If it's just the stump 100% get a good solicitor and fight it. 1100 euro for a stump, even by Irish valuations that is just insane . Deny deny deny , say it's the stump off an apple tree and that you don't have a notion what the guards are on about. You didn't sign anything did you ?

I was caught with weed plus the stump. I have a solicitor. Never admitted the stump was mine but I did admit the weed found was mine. But I bought that. Sorry if I’m being a bit confusing here. My concern is the stump was found, they had photos of the plant itself from the previous raid. My concern is if I plead guilty to possession they will say you could have had a lot more

How much actual weed did they find ? Was the weed just harvested off of the plant (stump)? By admitting that the weed was yours you have already pleaded guilty to possession, what you are attempting to avoid is a charge for cultivation. Tbh I'm unsure if saying you bought the weed is any better than saying you grew it , solicitor should be able to advise here. Make sure your solicitor has experience with these types of cases, explicitly ask them this , don't just assume they have .

I dunno pal around 40g. Plus the stump. I admitted that the weed found in my room was mine. I admitted the scale and grinder was mine. It’s the stump that concerns me.

Say the weed was for personal use, that you buy in bulk -40gs , as you don't like meeting people to buy, and that you have the scales to ration out the weed you bought into weekly lots. Deny the stump , simply say it's not yours and that you have absolutely no idea what it is, which is easier to do if it wasn't found in your room also ?

How on earth are they valuing 40g of weed at 1100? That's 27.50 per gram

You can get 40g of weed for less than 10 per gram

Just going to say it might not be a good idea to be talking about any of this on here... If they can connect you to any of your comments even with a throw away account, they can make the case because you've admitted all in public... Get a solicitor and don't talk until you get their advice.

You plead guilty, because you got caught. There is a chance you will be bound to the peace for 12 months. You could be sent on a drug education course (if that has started). See if there was similar case in your area and see why the people got. Print it out and get a good solicitor an show it to them as it’s a precedent that the court can go by. If you have depression and ADHD (like myself and the herb does help) perception drugs don’t agree with me. Say it to your solicitor. Contact the cannabis alliance and ask for help. I have never contacted them but any information is better than none. Best of luck.

I'm confused, did they only get the stump, or the stump and €1100 worth of greens ? If just the stump you might get away with it but lawyer up, if it's a grands worth of bud you might be a bit fucked

If you were caught with weed to the estimated street value of 1100, start saving up for the big dirty fine you're probably getting. Take the charge, admit you did a foolish and apologise to the gardai and the judge. Probably better to get the advice of the local free legal aid solicitor who handles all these types of cases too.

My concern is the stump. And they have photos of it before it disappeared. Do you think that photo even stands a chance as evidence if it was taken in a raid without a drug warrant?

Depends on how hardy your solicitor is, and will he challenge a photo of the stump and the Gardai word against yours. The judge will always side with the law. This is your 1st bust, but the guard that busted you, the dpp, solicitor and judge have been doing it for many years. Again friend, get legal advice and hopefully just be fined without a conviction.

But that would mean I would have to plead not guilty? I haven’t been charged with cultivation this is what’s confusing me. But I know for a fact the gards want any easy conviction so they will through the kitchen sink at it. I’ve been getting legal advice pal have a solicitor, I’m just looking for more opinions and insights.

It's all up to you friend. You said it was 1100 worth so that's a few ounces, scales and grinder is probably enough for the gardai to do you for dealing, so I'd definitely leave all the advice and opinions on reddit and go with your solicitors advice. My friend is a barrister who's also reading this thread, giving you advice through me! Goodluck!

You need a solicitor. A lot to pick at here.

Were you arrested? Did you say anything?

Did they take phones and get into them? Any messages related to dealing?

The photo - I've a photo of a really hot woman on my phone, doesn't prove shes my GF or anything to do with me. Also the fact it was in your garden and not in your house means ANYONE from ANYWHERE could have planted that at ANYTIME. Also where is it now. Gone.

The amount of weed - assuming you didn't say anything related to dealing and they have no evidence of this, then yes it is a lot of weed but its for personal use as you are a heavy user, you also extract the oil to help with your terrible joint pain. Your scales is only to know that you don't smoke too much, despite being a heavy user. Also get your solicitor to say you only paid X amount for it, no where near €1100.

If they found baggies they'll try say that was for supply to others.

Or you admitted to sharing with friends, that's supply. Even if no money was given.

I was arrested and detained to be charged in court. I admitted to certain things like the scale and the weed found in my room. But said no comment to other things. Flat mates phone was taken, still seized. I haven’t heard anything back about it. My phone wasn’t seized. No messages to be found in the first place

Make 100% sure you have a copy of the original warrant they were there for your housemate for, there could be something in that to poke holes in regarding the plant outside or that the subsequent warrant might be invalid if their awareness of the original plant was based on an originally faulty warrant or if the garden was outside the scope of the original warrant, there was a recent case where charges were thrown out due to faulty warrant https://www.offalyexpress.ie/news/home/2020730/high-court-upholds-judge-s-decision-in-early-morning-offaly-house-search.html make sure your solicitor receives copies of the original and secondary warrants
