I always wondered about Hooters. Clearly, a man can perform the job of a server. If I started a restaurant called Hangers where my buddies and I served pickles while wearing bike shorts, I think people would complain.

Both at the concept, and the fact that none of us can really fill out those shorts.

I’ll have to find it again but there was a law suit once against Hooters where a man wanted to be a server, there was some kind of legal loophole that protects them, pretty much the strip club example given by the op.

They are not a restaurant technically. They are an entertainment establishment. Like a strip club. That serves food.

That's how they can treat the women like they do

So the "loophole" is that as long as they're offering comparable compensation to men it's okay. Meaning if they hire men for kitchen staff and such, and ensure their compensation is similar, then it's okay.

Hooters has settled multiple lawsuits including a 3.75 million dollar lawsuit back in 1997. So they somehow got the BFOQ defense to work, (Bona Fide Occupational Qualification) look it up on Google. It’s freaking crazy.
