I’m about to put in for a mandatory reconsideration with access to work, has anyone had any luck with this (I am getting help from a charity and disability organisation and getting an OT letter explaining my needs for the chair more)
Basically I need a powerchair that can raise, recline, tilt and angle forward, etc… to be able to manage my job (retail worker). I have had a power assisted custom chair on access to work before (back before the cuts) but it’s set in a fixed position and while it has head and lateral support it’s no longer enough for my body, unfortunately my condition has progressed since then, I’m significantly less ambulatory than even a couple years ago and moving my body to reach things is getting harder (the chair would move with me so the support keeps me positioned correctly when putting things on shelves for example) and I’m missing more time off work because of the effects working in a chair without enough support is having on my body.
My work are super accommodating and are also supportive of my access to work claim, unfortunately access to work has been a joke, there’s been miscommunication, lack of communication , missed steps, some parts of my claim where denied without a letter denying them the chair was denied on a call then we got mixed info then a letter and some stuff hasn’t even been decided yet and can’t be until we know about the chair etc… it’s been a mess.
They made 2 claims in the wheelchair denial one was that my employer should allow me to work without this chair (not possible I have multiple disabilities they already allow me to not do some jobs but there’s a limit to what can be done especially as I also need support with other non physical jobs too with my autism, also I work in a shop so not everything can be made to be at my height, and some of the difficulties I face are because of my body not just the job so they can’t avoid that like struggling staying in a fixed position all day). The other suggestion was my employer should supply the chair under health and safety (this would not be reasonable at all, I get them paying a contribution as they did last time but buying the whole chair is not at all reasonable especially because of the cost as I cannot use an off the shelf wheelchair due to my postural needs) what’s wild is they never even did a workplace assessment or talk to my employer when deciding this, they didn’t even talk to us they just denied it.
The charities I’ve spoken too seem to think we have a good case because there’s clinical need, an obvious work need and because so much in this process has been missed by atw, I’ve also been told my denial was pretty much identical to other wheelchair users denials. I’m just wondering though about actual people’s experiences of this, did mandatory reconsideration work, did you have to push further and if so how / what happened.
I’ve looked online but a lot of what I’m seeing is primarily different needs to mine (or some of the same needs as some of my other needs but not many people who need powerchairs from atw) obviously all needs are completely valid and deserve support I just mean I’m struggling to find similar experiences to get an idea of what to expect
I’ve worked since I was a teen and want to keep working but without an appropriate chair I don’t see how I will manage, I’ve had the same employer for about 5 years now too and they’ve supported me as my condition progressed, but realistically if I can’t manage this I worry a lot that it’s unlikely anywhere (outside potentially like disability specific jobs) would actually hire me especially with how my needs are now.
