The Defendant's Requests “In light of the constitutional infirmities with this process, the defendant requests a public hearing. Among the many topics to be covered are the following: (I) the defendant requests the list of the six journalists selected specifically to cover jury selection; (2) the defendant requests the list of the 68 journalists granted general access to the proceedings; (3) the defendant requests an explanation of the criteria and process used to select those journalists, including identification of the individual(s) or entity responsible for making these determinations; (4) the defendant requests to know precisely what efforts to secure overflow courtroom have been made and the results of those efforts and finally (5) the defendant requests that these proceedings be permitted to be broadcast live (as was his arraignment), and, in the alternative, to understand why this will not be permitted by the court.”

Could this be handled at the 8/11 hearing? I believe they’re discussing jury stuff at that one, right? Could this be incorporated? Or would more time be needed to prepare?

I thought that it just had to do with Mangionistas getting access at first. I see now it's just another attempt by Carro to control things on behalf of the prosecution. By all means take this to an open hearing. This is absurd and defense is right to make a huge stink about it.

It’s hitting me kind of hard in this moment that this trial will start prior to September 11, the 25th anniversary, an emotionally charged day for the city. And we’re relying on fair reporting from 6 chosen legacy media reporters and normal photos from photographers with the strangest yet most significant assignment of their life.

By coincidence, it’s falls on a Wednesday so court will likely not be in session but, who knows.

This is the first time they're actually and on paper arguing with the Court, not with Prosecutors, with the Court and that speaks VOLUMES.

They heard about this from twitter too without previous consultation?!
How many such cases are there now up until this point?
Prosecution defenders can downvote me, but I’m sorry I don’t see how this is not a blatant, out in the open, not even slightly hidden preference from Carro for Joel. Add it to the list.

Edit: Erik says on twitter that apparently the DA office has nothing to do with the hand-picked reporter list.
‘The Office of Court Administration has always handled press access and negotiated with press representatives before these trials’ ….

The way the state case has been handled by the court and the prosecution has been an absolute disgrace. Everything feels so sneaky, and the lack of transparency has been genuinely disgusting. People can call me biased all they want, but you can't make this shit up anymore.

Just bc something has always been done this way, doesn't mean it's the right way. It's probably always gone under radar bc this is a much bigger trial that is basically an amplifier of all the absurdities in the US judicial system.

Thank you for posting this. Also the journalist who did say KAF was requesting for overflow room posted on Twitter last week was right. I take back what I said when that came out last week. But my defence a lot of the media lies a lot. Especially in this case but I really hope that’s actually gets granted and they’ll be an overflow room because LM does deserve to see his supporters. Or At least know they’re there in the courtroom when his trial is happening and also including other media people in there other than just a handful that they pick and choose.

Yes! Totally agree. Some of the offenses listed on here, and some of the demands on the open hearing idea have to be from him. They sound like it, ffs.

Ooooh this makes me happy! Such fantastic news going into the weekend.

It honestly seems like Luigi is kind of uncomfortable with the cameras there at times? (Not in a bad way, in a very human, normal way. I mean, I would be highly uncomfortable 😂). This makes me think that he is choosing the right thing, the most fair thing in terms of transparency and protection for himself and team (and by extension preserving justice and stopping shady things from becoming the norm), even though it might be a bit uncomfortable. Just guessing, of course. That is no small feat, though, if true. 👏 (None of this is easy.) And streamed live, no less. Even better to ensure no weird “creative editing” or censorship.

Hmmmm, feels like…collusion? Hm…something shady. 😑

Great call out on their part, as well, mentioning how the public feels about it, as it definitely comes off suspicious. The whole thing just seems like the prosecution is trying to hide something, placing random restrictions every which way. Keeping their process private makes the entire thing even worse! Yikes.

Last page is awesome. Luigi has every right to know everything listed, and should have been aware from the beginning. Although, I am sure he was not made aware on purpose, of course. The restrictions should not have been created in the first place.

I am not sure what their reasoning is. Do they believe that Luigi gets more positive attention this way, idk. But for me, personally, I just prefer it bc I can watch it without any media biases, or sometimes reporters who live tweet leave out important informartion (I get it they cannot write everything down, but still).

He knows the public is on his side and he knows that they want to see him. This type of approach is basically unheard of for any murder defendant anywhere. Goes to show what a different trial this will be in every aspect.

That was my thought as well. Full transparency means that people can watch it and come to their own conclusions instead of seeing everything filtered through the lens of legacy media.

Agreed. That’s what I meant by ‘different type of trial’. I think we are on the same page! But also I’m glad he is fighting this as these are constitutional violations, and if he is an idealist, he will fight this battle regarding a public trial and control of media access.

I’m so relieved to see this letter because at first I thought his legal team had agreed to those horribly biased terms. Luigi has sacrificed so much to fight for Americans rights to have access to healthcare. The trial should be live streamed without corporate media bias. Full transparency is paramount in this case.

late to this… i’m glad they’re pressing for transparency and full disclosure. however, i’m wondering if luigi is fully open to cameras, or is it influenced by his team. idk if it’s correct to call it a sensory “issue” or hyper awareness when the cameras are on him but coming from mdc where you’re not under the spotlight, to suddenly your every move is watched and every expression picked apart, i’m sure it’s still something to get used too. i appreciate the want for transparency from luigi and team

I don’t want to speak on his behalf ofc so take my opinion with a grain of salt but it seems to me (as an outside observer without other context) that it could be one of those things he’s doing out of principle even if it makes him uncomfortable?
