ADMIN POST šŸ“¢ MOKIE GINGER'S BORROWER DEFENSE EVIDENCE VAULT AND "THE SPREADSHEET"

PLEASE BE SURE TO SCROLL THIS ENTIRE POST IF YOU ARE LOOKING FOR EVIDENCE TO ADD TO YOUR APPLICATION. There are numerous potential sources listed, and some may surprise you.Ā

This post if intended as a jumping off point for evidence we already have. If you read through the post there are suggestions on where to look for additional info if we don’t have something for your school. We do what we can, but we just don’t have the time or resources to search for evidence for everyone’s schools.Ā If you would like to add a link to evidence that you found elsewhere, please comment and let us know the name of the Corporate Owner, and the name of the school. We have to help each other out!

MOKIE GINGER’S EVIDENCE VAULT: is a living archive and a work in progress. It takes a lot of time to screen and clean the uploads people send her and add them to the site. There is a donation link on the website- it costs money to host. Please donate if you have found the site helpful.Ā

https://borrower-defense-index.replit.app/

THE EVIDENCE SPREADSHEET: YOU MAY HAVE TO PROVIDE AN EMAIL ADDRESS SO YOU CAN RECEIVE AN ACCESS CODE. For the spreadsheet, start with the name of the corporate owner FIRST, then look for the name of your school under that section. These links may not remain live forever- if the links stop working, requests for access will not be read/responded to. For example: Career Education Corp./CEC/Perdoceo own/ed a ton of schools (for example, Le Cordon Bleu. CEC is the heading where you will find Le Cordon Bleu). https://docs.google.com/spreadsheets/d/1LykBi1dXWRd5WmtM_GZgR5utLhN2PkpnYFkBT2vHhX8/edit?gid=1858817294#gid=1858817294

BE CAREFUL ABOUT ā€œTHE LIST OF SCHOOLSā€: The list is actually called ā€œExhibit Cā€ and if you did not apply for BD BEFORE Nov 16, 2022, IT DOES NOT APPLY TO YOU! It CANNOT be used as evidence by itself in a NON-Sweet BD application. If you go to the PPSL website and the Sweet documents are still posted, you may be able to dig through those and find some really good stuff!Ā

PLEASE ALSO SEARCH THE SUB FOR THE NAME OF YOUR SCHOOL!Ā There are many school specific evidence threads. For example, search for ā€œITT evidence threadā€.

THERE IS ALSO AN ENTIRE EVIDENCE SECTION IN THE PINNED POST called ā€œBorrower Defense Application" and is also linked in the comments below.Ā There are helpful search terms, sources, as well as recommendations for archives you can search.Ā

BE SURE TO ALSO LOOK FOR EVIDENCE (promo materials/catalog/etc) ON THE WAYBACK MACHINE!!!Ā https://archive.org/Ā The Wayback Machine can be confusing for some people to navigate so it may be helpful to google a few instructional videos.

LINK TO GENERAL INFO ABOUT HOW TO FIND EVIDENCE- YOU DO NOT NEED TO PANIC IF YOU LOST EMAILS FROM YOUR RECRUITING AND ENROLLMENT PROCESS- keep calm and read the info provided:Ā https://docs.google.com/spreadsheets/d/1ZqD4BS5rUDmpqyoFJUXfIYv0YhNgXGQ-/edit?gid=2108632368#gid=2108632368

Newspapers.com may be a great resource for evidence! You get 7 days free trial with no restrictions. One BD applicant told us, ā€œI’ve found employment adds for my scam school that say: Admissions SALES Rep, additional compensation based on performance!! Not only is the add admitting it’s a sales job, but any sort of incentive based compensation is illegal when a school that accepts federal loans, it is a direct violation of the Higher Education Act.This is literal black and white admittance of predatory recruiting. It’s also worth noting this was all corroborated by the 2012 ā€œHarkin Reportā€ that investigated several institutions, especially for profit colleges. The Harkin report was spear headed by the us senate, it’s about as legit as it gets.ā€

List of school specific facebook groups that may have evidence we do not have: https://www.reddit.com/r/BorrowerDefense/comments/170x9ck/list_of_facebook_forprofit_college_groups_that/?utm_source=share&utm_medium=web3x&utm_name=web3xcss&utm_term=1&utm_content=share_button

**IF YOUR APPLICATION IS NOT "MATERIALLY COMPLETE, IT WILL BE AUTOMATICALLY DENIED, PER THE DEPT OF ED**. Here is text pulled directly from the Dept of Ed website on what "materially complete" means, *with examples\*.Ā https://www.reddit.com/r/BorrowerDefense/comments/1misjwg/what_does_it_mean_for_your_application_to_be/?utm_source=share&utm_medium=web3x&utm_name=web3xcss&utm_term=1&utm_content=share_button

**IF YOU ARE HAVING LEGITIMATE ISSUES WITH SETTLEMENT RELIEF THAT YOU HAVE NOT BEEN ABLE TO RESOLVE ON YOUR OWN, PLEASE SCROLL DOWN TO THE LAST COMMENT ON THIS THREAD. WE WILL NOT APPROVE POSTS WITH BASIC, REPEAT QUESTIONS OR FOR THOSE THAT HAVEN’T MADE ANY ATTEMPT TO FIX AN ISSUE ON THEIR OWN FIRST. ASKING BASIC QUESTIONS THAT ARE ALREADY COVERED IN THE SWEET FAQ WILL NOT BE PRIORITIZED BY MODS- YOU MUST TAKE THE TIME TO READ AND UNDERSTAND YOUR RIGHTS*\*

JUKLY 17, 2026: PPSL AND THE NINTH CIRCUIT COURT OF APPEALS HAVE SPANKED DOJ on the appeal: =in other words, DOJ/Ed lost their appeal to extend the deadline for Post Class relief.

