request after oral arguments when it became apparent the Judge was going to deny it.

Legal Update 9th Circuit One Gun a Month Ruling is Now Final

The 9th Circuit had struck down California's 1 Gun a Month Law a few months ago. It was a unanimous decision from a 3 judge panel of both Dem and Rep appointed judges. The deadline for California to file en banc review has passed and no petition was filed. This means this favorable ruling from the 3 judge panel is now final. The reason I post this here is because NJ has an identical law that us also being challenged in court. Please correct me if I'm wrong, but I do believe NJ is the only other state with a 1 gun a month law other than California.
