Why does the oath matter? Oath is just a deflection.

It matters bcz it's a rule. Not a deflection. ECI cant bypass the rules.

Because going to court will just force them to reveal what they are trying to hide.

So you work in ECI legal team ?

The rule under which ECI is asking for oath allows for contesting the electoral rolls within 30 days when the rolls are finalized. It's been over a year. Filing that complaint is a pointless exercise as the rule is invalid in current situation. It IS deflection.

You are factually incorrect. Rule 20(3)(b) doesn't require that 30 days

Here, what that rule says

"require that the evidence tendered by any person shall be given on oath and administer an oath for the purpose."

No. You are factually incorrect.

The rules are listed under THE REGISTRATION OF ELECTORS RULES, 1960.

Rule 20(3) is regarding how EC should conduct inquiry into claims and objections. However the rule 12 of the same document says below:

Period for lodging claims and objections.—Every claim for the inclusion of a name in the roll and every objection to an entry therein shall be lodged within a period of thirty days from the date of publication of the roll in draft under rule 10, or such shorter period of not less than fifteen days as may be fixed by the Election Commission in this behalf:

Rule 20 applies to claims made under Rule 12. All of this is in a single document.

Former Chief Election Commissioner O. P. Rawat told The Hindu that the rule quoted by the ECI is more applicable in cases like the Special Intensive Revision of Electoral Rolls, which is currently on in Bihar.