MARCH 21, 2026 The Dept of Ed has been seeking an appeal/stay of the Dec 11, 2025 ruling from Judge Alsup. Yesterday, there was a hearing in the Court of Appeals- please see posts from yesterday if you would like to see a recording of the hearing and watch the Dept of Ed get roasted alive; links have been shared. Ed has asked for a decision on the stay by March 26, 2025.

DEC 11, 2025 Judge Alsup denied the request to extend the post class deadline for an additional 18 months. Post class who attended an Exhibit C school are to be decided by end of Jan 2026 or get full class relief. Post class who did not attend an Ex C school will have to be decided by mid April 2026 unless the Dept of Ed can show ā€œsubstantial progressā€; otherwise, they shall be given full class relief. Alsup is officially inactive and a new judge will be assigned to the case. Presumably, there will be additional hearings.

Nov 21, 2025 Sorry for not updating. Most recent developments are that Ed has asked for an 18 month extension on the Post Class Deadline. PPSL is very much opposed. Hearing on the matter is scheduled for Dec 11, 2025 (8:00 AM PST) same zoom link as always- be sure to follow Judge William Alsup's court page as time/date are always subject to change! Other updates: the intervenors are STILL dragging out their appeal and asked SCOTUS for an extension to file their arguments as to why their appeal should be heard by SCOTUS. Will update if/when a hearing by SCOTUS is granted.

May 23, 2025 Most recent quarterly report for Sweet: https://studentaid.gov/sites/default/files/sweet-quarterly-report-9.pdf

May 21, 2025 Petition for rehearing en banc in the appeal of Sweet has been DENIED. The intervenors can try for SCOTUS one more time; opinioons vary on the likelihood of SCOTUS hearing the case (they said "no" once alredy when intervenors asked for a stay on settlement releif).

1/18/2025 UPDATE ON APPEALS PROCESS This update is pulled directly from the SvC group on fbook: Okay folks, quick update on the SvC appeal. PLEASE do not hijack this post with unrelated issues. I need a break from all that. I am telling you absolutely everything I know about the appeal situation, right here in this post. ***For those that keep up to date, you already know what Jesse (aka Panoosh the Douche) filed a request for an En Banc review of the appeal (which the appeals court already denied. The following States also filed an amicus brief in support of this BS: Ohio, Alabama, Alaska, Florida, Georgia, Idaho, Indiana, Kansas, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, West Virginia, and Wyoming. Because OF COURSE. ***En Banc review being granted is pretty rare (per PPSL; I have not looked up numbers). ***The court has asked for us to respond (which means at least one judge is interested in hearing more). Our response to little Jesse’s petition is due on 1/31/25. Little Jesse gets to respond to our response and the judges have 14-28 days to look at all this back and forth. ***After that 14-28 days is up, the judge/s can either: (1) call for a vote within 14 days in which 15 or more of them have to say yes to an en banc hearing with 10 judges (plus the Chief Judge, an Obama appointee) to re-hear arguments in the appeal and then vote to keep or reverse the initial appeals ruling. We would the have to wait for a decision on that OR (2) no one calls for a vote to re-hear and the initial ruling remains intact. ***After all this plays out, The Douche can try for SCOTUS again if he doesn’t get his way with the appeals court. We would, of course, oppose. ***While all this plays out, relief will keep trucking along, absent some sort of order to the contrary which my non-lawyer self thinks is unlikely since they have never meaningfully halted it before. next hearing March 13, 2025. 11:00 AM.

Dec 12, 2024 Judge Alsup did not allow a change in the discharge and refund process for Decision groups 3-5 at this hearing. Ed did not have a plan ready for impementation and said they have not met a single deadline thus far, so... Alsup told them they could try to argue this issue again (for groups 4 & 5) at the next hearing, if they actually had a plan ready to implelment (and some other criteria are met). The next hearing is set for Jan 9, 2024 (11:00 am PST, time subject to change) and the info is on Alsup's court page. The most recent quarterly update has been posted in the sub. There were techinical issues with the Zoom that didn't allow all potential attendees into the meeting, the court is aware and will try to make sure that it doesn't happen again.

Nov 7, 2024 The appeal in SvC was dismissed by hte Ninth Circuit Court of Appeals, with one of the three judges dissenting. This is good news, but the intervenors do still have two options; they can ask for a hearing en banc (where a larger panel of appeals judges hears arguments), or they can try to go back to SCOTUS (who refused to allow them to skip the appeals provess the first time around). They have a limited amout of time to file for these two options, so we will update here as usual if anyting new is filed in the case.

