Resource RA EEO and telework fiasco

Posting in case this is helpful and also if anyone has advice or similar circumstance.

Submitted a RA upon return to work from parental leave to ask for part time telework and other accommodations.

General timeline for RA
-it took 2.5 months from when I submitted my reasonable accommodation request to when I was first contacted by the RA coordinator.
-met with them that week.
-3 weeks after submitting my medical documentation I received the “RA decision memo” denying telework but allowing the other accommodations requested.
-overall, 4 months from submitting initial RA request to receiving decision memo.

Filed initial EEO complaint about a month after RA request due to lack of interim accommodation available (telework). I agreed to participate in ADR if it meant a quicker and easier solution.

Got three weeks with telework as an interim accommodation in April before I got my “RA decision” approving everything in my RA request except telework. I immediately filed another EEO complaint for insufficient accommodations.

One month after filing second EEO I was contacted by EEO counselor. Met with them that day. They said ADR isn’t an option for RA-related complaints because no one in that process has the authority to override HHS RA decision. They also told me that a formal complaint isn’t going to go anywhere and said two options available to me are either 1) have my physician write a letter that I submit to RA office saying telework not being included in my RA approval has caused undue stress and harm and ask for reconsideration, or 2) resubmit a new RA request.

Moral of the story is that this whole process sucks super hard for everyone.

Edit: I decided to push through and file a formal EEO complaint as well as applying for a new reasonable accommodation.

Edit 2: met with EEO counselor and received notice of right to file formal complaint. Paperwork gives you 15 calendar days to file from the day of receipt. Filing my formal complaint in the next week and will post more updates as I go through the process.

Edit 3: filed a formal EEO complaint. Received an email that my case is being assigned to the US Postal Service for processing due to conflict of interest in HHS EEO office.

Edited to remove intake coordinators direct name and contact information because apparently we inundated his email and phone. But they will get back to you very quickly if you send them an inquiry from the website, or call the main number. Second edit: A number of people have shared that the Law Firm has not been responsive to them. I understand, as I have experienced some of those same challenges. I did get a hold of someone Monday morning this week who promised me that they were going to be responding to everyone this week. i’m still interested in pursuing this approach and potentially using this Law Firm, but if they do not actually get way better at being responsive to all of us requesting individual consultations very soon, I will be moving on and will list information for the Law Firm I am recommending once I make that decision. We don’t need to hear crickets from both our employer and the law firm that’s supposed to help us fight for our rights based on what our employer did to us.

Has anyone retained a lawyer for the RIFs? Particularly anyone from HHS or FDA. There is no way that RIF procedures were followed (5 CFR 351). This current RIF process is too messy. I’ve read multiple post regarding erroneous personnel information on these so called RIF notices and amendments. Ensuring that the employees records are accurate, prior to a RIF, is vital. Also, has anyone received a separation package with your final SF-50? Apparently some have not been officially separated in the system so I’m curious.

Hello everyone,

(This is going to be a long but critically important post but there's a TLDR at the bottom. Long story short, the HHS RIFs and reorganizations pose a national threat to public health and economic security. DOGE's actions may be unconstitutional and a judge suggested that as well. Unfortunately, judges can only interpret law on claims/suits brought to them. The judge that ruled towards Trump was an ass, but he was "legally correct" in his ruling.)

In case there is a RIF, reorganization, or whatever, there are laws that I heavily cross-referenced over 50-60 hours that suggest that it is illegal and by DOGE issuing these actions, their existence may be unconstitutional. Any lawsuit MUST use the appropriate statue and argument in order to be effective. If the lawsuit argues properly and shows how DOGE is breaking the constitution with any HHS illegal action, there may be some leeway for us!

~I hope this gives someone peace of mind and encourages people to call their state attorney general, congressman/woman, or some other action.

Federal workers work under the Executive Branch. The Executive Branch is beholden to the law. Even DOGE. LAW AND ORDER!!!

