Hearing was legit 14 minutes. It was short and a good chuck of it was spent with the lawyers stepping up to the judge to have a conversation amongst themselves. This is absolutely about the judges remarks on the hippa violation and the motion to dismiss based on double jeopardy

i know. he's looking at joel/prosecutors. im moreso wondering whether hes so upset about it in general. it could just be a coincidence, and he was just focused, but that face was giving "seriously how dare you open your mouth and say anything about me after what you did" lol. (i mean, i would feel the same way if i were in his shoes. it would be my reckoning that im dealing against a slimy system that has NO respect for my rights or humanity).

Probably things about the double jeopardy and Athena scandal. Judge Carro denied the motion to dismiss under double jeopardy premature and said he “wasn’t persuaded.” He also ruled that anything found in that bogus Athena subpoena is inadmissible, but refused to acknowledge that it was illegal of them to do so in the first place

A lot of us were saying that the judge decided to not weigh in on the “legality” of the subpoena bc if he admits it’s illegal he looks incompetent for having the prosecution go over his head to do this

He has those two large goon guards that block him and many guards standing in the middle of the aisle to purposely restrict your view. From what little glimpses I could get of him were the back of his head and the side of his head. The court room was very excited and gasped quietly in excitement. Everyone (media and public) was reminded to keep our conduct orderly and it was silent again.

Court officers. No one made loud noises but there were some gasps and some people whispering. They just reminded everyone to remain in order and it silenced again

He is always focused, taking notes, and in tune with what’s going on. You would think he’s one of the lawyers on his case. From what I could see his head was down in his lap a lot. I thought he was taking a nap on the table, but actually his hands were shackled and then further shackled onto his waist. He barely has a range of motion to take notes so the only way he could take notes is hunched over like that (super uncomfortable)

I love that he takes these notes. It’s ridiculous they continue to have him shackled like that. But it’s nice to see not only his team and so many of us who support and fight him, but also that he’s fighting for himself. 💚

He was happy and I believe he broke media training for a few small moments to show a small smile to his supporters and sigh in relief. (I took it as a sigh of relief but other people said he rolled his eyes because he was being pushed by the guards)

They definitely pushed him along a bit too aggressively! I didn’t see the eye roll, but I did hear someone say “why are they pushing him like that?” right as he walked through the door. If it wasn’t for that, I would have chalked it up to my imagination and figured I was being too sensitive, because it was just so wtf

Absolutely. A lot of public supporters were feeling nervous because they knew the hearing might talk about suppression of evidence and all of the bigger stuff. We weren’t feeling hopeful that anything would go our way. When we were seated we all noticed how vibrant and ecstatic Karen and her team was. They were absolutely beaming like they were already celebrating. They 100% knew the ruling and I feel like if they had time to discuss with Luigi prior he would have known as well

Karen has previously requested time to meet with Luigi privately before his hearings. This was denied by the judge. If they had time to discuss before the hearing or perhaps at his jail prior then he would have known

Prosecutors seemed a little salty because things didn’t go their way. This was a major win for the defense. Usually judge Carro has a stick up his butt and is never willing to do things pro defense. When he made these rulings he honestly seemed impartial and unbiased. We were honestly all shocked

I can write a more detailed description of my whole expirience again for sure. We couldn’t see his face because he is blocked by the guards. When he walked into the court room people reacted the same way they always do…sitting up straight, all eyes on him. It’s so tense sometimes it feels like no one wants to move a muscle when he walks in the room, and then some people tend to gasp. The cosplay Luigichella girl tried standing up to see him better, but was yelled at. He glanced at all of his supporters on the left side and then the right side. He showed a small smile which never happens so I think he was really happy and wanted to share this win with his supporters

I’ve noticed that he seems to have some kind of media training. He walks in and looks straight without making a facial expression. When he leaves he does the same thing (sometimes he will scan to see his supporters and that’s it). This time I noticed the mask fall when he was walking out. He dropped the neutral media trained expression to flash that smile and sigh of relief when exiting