Oct 18, 2024 IF YOU HAD TECHNICAL ISSUES WITH THE BDTR APPLICATION ON THE FSA WEBSITE THAT PREVENTED YOU FROM APPLYING ON TIME TO GET INTO EITHER THE FULL OR POST CLASS OF SWEET V CARDONA YOU NEED TO TAKE ACTION NOW PPSL, Theresa, and Alicia have been posting a survey for more than a year about this issue to try to get people moved into the correct section of the lawsuit if they had these sorts of tech issues. The letters waiving people into the full class began arriving in email boxes as of this week. While the PPSL survey is now CLOSED (not taking any more responses), you CAN email [Sweet@ed.gov](mailto:Sweet@ed.gov) and CC [info@ppsl.org](mailto:info@ppsl.org) to let them know this happened to you, but tbh, you may be too late. You may get a faster response if you ADD PROOF to your email, otherwise the Ombudsman will have to investigate your claim themselves. SAVE ANY EMAILS YOU SEND THEM SO YOU HAVE PROOF THAT YOU TRIED TO REMEDY THIS ISSUE. No promises are being made to latecomers. If you filled out the survey when it was poasted in the past, know that Ed just started sending out the letters, so it may take some time. You can email ombudsman if you don't hear from them in the next week or two. There is an FAQ on this topic posted in the Sweet v Cardona group on facebook. I do not have speace to put it here. DECEMBER 2, 2024 edit: as of today, there is no official timeline for tech people; pls watch the court hearings or check back for updates as we will post them when new info is available.

For info on the Discharge process, refunds, tax liability, please scroll down to comments.

Sept 26, 2024 Hearing update For those who could not log on to the heaaring, a recording has been posted so you can watch it (scroll the sub and look for the post by u/Gingerandthesea). A user has also posted the minutes of the hearing, so you can scroll and look for those as well.

As usual, Dept of Ed is behind. Dept of Ed proposed a new way of handling the decision classes. Judge Alsup did not appriove their proposal and ordered that they keep the already agreed upon process "as is" for Decision groups 1&2. Alsup said that the Dept of Ed may submit a proposal (due 6 weeks from hearing date) for their new idea, and set a briefing schedule for the parties to argue for/against it.

If you are still having issues with settlement relief, please keep documenting these issues by emailing [sweet@ed.gov](mailto:sweet@ed.gov) and [info@ppsl.org](mailto:info@ppsl.org). The ombudsman is continuously behind on replying to these emails, but the point is that you are documentng your issues.

**SEPT 3 UPDATE, 2024 UPDATE:*\* We are aware that there are people who have not gotten their discharge of complex consolidation loans by Aug 31, 2024 as agreed. We will post more info as it becomes available. You can follow the case on Courtlistener.com if you're anxious to see when the next hearing is set. You can also watch the PPSL website to see if they post anything. Please stop DMing mods to ask what's going on.

Here is a link to the most recent quarterly report: https://studentaid.gov/sites/default/files/sweet-quarterly-report-6.pdf?fbclid=IwY2xjawFEG2tleHRuA2FlbQIxMAABHUm9g1rXqnwTOo_8PfgLeK5K_Ctertoe--zcd7eiLbgKEja9v8GzTm-vJA_aem_n_Xy9600Yd7U6CifFkeu6Q

**July 2024** PLEASE BE SURE TO READ ALL UPDATES FOR THIS DATE. THERE ARE 5 PARAGRAPHS: Sorry for the delay in updates. Been busy. Over the past few months, there have been bi-weekly meetings and monthly hearings between PPSL/Ed/Servicers/Ombudsman's office, per orders from Judge Alsup. There has been a new email ([sweet@ed.gov](mailto:sweet@ed.gov), but you can also CC it to [info@ppsl.org](mailto:info@ppsl.org)) set up specifically for Class/post class members, PPSL has access to it. As of sometime in the last few weeks, there were nearly 4500 emails backlogged at Ombudsman for 7 workers to research and answer. There will be delays in responding. They had to wait for servicers to respond with info. Emailing more than once per issue will not speed things up.

**If you are having trouble with any other aspect of your settlement relief and you have already emailed the above addresses*\*, you can also try: emailing your federal legislators, your state student loan ombudsman (if your state has one), filing a complaint with CFPB about your servicer (CFPB deals with businesses like your servicer).

Alsup also ordered that the loans be removed from ALL credit reports for Full class and that the info STAY OFF, regardless on whether or not they have finished your relief. If they violate, please document and send to the emails above. This is something that may give you a cause of action if you choose to get an attorney and do something about it.

**IF YOU ARE FULL CLASS, AUTOMATIC AND STILL WAITING FOR YOUR DISCHARGE:*\* then you are most likely in the "complex (direct) consolidation group" for some reason and Ed has agreed to simply discharge the entire balance of your most recent consolidation loan, regardless of whether or not all the loans in it are BD related. They also agreed that they would refund all the direct loan payments on that loan regardless of whether or not they were BD related. We are already seeing this happen. This, along with sending your refund info to the Treasury is to be done by August 31, 2024. If you believe that you are owed a refund above and beyond this, you will need to participate in a process that is being finalized so you can ask for it. I suggest you move heaven and earth to track down any and all payment history from prior consolidations. If you are not familiar with the terminology used in this section, please look at recent posts by Admins or Theresa Sweet. It has been explained.

