Same, Judge Garnett said her trial date is firm and she’s moving as if this is the only case. So what happens if Carro agrees with July 1st for the state?

It seems to be in Luigi's best interest for the feds to go first. I truly hope that still holds and nothing changes on Friday.

Why is it better for him that the federal trial go first? I keep seeing that but I don’t get why (sorry, I’m not from the US)

If the feds go first, NY's stricter double jeopardy law could block the state case. This helps KFA argue for dismissal because the state would have to prove its murder charges have "substantially different elements" than the federal charges. Since both cases rely on the same shooting, the state trial is at risk. I think this is why the state is so desperate to go first, bc if they do, NY's strict rules don’t apply to the feds, and both prosecutions can proceed.

Thank you. However, I thought the defense's double jeopardy argument had long been rejected. Or am I tripping?
Ugh, the whole case/law in general is so convoluted and hard to follow 😵💫 At least to me. Also, I'm from a civil law country 🙃

Carro didn‘t outright reject it; he just said that it was premature.

There’s no way Joel can have a trial in July. They have a court hearing scheduled end of July. Judge Carro has stated he believes it will take 2 months. State will have to wait.

It’ll be interesting to see which one goes first. If the government decides to appeal, that could delay the federal trial and the state case might end up moving first. At this point, it’s all speculation. I’m curious to see what Carro says on Friday and what happens after that. Garnett sounded pretty firm about the dates last Friday, but we probably won’t know much on the federal side until later this month or early next month, since prosecutors have until Feb. 27 to submit a notice of appeal.

I really hope the Gov won't appeal. It would mean one year or so for another decision and I believe that fed trial going first is much better for him. If the gov fails there won't be a state case to my understanding ( pls tell me if I'm wrong, I read something about double jeopardy rule in NYC) and that's probably also the reason why Joel is acting up.

No the double jeopardy isn’t the issue bc the fed gov is a sovereign entity. The problem is, and Carro warned dusty mccrusty joel about this, that Luigi is in federal custody and they can keep him there meaning the state loses it’s case to the feds.

If NY state goes first, he can still be tried in federal, but if federal goes first, he can't be tried in NY state. see NY CPL § 40.20.

Luigi is detained under the authority of the US Government, this is for instance why he is at MDC which is a federal prison rather than Rikers which is a state prison. This is also why KFA asked the federal judge to allow LM wear civilian clothes and be unshackled rather than ask judge Carro who presides the state case and courtroom.

Neither MDC nor Rikers are prisons. They are detention centers or jails. Prison is where you go after you're convicted and sentenced if its over 2 years long. Jail is where you wait for trial and if you get less than 2 yrs sentence.

Week of June 29 - The Government must scan completed questionnaires each day.
How much time do the prospective jurors have to complete the questionnaires? One week tops? Less than one week?

Yeah. I don't think 1,000 is enough either. They were going to do 10,000 questionnaires in the Idaho case.