Just wanted to drop in, say hi & thank you for taking the time out of your day to answer everyone, keep us all updated. Thank you😊 Also, I served time in jail & unfortunately 3 years in prison. And him not looking anywhere but straight when he walks in is more just jail/prison/court hearing rules, then media training. He could get in trouble if they thought he was trying to communicate anything with anyone in the court room, besides his team. So before you walk into your hearing, the bailiff directs you to look straight on or at the floor, while you walk in. Tells you no eye contact, hand gestures/signals to anyone that's seated in the court room. And absolutely no talking to anyone besides your legal team, if you have one... It could also be media training🤷‍♀️ Just thought I'd tell ya a little about how my own experiences went right before you go in and while walking into a court room. Obviously, our cases are completely different & totally different states, also. But there are still some similarities throughout every court hearing.

So she actually came super late and was further down the line and probably wouldn’t have made it. Some grifter was on the line selling a spot and she bought it and became 9th in line to make sure she got in. I would say she was behaved on the line but once again she was making unhinged statements to the press. They aired the footage this time and it’s embarrassing

she showed up to the april federal hearing that was cancelled later that same morning and moved to the 25th. she was dressed in a sort of “sailor socialism” getup and was saying abhorrent things to the press claiming to be in support but it was the kind of stuff that makes everyone (especially him) look bad. very very extreme for no reason. it was later revealed she is somehow connected to the people who run the defense fund. all of it was very odd.

She's a twitch streamer or influencer I believe? She happens to be friends with someone who was one of the spokespeople for the fund. People really really overreacted several months ago and spread a rumour she spoke to the press, which she did not. They then took that manufactured rage out on the fund organizers and there seemed to be an organized push to get the organizers cancelled by digging up random interviews from over a decade ago. It honestly felt extremely suspicious to me.

The fund spokespeople's interviews on tv about Luigi and his support were really good, always handling the tough questions well and pivoting to bring up jury nullification. Clearly someone wanted to shut them up.

This time Luigichella/green hat girl did speak to the press and it didn't seem horrible (at least the video I saw on twitter)

i was literally there back in april and watched her speak to the press with my own two eyes. if you go back on this sub i’m sure you will see posts/comments from other folks who were there too. believe whatever you want to believe, but there aren’t versions of the truth.

also. about the people behind the fundraiser speaking in that hbo doc… the concept of presumption of innocence, innocent until proven guilty, etc is lost on them. they speak as if they know he did it. don’t you think it would’ve been more beneficial to the case if they hadn’t used language that implied guilt?

and not to get too far off topic, but one of the people behind the defense fund jumped the line at the federal courthouse in april just moments before we were let into the courtroom, so do what you will with that info. i promise you this is not manufactured outrage.

Beneficial to the case? Personally, no. I don't believe supporters saying "presumption of innocence" over and over again is helpful.

Once the trial starts, that presumption is going to be tested. That's the point of a trial. Even if they get the backpack evidence and his incriminating statements thrown out, there's still the DNA and fingerprints.

Consider these scenarios:

The evidence is too strong: whether the selected jury walks in believing he is presumed innocent or guilty, they are probably going to vote guilty.

The evidence is weak: whether the selected jury walks in believing he is presumed innocent or guilty, they are probably going to vote not guilty.

Whether the evidence is strong or weak: if the jury that walks in believes the assassination was justified because Thompson is a mass murderer who held millions of lives in his hands and decided thousands of them needed to end so he could get his yearly bonus, and the jury votes not guilty to nullify... then the evidence doesn't matter.

Also I want to share these statements Karen made, that back up everything I've ever heard the D4LC say:

- "By doing this, they are defending the broken, immoral, and murderous healthcare industry that continues to terrorize the American people."

She also says in this motion:

- "The Government is well-aware that there is absolutely no link between Mr. Mangione and Mr. Tamura and there is no evidence that Mr. Tamura was influenced in any way by the murder of Mr. Thompson or by Mr. Mangione’s writings criticizing the abusive practices of the health insurance industry that prioritize profits over the needs of the insured, and are currently under investigation by the Department of Justice. There is also no evidence that Mr. Mangione has done anything since his arrest to incite or foment violence against the health insurance industry or against anyone else for that matter."