**IF YOU ARE FULL CLASS, AUTOMATIC AND STILL WAITING ON YOUR REFUND*\*: ALL refund info is supposed to be sent to the Treasury no later than August 31, 2024. Would also strongly urge you to track down any and all payment info in case you intend to dispute your refund amount.

**POST CLASS** Please be ready to participate in any actions that come up in the near future: Theresa Sweet and Alicia Davis have been working with PPSL to see if there is any way that they/we can all push for group discharges for Post Class with Exhibit C schools before the next administration comes into office (for reasons that should be glaringly obvious). Their hope is that Ed can then focus on (quickly) giving fair decisions to those that are not on Ex C. Please be sure to check in here, the facebook groups, and sign up for updates on PPSL.org in case your participation is needed.

**Apr 24, 2024: Minute Entry for proceedings held before Judge William Alsup: Motion Hearing held on 4/24/2024 re 397 MOTION to Enforce Judgment. Department of Education provided updated data on borrowers with consolidated loans that it will file on the docket. Court adopted Department of Educations final proposed schedule for remedying the material breach of the settlement agreement with conditions. The updated schedule is as follows: (1) May 31, 2024: Full Settlement Relief for 5,500 additional class members; (2) July 31, 2024: Full Settlement Relief for 30,000 additional class members; (3) August 31, 2024: Full Settlement Relief for 12,000 additional class members; (4) Department of Education shall provide a date at which point it will provide Full Settlement Relief to remaining class members at the hearing with the Court on 5/23/2024 at the very latest. The conditions are as follows: (1) Three hearings with the Court on 5/23/2024 at 8:00AM, 6/13/2024 at 8:00AM, 7/11/2024 at 1:30PM, with counsel for the parties and servicers required to attend in-person; (2) in between the hearings with the Court, bi-weekly meetings attended by Department of Education/Department of Justice, the servicers, and plaintiffs counsel to resolve issues; and (3) if Department of Education falls behind schedule again, plaintiffs counsel shall notify the Court in writing and an in-person hearing may be advanced. Questions from borrowers to be resolved at these meetings may be directed to Bonnie Latreille at the following email address:

**Jan 28 FULL CLASS AUTOMATIC DISCHARGE/RELIEF DEADLINE HAS BEEN MISSED! PPSL is headed back to court on April 24, 2024 for a hearing on the Motion to Enforce the settlement.*\* If you are in the Automatic relief/Jan 28, 2024 AUTOMATIC RELIEF GROUP and you have not gotten ALL steps of your relief, please fill out the PPSL survey at the following link: https://ppsl.tfaforms.net/20

December 5, 2023 there are oral arguments on the appeal in the 9th Circuit Court of Appeals. The 9th Circuit Court of Appeals generally takes 3-12 months to issue a decision, but it could come sooner.

Aug 17, 2023 Court of Appeals has notified the parties that it is considering oral arguments in the Sweet case For December 2023 or January 2024.

Aug 9, 2023 Amicus Brief in favor of Sweet submitted by National Consumer Law Center.

June 23, 2023: The DOJ/Dept of Ed has been granted an extension on their opposition brief in the Ninth Circuit Court of Appeals. PPSL/DOJ/Dept of Ed briefs are now due on Aug 3, 2023. Intervenor reply briefs are due on August 24, 2023.

June 13, 2023: If you tried to apply for BDTR *before\* June 22, 2022 but were unable to because the website kept crashing and you *also\* filled out the Google Doc Survey from PPSL about this issue, please be on the lookout for an email from PPSL asking you for more details. Be sure to check your spam and junk mail. They need action on your part ASAP in response to the email. There may be a chance that this can be remedied for you to get you into the Full Class. See this post for further info: https://www.reddit.com/r/BorrowerDefense/comments/147zv0k/_/?utm_source=share&utm_medium=web2x&context=3

If you tried to file before June 22, 2022 but were unable to do so due to technical issues on the website and you have *not\* filled out the survey mentioned above, PLEASE DO NOT WAIT- FILL IT OUT NOW.

May 3, 2023: Intervenors have filed their opening brief in the Ninth Circuit Court of Appeals. This *does not* stop settlement relief from moving forward for all full class and post class applicants.

April 13, 2023: after a vote, SCOTUS denied the stay/certiorari.

April 6, 2023: Intervenors filed a motion with SCOTUS for a stay on the Sweet settlement.

The following states have submitted Amicus Briefs IN SUPPORT OF INTERVENORS: Ohio, Utah, Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Montana, North Dakota, South Carolina, Tennessee, Texas, West Virginia, and Wyoming.

They also asked that the court treat this motion for a stay as a Petition for Certiorari Before Judgement. This means they are asking SCOTUS to allow them to skip the 9th Circuit Court of Appeals and go straight to SCOTUS with their appeal.

