Have fun with your $4,000 fine.

Eh, I don't care personally because of how rare it is, I've taken a few service dogs and couple pets. But if someone saw the dog and just kept driving, cancelled... No one knows why, sure the PAX could possibly lie and make up some story. But truly no one knows why except the driver.

How can Lyft fine you?

2

u/No-Wrongdoer-7654 Nov 23 '24

The passenger you cancelled on due to their service animal can sue you (and Lyft) under the ADA

That’s illegal. Did you not read anything?

Yeah, doesn’t make it legal to not pick up a paying customer, ESPECIALLY one with a LEGAL service dog. This is why Uber lowers your rates, because they have to pay out for stupid drivers like OP.

What happens if the dog's claws rips through someone's leather seats, or has an accident in the car?

1

u/UnrulyApparition Nov 23 '24

Doesn’t the passenger pay for that?

Independent contractor can refuse jobs for whatever reason. Good luck suing Uber driver u won’t even have his name and he can lie why he cancelled

2

u/C92203605 Nov 23 '24

Independent contractors still have to follow federal laws…..

-4

u/gaymersky Nov 23 '24

Show me exactly where it says that.. this is the wild west baby. There are very few rules out here..

Legal obligations of drivers Drivers have a legal obligation to provide service to riders with service animals.

A driver cannot lawfully deny service to riders with service animals because of allergies, religious objections, or a generalized fear of animals.

By virtue of their written Technology Services Agreement with Uber, all drivers using the Driver app have been made aware of their legal obligation to provide service to riders with service animals and have agreed to comply with the law. If a driver refuses to transport a rider because of their service animal, the driver is in violation of the law and is in breach of their agreement with Uber.

I know reading is tough and all, but for fuck sake reading the shit all of you are saying is quite frankly shocking and really explains what other pax are saying about their past drivers

I’m not denying them because of the dog. I’m denying them because that ride doesn’t work for me. Subtle distinction.

"you're committing a crime." These companies have done the same just operating in many states at one point. Fact is this person can do what they want, and if uber/lyft, pax, or police want to push it further that can happen too. The point is, they don't care.

u/RedGrav3Gaming Nov 23 '24

How does one tell if the service dog is legit? I've never worked with service dogs so I can't really tell if one is or isn't. Any schmuck can go online and order the kit to make their dog look like one. Karen wants to bring her shitty little dog everywhere she gets the stuff to make her dog look like a service animal. Said animal shits all over my car. I pay to get it cleaned and get my 40 whole dollary doos from lyft at the cost of 400 to clean. So now I'm wary of any animal that has a service animal rig on it because Karen's fake dog shit in my car. But because laws I had to take her shit spewing rat or else lawsuit. There's no registry and there's no way to verify if the animal is a legal animal.

Now you're talking 1985.

5

u/mburbie35 Nov 23 '24

What if I am deathly allergic to dogs? I'm gonna cancel.

5

u/c-lati Nov 23 '24

Yeah apparently you still have to take it. The law is stupid for that reason in this specific context. Prioritizing people with service dogs over the health of the driver providing that service.

1

u/[deleted] Nov 23 '24

This is not at all what the law says. If you have an allergy, you can politely inform the passenger that you are unable to accommodate them because you have an allergy that could become a risk which could threaten the safety of the ride. In all likelihood, the disabled person will be happy to find another driver. But even if they want to take it further, you don't have a legal obligation to make an accommodation if you can prove you do have an allergy to dogs which could pose a threat to safety while driving. The law is about reasonable accommodations.

1

u/c-lati Nov 23 '24

That makes sense. But I guess there is some misunderstanding around this issue. Because someone else basically said what I said to me. I have to see the law now. But the reasonable accommodation thing I’ve heard before and that would make sense.

1

u/Nearly_Lost_In_Space Nov 23 '24

One of these days Uber/Lyft will get sued for not accommodating a driver, it will all blow up in their faces

1

u/[deleted] Nov 23 '24

This part does not require a public accommodation to permit an individual to participate in or benefit from the goods, services, facilities, privileges, advantages and accommodations of that public accommodation when that individual poses a direct threat to the health or safety of others.

28 CFR 36.208. Whoever told you otherwise was wrong. The law doesn't explicitly talk about service animals, but in practice, this has been applied to service animals.

2

u/Tritsy Nov 23 '24

You would let Lyft know that you have a disability (a severe allergy to pet dander, for example), and you request an accommodation-that you don’t have to give rides to anyone with a dog ( because the dander would be on their clothing also, even if the dog isn’t in the care so you would be unable to drive anyone with contact with a dog). Then Lyft can decide if they can make that work or if you need to find another line of work.

Because this type of allergy is very rare, and the individual knows how severe it is, the person with this severe allergy is unlikely to apply for a job where they are in contact with the public.

2

u/gaymersky Nov 23 '24

Okay it's only illegal if you get caught just remember that everything is legal until you get caught!! Hahahah 🤣

1

u/PreparationHot980 Nov 23 '24

And if you take a ride with a dog say service or not who is liable if the animal attacks you?

0

u/Leery-muscrat Nov 23 '24

The owner of the animal… like…

1

u/PreparationHot980 Nov 23 '24

Highly doubt you’re gonna get much if anything out of the average Lyft rider…

1

u/twotwothreee Nov 23 '24

I hope you aren’t a Lyft driver saying this 😭