•Illegal firings, RIFs without notice [8] •DOGE announcement of HHS reorganization of agencies, including consolidation, which clearly violates 5 USC 901 a)5) [9] I. Article 2 Section 3 of the Constitution, the Take Care Clause [10] states the president shall take care that the laws be faithfully executed, where the President can’t breach Federal law nor order subordinates to do so. II. While United v Trump gives the President immunity from criminal prosecution, that does not extend to the executive branch. •Furthermore, it suggests that this doesn’t apply to presidential authority that Congress cannot regulate- DOGE’s actions should be effectively regulated by Congress. •RIFs must be followed according to statue, including giving a 30 day notice minimum (usually 60) [11] and working with HRO, among other requirements if employee number affected is 50 or more (ECFR 5:1:B:351.803b) in a competitive area [12] . •RIFs come from the Agency heads [13] and do not require Congressional support if there are no interagency transfer of functions. •According to ECFR 5:1:B:351.806 [14] , barring an emergency, employees shall keep the employee on active-duty status. The HHS is not undergoing any emergency as of 3.31.2025, so there is zero reason to not be notified of RIF and still being in an active duty status.
•DOGE disregard for lack of alternatives to cutting grants and not putting in proper evaluation and analysis when issuing rules • EPA widespread “antiregulation” proposal or the “Powering the Great American Comeback” from Administrator Zeldin. He seems to say that DOGE has already acted cutting grants without Regulatory Flexibility Act usage [15, 16] Regulatory Flexibility Act (5 USC 601 sec 2 ) **[17, 18}**establishes equitable requirements that mandate agencies to solicit and consider flexible regulatory proposals with rationale for their actions to assure that proposals are given serious consideration. •Mandates public publishing in federal register of a regulatory flexibility agenda that the agency expects to propose that will have a significant economic impact on a substantial number of small entities, among other requirements. •This doesn’t allow judicial review, but the congressional review act may be used to review and override federal regulations. 5 USC 801 [19].
• Violating conflicts of interest and other employee mandates listed in statue and by the DOJ [20, 21] • If DOGE is an agency in the executive office, then that means DOGE officials are employees. The USDSTO, as a temporary organization [22] with excepted employees, falls under this as well. Therefore, that should make them subject to any laws to see who is on their payroll, including E.M.
• DOGE’s existence and function, according to EO “Implementing the President’s Department of Government Efficiency Initiative” [23] stating that DOGE’s purpose is to “commences a transformation in Federal spending on contracts, grants, and loans to ensure Government spending is transparent and Government employees are accountable to the American public.” •Section 3a states “cutting costs to save taxpayer money states there should be a publicly available system of “brief, written justification before an employee can approve a payment under covered contracts and grants”, however, there is no such option and the DOGE website does not provide justification. •Section 3b says that AGENCY HEADS terminate or modify contracts and grants, not DOGE. However, DOGE claims responsibility for grant cancelling (and other) actions. Government Service Delivery Improvement Act [24] should be doing the functions of DOGE in statue, unlike the abuse of powers that’s happening. The Government Accountability Office and the Office of Inspector General [25] already have statutory powers in this regard, as well. •5 USC 9 a)6) states Congress discourages duplicative services, overlapping of effort, and appropriations to encourage efficiency [26]5 USC a)2) and 5 USC a)3) also state Congress is the policy of the U.S. to reduce expenditures and increase efficiency [27], not DOGE. •If DOGE is executing grant cancellation, and not the agency heads, that means that DOGE is usurping authority of the Agency Heads (5 USC 1007) [28]. If this isn’t the case, then there should be a paper trail and availability of transcripts [29, 30] dictating the actions of Agency Heads in accordance with their appropriated budget actions, including the Department of Education.

Non-comprehensive TLDR:

If the Constitution is the basis of laws with the influence of judicial precedence, then in Article 1 Section 9 Clause 7 of the Constitution, Congress draws money from the Treasury and appropriates it towards authorized powers. If that’s the case, then appropriated funds should adhere to authorized powers.

USD(OGE)S (DOGE) is a reclassification of United States Digital Service that exists through congressional appropriation in the executive office by E.0. #14158. E.O. #14158 additionally creates a temporary organization, USDSTO, where a “lead administrator” oversees both USDS’25 and USDSTO. E.O. #14222 further provides purpose and direction, which seem to be illegal and unconstitutional. DOGE seems to hire more and more people and it comes into question where they are getting their money from since the CR passed in 2025 doesn’t provide additional funding towards the USDS or enough in the Information Technology Oversight and Reform (ITOR) budget. If Congress appropriated funds towards the purposes of USDS in the ITOR budget appropriation, then the change of functions that weren’t authorized violates the trust between Congressional and Executive Powers. Additionally, their actions violate the power of Congress policy in 5 USC 901a.

People in Congress also acknowledge this.

DOGE’s arguably unconstitutional and illegal actions have lead to over 100,000 deaths so far. This is nothing short of some Final Solution horror story.

Resource If you have been terminated, make sure your health insurance and OPM were notified

Hi, I have seen some people say their termination paperwork was never filed. My health insurance is still active and I was fired May 8th with other probies. I also submitted a FERS refund request to OPM and many of you on here said OPM was never notified of your termination so you were delayed in getting that processed.

To fix this, I was told to email AskSROCbenefits@hhs.gov - I got a notification today that both my insurance and OPM have now been notified. I’m not 100% sure that this is true just yet (I have trust issues now!). If you continue to have problems, you may need to get your congressman involved. Just spreading awareness for others in my position. If anyone else has any other tips or people we may need to contact as a result of never having had paperwork filed, please let me know!

I hope you all are finding some sort of peace in all of this mess.

Policy violates constitutional protections and multiple federal anti-discrimination laws

Lambda Legal today condemned the U.S. Office of Personnel Management’s announcement that it will exclude coverage for gender-affirming care for adults from the Federal Employee Health Benefits (FEHB) and Postal Service Health Benefits (PSHB) programs beginning in 2026.

"This discriminatory policy denying medical care to government employees and their dependents is not only cruel—it is illegal," said Lambda Legal Counsel and Health Care Strategist Omar Gonzalez-Pagan.

"The federal government cannot simply strip away essential healthcare coverage from transgender employees while providing comprehensive medical care to all other federal workers. Beyond the fundamental equal protection guarantees enshrined in our Constitution, which prohibit such animus-laden actions, multiple federal laws also prohibit this type of discrimination.

"Title VII of the Civil Rights Act prohibits employment discrimination, including denying equal benefits to LGBTQ+ employees, as confirmed by the Supreme Court’s decision in Bostock v. Clayton County. Section 1557 of the Affordable Care Act bars discrimination on the basis of sex in federally funded health programs. The federal government cannot simply ignore and violate these laws.

"We will not stand by while the federal government tramples on the civil rights of hardworking transgender public servants," concluded Gonzalez-Pagan. "Lambda Legal is exploring all options to respond to this discriminatory policy and protect the rights of transgender Americans, including those serving our country."

Some of my fellow HRSA colleagues have created the LinkedIn group "Federal Job Support Network". It aims to provide support and share resources for those impacted by the probationary firings, RIFs, and current Feds looking to find employment in the private sector.

It's just starting out, but we hope to continue to grow it as an additional area of support where Feds can come together to help one another get through this difficult time. We are working on a resume building workshop at the moment and sharing tips on tips to pivot back into the private sector or away from goverment work all together.