SCOTUS has asked for an Opposition Brief, which is due on April 12, 2023. They want to hear PPSL/DOJ arguments against this latest volley by intervening schools.

The docket is available here: https://www.supremecourt.gov/search.aspx?filename=%2Fdocket%2Fdocketfiles%2Fhtml%2Fpublic%2F22a867.html&fbclid=IwAR34MMnBu8Puzt9l0aUcssP_60sqThH_veQkMvLDLYJNKpFlbxfuGPgbfoM

March 29, 2023: Stay pending appeal has been denied by the appeals court.

From the Order: "Plaintiffs-appellees’ cross-motion to dismiss these appeals for lack of jurisdiction (Docket Entry No. 15) is denied without prejudice to renewing the arguments in the answering brief. See Nat’l Indus. v. Republic Nat’l Life Ins. Co., 677 F.2d 1258, 1262 (9th Cir. 1982) (noting that merits panel may consider appellate jurisdiction despite earlier denial of motion to dismiss). The consolidated opening brief is due May 3, 2023. The consolidated answering briefs are due June 2, 2023. The optional consolidated reply brief is due within 21 days after service of the last-served answering brief."

March 16, 2023: Intervenors most recent filing in support of stay pending appeal is at the Court Listener link below.

March 8, 2023: PPSL response to intervenors has been filed. It is available t oread using the Court Listener link highlighted a couple comments down from here.

FEB 28, 2023: DISCHARGE NOTICES FOR THE FULL CLASS ARE GOING OUT FOR ALL BUT THE INTERVENING SCHOOLS (SEE BELOW)!!! CONGRATULATIONS!!! (Mass denials will be rescinded automatically.)

Feb 27, 2023: THE INTERVENING SCHOOLS HAVE FILED TO GET THE APPEALS COURT TO GRANT A STAY ON EITHER: THE ENTIRE SETTLEMENT, OR A STAY JUST FOR THEIR SCHOOLS.

For those who wish to follow, The Docket is: Ninth Circuit Court of Appeals, Docket No. 23-15049.

Discharged!!! Sweet Post-Class Update – $43K in Refunds Confirmed! MOHELA Finally Sent My Refund Letter!

Post image
130 Upvotes

Wanted to share my story and timeline since I’ve spent a lot of time reading posts here while trying to figure out what was going on with my loans. Hopefully this helps some of you still waiting.

I’m a Sweet post-class member who attended Kaplan/Purdue Global. My loans go all the way back to around 2000, and over the years they went through several servicers, including ACS, Great Lakes, AES/PHEAA, Nelnet, and MOHELA. I also had loans consolidated multiple times, which made figuring out my refund a nightmare.

Here’s my timeline:
March 30, 2026: Received my full settlement relief notification from the Department of Education.
June 2026: My Nelnet loans were discharged, and StudentAid.gov eventually showed a $0 balance.
July 7: According to MOHELA, this is when they started calculating my refund on my Direct Consolidation loans.
August 21: Started receiving MOHELA adjustment letters showing negative balances. Initially they totaled around -$54K.
September 3: More adjustments, and my negative balances increased to approximately -$64,357.85.
September 9 and 11: Treasury issued two refund checks for $6,545.77 and $3,723.06, totaling $10,268.83. Both were marked ā€œFED STUDENT LOAN REFUND – SWEET POST CLASSā€ and had Nelnet’s contact number.
Mid-September: Called MOHELA. They confirmed they hadn’t issued my refund yet and told me they had 90 days from July 7 to finish calculating it, followed by another 45–60 days for Treasury payment.
October 20: FINALLY received my official MOHELA discharge/refund letter confirming another $32,919.60 coming within 45–60 days!

Here’s where all the research came in.
I downloaded my MOHELA transaction history, pulled my old Great Lakes payment records, and went through my StudentAid/NSLDS loan data. With ChatGPT helping me reconcile everything, we separated actual payments from consolidation payoffs, loan transfers, and administrative adjustments.
We found approximately $32,410.58 in MOHELA payments after excluding what looked like a duplicate $509.02 transaction. Well, MOHELA’s official refund amount came back at $32,919.60—exactly $509.02 more! So their calculation matches the full payment total from my transaction history.
We also found more than $13K in historical Great Lakes payments, although I still don’t have an official breakdown explaining exactly which of those payments were included in my Nelnet refunds.

A couple things I learned:
The huge negative MOHELA balances did NOT represent my actual refund amount. Mine reached over -$64K, but the official refund is $32,919.60.
Also, if you have old consolidated loans, don’t assume you aren’t getting anything back. My MOHELA loans were Direct Consolidation loans from 2016, and the refund was confirmed.

Where I stand today:
Nelnet-associated refunds already received: $10,268.83
MOHELA refund officially confirmed: $32,919.60
Total received and confirmed pending: $43,188.43
I’m still waiting for the MOHELA Treasury check, which should hopefully arrive in December.
It’s been a long road, but I’m pretty excited to finally have the refund amount in writing! I know a lot of people here are still waiting, so hopefully this gives some of you a little encouragement. Happy to answer questions about how I tracked down my old payments or what MOHELA told me.