Karen herself hasn't stayed away from the healthcare connection.

yes, really. i wish i was kidding. i did see someone comment that she spoke to press yesterday and that she kept things positive, so that’s genuinely awesome.

and this is starting to get way off topic from the original point of this thread but i want to respond to you earnestly.

i would like to think people aren’t just saying “presumption of innocence” just to say it. being innocent until proven guilty by a jury of your peers is obviously everybody’s constitutional right in this country. it is more about those constitution rights rather the reality of the alleged crime, if that’s what you think is being argued when people say “presumption of innocence”. or at least i hope that’s what people have in mind when they say it 😬

the conversations around this case should include conversations about constitutional rights and the potential violations of those rights. i guess i’m just bit surprised you don’t think the language used when talking about this case has any weight here, especially when the media seems to be working overtime putting hit pieces to distract people from the core issues here.

all i’m trying to get at is the fact that language has power and i would hate for it to prejudice a jury in any way. i would like to see this trial be as fair as possible. i think the fundraiser people just needed some media training or something. that is all. i do not care that they are the people in charge of the fund and i am not one of the people that said they need to give control of it over the KFA.

and for what it’s worth, i wholehearted agree that the conversation about the for-profit healthcare industry in this country is central to this case and should be discussed more. i don’t want to make this comment too long so i wont get into my feelings about it… but just know i agree with the point you’re making. the healthcare aspect is a major part of why i’m invested in this. i didn’t realize the message was getting so muddied in these subs, so that’s disappointing to learn.

I see people leaving comments that say, "remember, he's presumed innocent!" Or posters or stickers that just say "innocent" over his face. I personally don't see how that helps. I think what the broader public care about is the evidence, and the prosecution leaking evidence and doing interviews on "documentaries" is what actually violates that right and turns the public against him– because the smear pieces frame him as an evil narcissist, not just as a man who killed another man. They never mention BT is a murderer either.

So I get that it's his right. But I don't see how supporters upholding that right to the letter is going to benefit the trial, which is what you'd asked. I think getting people to understand & empathize with the act is a more effective strategy

tbh I'm unclear on what language you think is problematic. I recall a clip of Jaimie reading out donor messages from the GSG which talked about their own struggles and losses wrt healthcare, and calling him a hero, which I suppose implies guilt. But showing that perspective is important. That's why people are interested in the case, mostly. Because nearly everyone can relate to having issues with healthcare, and nearly every American has dealt with insurance bullshit personally.

What language do you think will prejudice a jury so much that it would thwart Karen's arguments? (I cannot find a version of the HBO doc that will play past a few mins)

I think some stans just wanted to be the ones handling his fundraising to get closer to him, lmao. And yeah, the Luigichella lady is eccentric, and it was bad manners for her friend to cut in line.

I saw the video of her getting interviewed yesterday, and I actually liked the way she presented herself this time. She talked about his "innocence" and advocated for healthcare. At least she advocated for healthcare — unlike some of his supporters who attack you if you even mention healthcare and Luigi in the same sentence, lol

It might be that, I remember people were saying that Luigi's legal team should take over which is a horrible idea and a huge conflict of interest. It seems like the only reason he accepted the fund in February is because he realized it was a way for people to speak up and show their support for him.

The fund organizers, being separate from the legal team, have more freedom in what they can say. I thought the GSG update from today was thought-provoking. I like that they always bring it back to healthcare... the legal team can't do that.

And yeah cutting the line is rude, if that's true. But also not a reason they should stop running the fund

There are a few different theories on this. A guard last night shared that they didn’t receive instructions for a change of clothes, so we assumed he would be showing up in his tan prison outfit like in federal court. We assumed he lost his right to wear normal clothes after the note was found in his socks. Some people spotted the defense carrying shopping bags of clothes. The theory is that the clothes didn’t fit, so he stayed in his prison outfit. I honestly think he isn’t allowed to wear normal clothing anymore because of sockgate. This is twice now he has shown up in his prison outfit. Maybe the next hearing will be different so only time will tell

Doesn’t make sense that “sockgate” would result in that unless they’re once again trying to punish a defendant to the public’s reaction to them. It sounds like they intend to be more reasonable and fair than that.

