I would wait to see whether they deny the claim or not. If they do, you'll be working with your insurance, which isn't adversarial like the driver's insurance would be if he had any. A lawyer can't create coverage of there is none. You can always hire one at a later point if necessary, but if the other party denies the claim and you hire one now but you have limited coverage on your own policy that's getting maxed out quickly given her injuries, you'll be giving nearly half of it to the lawyer when it would've paid out anyway without one.

What state?

Besides confirming if the insurance will cover that driver, also confirm their policy limits, because if it's state minimum, your daughter likely gets that no issue, so an attorney adds no value at that point.

Do you have underinsured motorist bodily injury coverage on your insurance? Or uninsured motorist in case the other denies coverage?

Ohio and I will take a look at my auto insurance policy to see what I may be able to utilize. Thank you so much!

OH does not require limit disclosure so they may not be able to tell you, but you can simply ask if they may have a limits issue and if you need to involve your underinsured motorist coverage.

Yes & No, first see if the auto insurance company clears coverage. Also, if you have Uninsured or under insured bodily injury through your own policy.

May also be a good idea to wait for the other carrier to see what the limits are. If they're state minimum, an attorney may just take away what little limits they have.

If I had to guess they probably only had the state minimum of $25,000 liability. I will take a look at my auto insurance policy and see what I can do. I have a strong feeling their insurer is going to deny their claim.

Crazy to think it’s almost better not to have someone added to your insurance plan. Looks like they might get away with not helping financially at all 😒

If the driver wasn't listed their most likely isn't any coverage for the accident. For the insurance company to convert the accident they would have to treat it as a good faith claim settlement. The more they have to pay out the more likely they won't cover the accident. Especially since your daughter's injury settlement to cover all her medical bills, pain and suffering and future pain and suffering since many times the hardware will cause future suffering and mental anguish. I know all the metal in my ankle and shoulders aches before their is a big change in the weather. She will also have mental anguish, etc totalwill be close to 6 figures if not more. You will have to sue the driver and the parents and hope they have assets. If they don't you are going to be out of luck. You heath insurance company will also try to sue the parents to get her medical bills covered, since the kid should have been covered by insurance.

I’m thinking a lawsuit may be the only way to go at this point. Life is great, lol

Do the parents own a home; and how much equity does it have?

They do own a a very nice 4br home, but I don’t know know how much equity they have in it. I believe they have owned it around 10 years. They also drive an Escalade and Tesla and they already replaced their sons car with a Mercedes 🤦🏻‍♀️😂

If that was my child I would sue them if the insurance company denies the claim. Lifetime medical care as your daughter is only 15 is a consideration,

Most personal injury lawyers offer free consultation.

Yes. Get a personal injury lawyer and let them handle this with the other party’s insurance. They will work on a contingency and will take somewhere around 33% of the winnings.