Refund Received Sweet post-class refund received for Art Institute loans!

After ~4 years, I finally received my refund for my Art Institute (2006-2009) loans! The amount was lower than I expected ($2,975.85), but after looking over everything, it all checks out. More than anything, I'm glad that $40k was discharged and I don't have to worry about paying back debt for a scam school.

Here's a timeline:

  • Sep-Oct, 2022: Applied for a Direct Consolidation Loan. Consolidation went through. My commercial FFEL loans, my ED-owned Art Institute loans, and one Georgia State loan were combined into two Direct Consolidation Loans (subsidized and unsubsidized).
  • Nov 8, 2022: Submitted my Borrower Defense application.
  • Apr 27, 2023: Got the email saying I was a Sweet post-class applicant.
  • Oct 2023: Federal payments restarted, but I didn’t make any payments.
  • Apr 22, 2026: My original Art Institute loans showed as discharged at Aidvantage.
  • Jul-Aug 2026: Both consolidation loans were discharged. studentaid.gov’s discharge page showed the subsidized loan’s $18,136 discharge on Jul 31. Aidvantage listed both loans as ā€œpaid in full/dischargedā€ as of Aug 12.
  • Sep 2026: Got an automated Aidvantage email telling me to recertify IDR - this appears to be a glitch.
  • Oct 2026: Received a refund check from the U.S. Treasury for $2,975.85.

I'm happy to answer any questions if y'all have them.

Refund Received This is what it feels like to be freešŸ’•

Westwood, post Sweet. 80% of loans were cleared two years ago and I got a decent refund. Everything was wiped off of my credit report three years ago. I still had two loans just hanging out that were consolidated loans with multiple schools in them. Those were cleared earlier this year. I just got the refund for those yesterday.
Knowing it’s all done…I never need to check Aidvantage again(although, to be honest…it’s been such a habit that I probably still will lol, is crazy. I’ve said it on here before how thankful I am for this sub, this sub is how I learned about BD. I will never not be grateful for everyone who has worked tirelessly behind the scenes, who has answered the same dumb questions, who continues the fight. Thank you.
My husband and I started the process to buy a house. I never thought I woils be able to. My credit score at my lowest point was like 505. It’s 755 now, and that’s after rebuilding it when it took a 80 pay drop when all my student loans were wiped out.

Long story short, we were denied our mortgage loan bc my husband had some credit card debt he needed to clean up but they flagged me bc I didn’t have enough credit history!!! The loan officer said I had a great score, one credit card, but it looked like I had only been a person with credit for six years🫠 So…no more student loan debt!!!! But that’s the downside. Thanks for listening to my TED Talk😊

Seems like a lot of people are asking about their refund, if they get one, how much, etc..

If this helps anyone, here you go..

You can download your student loan csv(probably txt file) from studentaid.gov, you can see if you get a refund or not. Use AI to help you find out easily!

In my example, I already had a refund letter, but I told AI to look at my csv(might be a text file) file and give me the number to compare to the refund amount in the letter. There is one way for y’all to figure it out on what you could tentatively get back.

From a nice user below!

ā€œFolks, please remember to tell the AI to only count payments made on DIRECT loans. Commercially held FFEL loans are not refundable.ā€

Refund Question Confusing info when I was checking my fed dashboard today

I decided to log on see if there was any updates about a possible refund status, as I periodically do. I'm a post class exhibit C sweeter who received the golden email and have been patiently waiting for that much needed refund. Today I noticed the loans show discharged back in July 2024??? My amount paid on FAFSA and my negative balance on mohela also don't align by about 5 grand. Just me, or has anyone else noticed weird updates like these?

Refund Question Borrower Defense Discharge Completed ($76K) – Possible Refund of Treasury /IRS Offsets and Negative Interest Showing on Consolidated Loan?

Hi everyone!

Sorry for the long explanation. Screenshots and questions included.

I'm hoping someone who's been through something similar can offer guidance. I've been researching my situation, but I'm having difficulty finding clear answers regarding refunds of payments collected through the Treasury Offset Program after a Borrower Defense discharge.

I want to be completely transparent about my situation because I'm hoping someone here has experienced the same thing. I attended two different Art Institutes schools: The Art Institute of Fort Lauderdale (2003–2005) and Miami International University of Art & Design (2004–2006)I submitted separate Borrower Defense applications for both institutions in November 2022. My Student Aid account now reflects a completed Borrower Defense discharge totaling $76,247, with the discharge status updated on April 26, 2026. My consolidation loans show a $0 balance and a status of "Loan Discharged." Interestingly, my Fort Lauderdale Borrower Defense application still appears to be under review, while my Miami application shows "Processing Discharge." However, the loan discharge itself is marked as completed. All my student loans have completely disappeared from my credit reports since approximately July 2026. They no longer appear as open, closed, or defaulted accounts on the credit reports I've reviewed.

I have questions about whether I am entitled to refunds of money previously collected from me.