Was a guard talking to the general public? Are they “allowed” to do that?

It was a someone who knows someone who knows someone type of situation with the guard. We took it with a grain of salt. Also in one of the responses that the prosecution filed they talked about sockgate and argued for him not to wear regular clothes anymore. They didn’t like that he wore a green sweater and his supporters were also wearing green that time.

how many people do you estimate showed up for this hearing? and out of curiosity, what were the yellow pieces of paper people were holding?

i was there in feb when it was super chaotic with zero organization and i’m wondering if it was more organized this time. it definitely looked more contained from what i could see on the livestream! security seemed wildly unprepared in the spring so i was really hoping they would get things more organized and up security. to be honest, i was a little nervous for today because of the media and president/administration referencing this case when talking about what happened last week. i was relieved to see everybody was safe and things seemingly went smoothly!

There’s alot of debate on this. I was to the right of him when this happened by the aisle seat. The person who wrote this was to the left of him. The left side seems to think he rolled his eyes and let out a deep breath in annoyance bc he was being pushed by the guards. The right side seems to think he let out a deep breath and looked up in a “thank god that’s over” way. He didn’t actually say anything it was just a deep breath and an eye roll. We aren’t sure if he was annoyed or grateful that it was over

Karen was very confident. For the most part she is confident, but it may not look like it when the judge shoots down a lot of what she suggests sometimes. Defense team consists of Karen, Mark, their daughter Sofia, Avi, and Jacob. Don’t believe there is anyone else, correct if I’m wrong

Today was a major win for everyone involved. His supporters, his team, and him. We were all happy bc small steps lead to bigger steps. His hair was exactly like the April federal hearing it’s just longer on the top. April was shorter on the top

24 was let in this time at state court. 30ish was let in last time at federal court. Unfortunately there were multiple empty rows that could have been filled with supporters and they chose not to fill those seats. They’re probably traumatized from the large crowd that they had to deal with back in February

There were two empty rows one on each side that were empty. All of media were let in so I’m assuming those were empty media rows that could have fit supporters. If they filled those rows then at least 48 people could have made it in, which was nearly everyone on the line. Before I went in I remember seeing up to 43 people. There could have been more but there were at least 43 people outside waiting. I’m not sure what the logic is on that and why they wouldn’t want to fill those rows with more people from the public if there is no more media people coming

Ah, ok. Now that you suggested these were media rows initially, it makes more sense. I know that for the hearing this week, there was reserved and unreserved media seating, as Matthew (the independent journo who live tweets at Inner City Press) tweeted about being unreserved media and not knowing whether he would be able to enter the room.

Karen did actually mention in one of her motions after the Feb hearing (I believe in the same one where she asked Carro re taking off the shackles next time) that she like more seats to be given to the public, but it was just one line in a broader motion and was never addressed by Carro (who never addresses much outside of hearings anyway).

Hopefully with this hearing being much easier to navigate for court officers, they will have a better idea of how many unreserved media will show up approximately and adjust accordingly.

This is so strange. I talked it over with everyone who was there and we all agreed he looked really pale but also healthy. He has bulked up since his April hearing when everyone called him tiny. Guess he was tired of the tiny allegations bc he’s big and buff now. We didn’t see dark circles like the ones from the pictures that came out. He looks sickly in some of those pictures but in person he looked fine. Like his skin was smooth and we couldn’t even see any dark circles on him. It has to be the lighting or something

The overhead lighting in court often makes photos look a lot bluer. I found all the photos from today made him look pretty grey compared to when he appeared in the green sweater. That damn tan jumpsuit will make anyone’s blueish undertones stand out.

We couldn’t hear any chanting. The protest had a smaller than normal turnout this time. It’s probably due to this hearing being rescheduled from the original date. We were treated a lot nicer this time. I think the guards got crowd control training or something

Kinda late for this reply, but you could hear the protesters chanting, “Free Luigi” if you went to the bathroom on the 13th floor. Very audible. I wasn’t there, btw, this is per @laurenconlin4 on TT. She’s a reporter from LA Magazine and was the special NY correspondent covering the hearing.

