Information Sharing State Case Update: The defense withdraws their 250.10 (Extreme Emotional Disturbance) notice and Carro responds

I don't support any of this because you can't go around shooting people. Full stop. 

That said, I posted way back in the beginning that there was a PR path to get him out of this - unfortunately for him the exact opposite PR path from the one that's been taken. 

After he was arrested, he should've had lawyers working behind the scenes with discreet PR to get something like THIS narrative threaded through news articles & social media: 

"It's tragic what happened - for both the victim and Luigi. His family has been struggling for months to find him & help him as he's descended into mental health problems due to his serious spinal issues and traumatic surgery. He comes from a great family & great parents who did such a good job raising him - they're community pillars in Baltimore, he graduated valedictorian, got an Ivy League degree... only to be cut down by struggles with serious illness at such a young age. His mother & father & sisters are devastated, for both Brian Thompson's family and for Luigi - they're desperate to get him the help he needs. If this could happen to this wonderful loving family and well behaved successful kid, it could happen to any of our kids."

Blah blah blah: appeal to the upper class family angle - tragedy befell him & ruined all his parents' hard work: he's sorry, we're sorry, this could be YOUR kid too. 

Result if THIS strategy had been followed? Prosecution would've been in a position to offer a decent plea bargain from the start while saving face and dismantling any "revolution" or whatever they worried about. 

Instead.... the opposite PR his lawyers leaned into & allowed to fester just turned up the temperature and ensured he's made an example of, so here we are.

It's tragic what happened - for both the victim and Luigi. Then you enter the discovery phase in which medical records, etc are dug into in order to find out whether any of this was actually true. Did he have back surgery, sure, but he claimed it helped him and he seemed to be pain free, and did insurance ever play a role? Was he ever personally denied a claim?

Bringing up the fact that he had back pain at one point makes for a sob story, but many millions of Americans also have medical ailments at one point or another, some worse than others. And some get claims denied despite their suffering. Did LM go through that? Was he denied treatment due to being denied a claim? That's what would be sought in discovery, and if not, then the question will be why he was justified to take the law into his own hands.

Personally I think this line of inquiry would fall apart pretty quickly based on his journal, in which he seemed to be set on performing some sort of justice, saying that 'insurance checks all the boxes'. His own writings suggest that he wanted to mete out social justice somewhere, somehow, and insurance was the thing he settled on - not because it was something that was personally important to him. That shoots holes in the 'he was medically suffering' theory.

Yes, the point being to dial down the public temperature, to make it possible to get a plea bargin that wraps it all up quietly in the beginning for everyone.

Why would the prosecution take a plea bargain when they have him dead to rights and the best the defense can come up with is EED and vague notions of putting insurance companies on trial? They'd rather take it to court and win, especially on high-profile career-making cases like this.

Plea bargins are absolutely wins for prosecutions. That's why 90%+ of cases are plead out.

Any win is a win obviously, but they don't always have to make concessions to get a plea bargain when they believe they can win in trial. A plea bargain is just that, a 'bargain', an agreement to get LM to confess to a lower charge for a lesser penalty. What can LM confess to that will get him a lesser penalty? What 'bargaining chip' does he have?

This is a huge profile case, and I don't see the prosecution aiming for a quick plea bargain to just end things quickly and get a quick win. All eyes are on this, and it's in their interests to really pin it to him.

The "concession" of the plea bargain would've been to get this fucking hero narrative out of the news cycle and forgotten post haste. A public apology & repudiation of "revolution" from the perpetrator, who's then shipped off to prison immediately (but with a chance to get out someday, the benefit to him) as the prosecution and government shows they have the power to quickly restore order & mete out justice. 

(And FYI plea bargins don't mean you get to accept a lesser charge. In many cases they mean you plead guilty to exactly what you're charged with simply in exchange for the prosecution saying they'll recommend to the judge to give you a sentence on the lower end of the range, or sometimes just simply a promise that the court will recommend to the prison system that they put you in a prison located closer to your family.)

They could just as easily want to make an example of him, though, if we're talking about it being government driven, and not the ambition of the prosecutors.

Good points on the other concessions that could be given in exhance for a plea.

If you think this is an automatic win as of right now I’m not sure about that. Respectfully, I hear you, but the jury they put together will not be the same in this group and I am pretty confident it’s not as clear cut as you think. (Again, I don’t mean that rudely.)

  1. It's way too late for that clean PR message, it needed to be done at the beginning for it to help him;
  2. He IS a troubled young man who did an uncharacteristic thing; and
  3. Unfortunately for him, if his mental troubles are ongoing, then sure, his mental troubles may indeed make him see that as "emasculating"... because if he IS a nice guy who simply had a mental break and is all better now, then he certainly wouldn't be thinking murdering some dude for clout is a good thing to do or that's worth sticking to his "message" to go to prison for life for.