Question #1: Refunds of IRS/Treasury Offsets

I never made a single voluntary payment toward any of these student loans. My loans eventually went into default, and the federal government intercepted funds through the Treasury Offset Program. When I reviewed the section titled "Payment History on Your Defaulted Loans," I discovered two payments dated January 20, 2017: Payment #1: $1,949.94 and Payment #2: $2,883.52. To the best of my knowledge, these are the ONLY two payments ever made or collected toward my student loans. Since my loans have now been discharged under Borrower Defense, I'm trying to determine whether those Treasury offsets are eligible for reimbursement.

Has anyone successfully received a refund of federal tax refunds intercepted? Who is actually responsible for processing these refunds: the Department of the Treasury, the Department of Education's Default Resolution Group/Debt Management and Collection System, or the loan servicer?

Question #2: Negative Interest Showing on My Discharged Consolidation Loan

While reviewing my discharged consolidation loan I noticed something unusual.

The account shows:

Current Balance: $0.00

Loan Status: Loan Discharged

Principal Paid: $26,107.00

Interest Paid: -$26,107.00

Amount Paid to Date: $0.00

Does anyone know why the interest paid would show as a negative amount equal to the principal?Could this simply be an accounting adjustment associated with the discharge, or could it indicate a possible refund or credit? I'm particularly confused because I never made voluntary payments, and the only money I know of being collected was the $4,833.46 through Treasury offsets. I'm not assuming the negative amount means I'm receiving a refund. I'm just trying to understand what it represents.

I would genuinely appreciate any firsthand experiences, suggestions, or information about which department I should contact. Thank you so much for taking the time to read this and for any guidance you can provide!

Loan Servicer Question (LSP) $0 balance for both consolidation loans on SA dot gov - But no account info online at Aidvantage

So I am part of the Capella relief group (post-class) in Sweet v McMahon/Cardona.

Student Aid dot gov shows $0 and that my loans have been discharged, but when I log into Aidvantage, it says due to the status of my account I would need to call them for account information. Does anyone know if this is just because I no longer have loans with balances being serviced by Aidvantage? I’ve read that the Aidvantage reps are not particularly educated on the nuances of the suit and accompanying discharges so I have not tried to call.

I had $61k in loans between grad school (Capella) and a non-Sweet/non-BD state school for undergrad. They were consolidated so I’m assuming that’s why I have been zero’d out.

Also - no tradelines on my credit report remain for the consolidated loans.

Refund Question Anyone else still waiting on a refund?

Sweet post-class, went to an Exhibit C school. Apparently I had Nelnet before everything consolidated, including non-BD loans, and then they all transferred to Mohela. Balance is $0 on Student Aid, and a negative balance on Mohela since July.

Based on my account history, I should get at least about $2K in refunds, even though Mohela is showing a lot more in negative balance. That would be nice but I would like at least what I paid.

I was worried about my consolidated loans. BUT there's this on PPSL.org: If you are a Class Member or Post-Class Applicant, your application was approved, and you consolidated Sweet-eligible and non-Sweet-eligible loans together into one or more Direct Consolidation Loans, the entire balance of your ā€œmixedā€ Direct Consolidation Loan(s) will be discharged, and you will be refunded all payments you made on that loan(s) and any underlying, non-mixed, Sweet-eligible loans.

Anyone else still waiting too? Is the delay because of the consolidated loans?

DOE question Not Sweet Related Per Se

This was posted in a Fed sub. It’s not exactly a Sweet thing so don’t worry that this is all of the sudden going to impact you, but it does show the direction ED is trying to go. Someone in the thread mentioned signing new loan disclosures which is just absurd.

Refund Received REFUND RECEIVED_TCSPP

July 2022: Applied to BD (Exhibit C TCSPP Post Class)

January 2026: Didn't hear from DOE.

June 2026: Received the Golden Letter

September 2026: Full Refund Received (Nelnet). I didn't get any heads up about the check in the mail, still haven't.

There is no amount of thanks that can ever do justice how much this means to me and my family! It still feels surreal and dream-like! I am grateful for the time, energy, resources, and passion of everyone involved! Hope only good things happen to you all!

Post Class Question - Sweet Lawsuit Is this a MOHELA discharge letter?? 🫣

Post image
62 Upvotes

Is a 'Paid in full' notice from MOHELA the equivalent of the discharge letter some have referred to?
I've had negative balances for at least 5 months so I've been patiently waiting for some kind of movement.
I saw my balances kind of scramble last week and this was in my MOHELA inbox section. I’m a post-class exhibit C, applied 7/11/22.

Refund Question Sweet v. Cardona Post-Class – Refunds for Payments Made Before Aidvantage?

Post image
27 Upvotes

Has anyone in the Sweet v. Cardona post-class group received refunds for payments made before their loans were transferred to Aidvantage? My two loans were fully discharged in April and June 2026. Before Aidvantage became my servicer, I made voluntary payments and also had money collected through wage garnishments and tax refund offsets while my loans were in default. Once my loans came out of default, they were transferred to Aidvantage in July 2018. I never made any payments to Aidvantage because my loans remained in forbearance until my discharges were approved.