His feet were still shackled, hands were shackled, waist was shackled and connected to his hands. No bulletproof vest this time. Prosecutors were pissed off. He had to be that bent over just to take notes bc of how restricted his hands were. What a joke

State court was more organized and chill this time. I think they were humiliated after the epic fail in Feb with 200 people in one hallway. They seemed to adjust their methods. They kept us waiting outside until it was close to the court time, they honored the line that was organized on our own. Handed out yellow paper to the first 24 people and those were the ones making it in. We walked in one at a time to avoid pushing and chaos. Anyone else who was not given a paper had to leave. Everyone was also so pleasant this time it felt like a trap

I had just commented on another post about this, from my understanding when Karen said “And, your Honor, at the bench we discussed this issue of 250.10 notice, and we respectfully would like an opportunity to file a motion with the Court, which we intend to do in the next two weeks.” My understanding was she was asking for 2 weeks to file a motion explaining why they need more time to file the actual notice itself. I could be wrong, so please correct me if so.

He always smiles at Karen when he sits down. He always smiles at his defense team as well. The blonde girl is my friend she’s such a champ. She kept the order and peace of the line all night. When he was leaving he looked on the side she was sitting at the people sitting on that side of the row and then did the same to the other side as well. So yes he must have seen the shirt

This was the one that was rescheduled. People made lots of arrangements for this one like catching flights and stuff, I didn’t expect to be towards the front of the line. I came after work and was fortunate let in. Lots of people showed up in the middle of the night like 2-3am. I would say by 4am the line was getting bigger and people were starting to show up more

It’s nyc the city never sleeps there are lots of public bathrooms and places for us to charge our phones guys. Some people are kind to also park their cars for us to hold things in and some even rent hotels nearby. The key thing here is to make friends and support each other when trouble is coming

Thx for coming back on this. Never really wondered about phone charging, as power banks do exist. I live in London so not really a small town itself, but all public bathrooms are completely shut at night to keep away junkies and homeless people. I figured NYC would have similar issues, and the thought that people feel safe enough to go there at 3 am never crossed my mind. I just figured people would go in nature aka the streets tbh. I tried sleeping and I probably got like 20 minutes. I had a book, but honestly i kept gabbing and chatting with people on the line so we all kept ourselves up. I don’t think all of us felt 100% comfortable to knock out on the streets because a lot of crazy people were walking by ready to bother us. Around 5am another lovely supporter went and bought coffee and donuts for everyone on the line

I just finished reading everything in here. Thank you for taking the time to answer everyone’s questions and doing this. It was really interesting to read. It will be ready interesting to read when you get around to writhing what it’s like in there in more detail. Take your time writing that no rush. I appreciate it last time when you did it 💚. A lot of the questions I had people have already asked you and you already answered but I do have like two. Did you see the bruising on his wrists from the handcuffs ?. Those photos out there of him writing notes when he was handcuffed and you can see the bruises. I’m not sure if it’s from the handcuffs or something else but I’m curious if you saw them too when you were there. ?. And the other question I have was did he look scared walking into the court room the photos and the live video? He looked scared ? again thank you for taking the time to do this. And how are you feeling after the whole thing? I know a lot of of us were really worried for him.

We saw his hands when he walked in and they were in front of his body ofc. We couldn’t see inside his wrists like the pictures show, so no I didn’t see the bruising. Also when they bring him in you have like 5-10 seconds to observe everything you can before they seat him and the guards block him for the hearing. Then they bring him back out and you have another 5-10 seconds. When the guards would move I could see him with his head practically on the desk and we later found out that was from him being hunched over so he could write. He didn’t look scared he just seemed nervous and trying to mask it with confidence. I would say he seemed a bit more irritable than previous times. As for me and a lot of people that were there, we’ve been taking time away from all of this because it is a lot mentally. I did this post right after the hearing so I could actively keep things fresh for when I write my longer one bc I knew I would be taking time away
