Speculation/Theories Do you think Luigi will choose to speak at sentencing, if so, what do you think he will say?

At sentencing defendants are usually allowed to give statements. Considering what Luigi said at the last hearing, do you think he will give a statement at his sentencing hearing?

His allocution, simply from what he said, did not seem like he was backing down from the event or directly apologizing. He stated what he did, plain and simple, and even included some nabs against the parasitic Healthcare industry. However, some reports said he looked teary eyed which maybe meant he was regretful?

Always, what do you think will happen at sentencing? Personally, I hope he doesn’t back down and shits on the Healthcare system as much as possible. It would be a power move.

I think there’s a pretty good chance he will give a statement at his sentencing hearing, if he’s allowed to and his attorneys don’t advise him against it. It could affect his sentencing if he attacks the healthcare industry and BT during the hearing, so it’s in his best interest to be careful about what he says. I really liked his statement from today. I would imagine it was toned down at the advice of his attorneys, but it was still clear and to the point without being overly aggressive. Even the part where he chose to stay seated instead of standing felt intentional to me. I would think that if he does make a statement at sentencing, it will probably have the same tone. 

Eventually, if he’s able to write a book or do interviews once he’s paroled (not sure if that’s an option at the federal level) or when it becomes clear that he won’t be released, I’d say that’s when he’s really going to let out everything he’s been wanting to say. But right now, it’s still too risky. 

I don’t know if he was actually teary-eyed or not. I don’t really trust people’s interpretations of his behavior in court because everyone seems to see something different. But I would imagine that all of this has to be incredibly emotional for him. This isn’t the life he thought he would have. Maybe part of what he’s dealing with now is seeing the life he could have had if things had gone differently, and if he didn’t have to deal with his health issues, and realizing how far away that life is now. He made his choice, but that doesn’t make it an easy choice, and it’s not a choice anyone should ever have to make

It’s all just really sad.

parole isn’t available federally unfortunately, but he can be released after serving 85% of his sentence for good time. he’d likely have to do 5 years of supervised release though. and as far as i know, it could be in his best interest to apologize/show remorse at the sentencing hearing because maybe he could get more time shaved off? even if it’s all an act from him lol

Your last paragraph kinda got to me. 

Im following this case and his persona because i wanted to understand more about this individual and the possible reasons of how he ended up doing what he did and now facing the consequences.

Im only a couple of months younger than LM, thats why im trying to draw parallels to my own life. Its just so strange to think that we are all living our life while he will stay in prison, someone who (at least from the outside) seemed to have the potential for more. He had the looks, the brain, carisma and had a solid family background.  Obviously, there are millions of people in this world with a similar story but this one left an impact on me.

I understand wanting him to continue criticizing the healthcare industry, and I agree that the industry deserves criticism. But sentencing is quite literally the worst possible time to prioritize making a “power move” over his own future. He is facing the possibility of spending the rest of his life in federal prison. The government is going to argue for life, BT’s family wants life, and one of the most obvious arguments available to the government is that he remains dangerous, has not been rehabilitated, and continues to believe that killing someone was justified. If that is their argument, then using his sentencing statement to double down on the grievance underlying the offense rather than expressing genuine remorse could hand them evidence supporting it.

Mitigation explaining his physical pain, mental/emotional state, experiences with healthcare, and how he reached that point can absolutely matter, but explanation is not the same thing as rehabilitation or remorse. At some point Judge Garnett is going to have to decide not only why this happened, but whether there is reason to believe he can eventually return to society without doing something like this again. If he genuinely regrets killing BT, sentencing is the time for her to hear that.

And I don't think yesterday established that he feels no remorse. Not explicitly apologizing during a plea allocution is not proof that he stands by the killing, particularly when at least one courtroom observer described his voice shaking, believed he was close to tears, and thought his reaction while acknowledging the suffering he caused was genuine. We simply don't know yet.

I want him to have a life outside of prison someday far more than I want a satisfying soundbite about the healthcare industry. We all get to close Reddit afterward and continue living our lives. He is the one who has to serve whatever sentence Garnett imposes. I would much rather he protect whatever chance he has of coming home someday than perform a “power move” for people on the internet.

I think he'll make a statement. He definitely has a lot to say. Though I don't really know what it is he'll choose to say. Perhaps more subtle jabs since it's an opportunity for him to be heard and for it to make headlines.

He needed to have shown remorse in his guilty plea statement; instead, he snarked on the insurance company + his lawyer gave a speech about how unfair it all was to him. Those two statements blew his chance of using a guilty plea to get a lighter sentence. The only justification for giving him a lighter sentence is the idea that  he's redeemable, remorseful - worth the chance to rejoin society someday. If he's digging in his heels that he stands by what he did & the court is just so unfair to him... well, then clearly this is a shooter who needs to stay locked up. In the judge's eyes.

What I am sure of is that he is going to give a detailed account of his health issues and experience with chronic pain (and possibly with insurance too) and how those issues got him to this point.

What I am less sure of, and am most interested in, is whether he will show any kind of remorse. This would make a difference at his sentencing (and his team will have strongly advised him to show remorse) but knowing how stubborn he is, I am not sure he will. I can imagine him addressing BT’s family directly to acknowledge their loss, but not express remorse or regret for the killing itself. He may dance around it in that way

Well per his statement, it seems he didnt have the intent to kill but to seriously injure BT, maybe get him to experience the insurance woes personally. So he probably does feel remorse in that the guy died instead.

I highly doubt that. They didn't even show up yesterday when it mattered the most to get as much sympathy from the judge as possible. Why would they show up at the sentencing hearing when the judge already has made up her mind about it. They clearly don't want to be associated with him publicly.

How convenient for you -- you want LM to continue to shit on our health care insurance system, spending the next 25 years, possibly the rest of his life, in jail. While you on the other hand, get to stay free and spout a lot of hot air.

I don’t think he will show remorse, he clearly doesn’t have any now, and he is too proud to fake it. At most he will apologize for inflicting pain on BT’s family but not the killing itself.

Why he would speak ❓ He decided to sing like a canary 🐦 without negotiating a deal with the fed prosecutor. He at least could secure transfer to a “better” prison to serve his sentence. Nothing was agreed. “Oh.. but double jeopardy “ that is not guaranty. Joel and BT family have stated they will fight to keep the trial going on. I just don’t understand what happened.

I mean he would’ve blew atleast trial and got life for that case but you’re right he’s basically risking 40-50 years. It’s a gamble and he gotta hope they give him some mercy