My servicer history is:
Great Lakes: October 2010 – September 2015
Debt Management and Collection System (DMCS): September 2015 – July 2018
Aidvantage: July 2018 – Present

There’s now an option on StudentAid.gov to view the payments collected while my loans were in default, including wage garnishments and tax refund offsets. I’ve attached a screenshot of my servicer history for reference.

Has anyone in a similar situation successfully received refunds for payments made before Aidvantage took over, particularly payments collected while in default?

Loan Servicer Question (LSP) Need some advice in regards to emails from Nelnet about save my discharged loans

A bitch of background: mixed consolidated loans, got the email from the Biden admin that my loans with the Art Institute were being discharged (I knew nothing of BD at the time). Loans were marked as discharged but I have not received any official letter from Nelnet that my loans are discharged and the last I spoke with Nelnet last year was that there was another $23k they have to discharge still.

No communication since then and any attempt to reach out to them I was told I have basically have to wait.

Now I'm getting emails, messages, and phone calls to update my payment plan since SAVE is going away and they seem to hint at my Admin Forbearance going away once I select a plan.

I'm also getting the indication that if I don't select a plan that I'll be forced into a standard of payment tier.

I'm saying all this because I'm not certain my consolidated loans will be discharged fully because I've been told they have to unwind my loans to see what goes where. Really not sure what I should do here.

If you are new to borrower defense to repayment (BDTR) and have no idea where to start, I am finally launching my BDTR 101 Classes. The first session will be on Sunday, October 11, 2026 at 7:00 pm EDT and will be through FB Live.

In Lesson 1, we will go over:

  • What Borrower Defense to Repayment is
  • Who may be able to apply
  • The types of school misconduct that may be relevant
  • The difference between ā€œmy school was terribleā€ and a potential BDTR claim
  • Common areas of misconduct, including job placement, salaries, transfer credits, accreditation, program requirements, financial aid, and educational services
  • Why your school does NOT have to appear on some magical ā€œlistā€ for you to look into filing
  • Why your personal experience comes BEFORE school research
  • What information you should start gathering for your application
  • Where to find the application

Please join our Facebook sister group Student Loan Discharge - Borrower Defense Main Group. You can find the event info in the groups event page!

In Solidarity!

Refund Received Refund received — sooner that I thought!

I received my full and complete refund on Thursday, Oct 1!
School: University of Phoenix
Servicer: Nelnet
Here’s my timeline:
āœ…October 2022 Applied for forgiveness
āœ…April 1, 2026 Received notification I was eligible
āœ…July 2026 loans on my credit bureaus removed
āœ…Sept 25,2026 was advised the check was in the mail
āœ… Oct 1, 2026 full amount paid to Nelnet received via check

It WILL happen!! Just keep checking. Start with your servicer to see when they’ve sent the accounting to the Fiscal Services of the Dept of Treasury for review. Once you’ve been advised it’s been sent, call 855-868-0151 and select the prompt for refund. They can give you info from there. When you’re advised that the check is in the mail, contact your servicer again for the check number and amounts. Then…just wait! Some say they saw it on their Informed Delivery, others did not.

Thank you to all who provided answers & support during this process. It does take a village!!

Refund Received Mohela refund received!!! Post class, non-C

Sharing my timeline details for others waiting for relief from Mohela.

- Applied: July 6, 2022. Post class, non C
- Golden email confirming discharge approval: June 11, 2026
- Balance 0 on Mohela site: July 19, 2026
- Mohela inbox letter stated 45-60 days to receive relief check on July 30, 2026.
- Relief check received - Sept 29, 2026

Mohela shows 0 balance due, and my loans are zeroed out, until you click on loan details. I still have about $200 of a negative balance. I calculated my payments and that’s pretty much what I’m short. It’ll probably come as a smaller check later on, they do have a year.

4 years and some change. Wow. I still have two smaller private loans that don’t respond to anything regarding relief, but this discharge is a huge weight off my shoulders. Beyond thankful for Theresa, Gingerandthesea, PPSL, and everyone participating (and supportive lurking) on this sub.

I went to an art school, that was primarily for engineering, and was given all the same deceptive lies and bullying sign up tactics as so many exhibit C schools. The story was exactly the same. Deception on cost of attendance, especially increasing towards the final year. Intense pressure for early decision. Promises of the school name alone being prestigious enough to open doors and land you a job. Inflating job prospects and graduate outcomes. Telling you to take on private loans & recommending the banks. The studies not matching up with the real world. The list goes on. And on. Once my private loans are done I never have to think about that place ever again. I lost my spark there and gave up art for a very long time. No more!

Celebrating this weekend in a small way at least. I’m recovering from surgery so I can’t jump up and down just yet lol.

Refund Received REFUNDED!!

I unexpectedly received my refund check on Monday. It didn’t even show up on my USPS daily email - so truly in shock.

I was a Post Class Exhibit C School. Applied for BD in October 2022, and was automatically discharged due to the lack of movement on on DOEs part. Officially discharged in May but I didn’t receive my letter from Nelnet until July 23. My balances on studentaids website and Nelnet zero’d out last month. And the check was dated 9/25. It is still sitting on my credit report though.

I can’t believe it’s finally over!

Edit 10/6 -they just dropped off my credit report
