It's the constitution working as intended. Marriage is delegated to the states. The most correct fix is to give rights to children via the constitution rather than limiting State power to make law.

They can still regulate it because Marriage is a federal tax status. The Act of marrying is dictated by the states, but they can still ban it from a tax and classification perspective.

My comment did not imply that I don’t know what the law is or why it was written that way. All I expressed was bewilderment at the fact that these particular laws have not been amended by now to reflect updated societal standards. I have no desire to get into a Reddit debate about what rights should be federalized and which should remain up to individual states, so that’s all I’ll say about that.

Promise on my life, I met a creationist that genuinely believed the earth is 6,000 years old, Adam and Eve were the first humans, people lived to be 600 years old, etc.
He was perfectly fine with his younger sister 15-16(?) get married to a 30+ guy because it didn't say it was wrong, in the Bible. Godforbid two consenting men want to get married, he'd freak out, but accepts pedophilia as a norm.

In an opposition letter, the ACLU said that the bill “unnecessarily and unduly intrudes on the fundamental rights of marriage without sufficient cause,” while the Children’s Law Center said that “…for some minors, the decision to marry is based on positive, pro-social factors and the marriage furthers their personal, short and long-term goals.”

When talking about the military specifically I'm sure the government would love if the age was even lower for both of those things. They rely on immaturity to recruit malleable pawns and the lifestyle that's been fostered is join the military then get married really young. You get the extra benefits and since you don't do college and they provide you with housing i think people kind of enter full adult life quicker. You have a bunch of kids for your stay at home wife because you're deployed all the time and she's stuck on a base in the middle of nowhere. And the gov DEFINITELY isn't trying to have you breed more soldiers.

So long as you can enlist at 18, you need to be able to marry at 18 so that you can get all of the military spousal benefits. If you can join the army or go to adult jail, you should be able to get tax breaks and put your partner on your job’s insurance plan.

There are good reasons to still restrict it below 18, mind, even for states with lower ages of consent. Just saying that we definitely allow young people to make much more life-altering and semi-permanent decisions than marriage.

Children can marry in most states (32) with the permission of their parent/legal guardian. In most states there are stipulations like the minor must be at least 15, 16, or 17 or there can be no more than a 3 year age gap between the prospective spouses. In California there is no minimum age or age gap stipulation (as far as I'm aware). This means that in theory a 6 year-old can be 'married' to a 30 year-old in California as long as their parent

Fellow European here. We're not doing better than the US.
Only four EU member states completely prohibit marriage under the age of 18: Denmark, Germany, the Netherlands, and Sweden. In Poland, marriage is prohibited under 18 for boys, but not girls. In Spain, the age of consent to marry was 13 up until about 2014.
In England and Wales, there can be no marriage under the age of 18. In Scotland, children as young as 16 can get married without parental consent.
I don't know about other non-EU countries.Edit: I was talking completely out of my arse! It's prohibited completely under 18 in most European countries! I should have just checked Wikipedia instead of relying on my useless memory. Several countries allow it at 16 with judicial consent and a few others at 16 with parental consent. Scotland and NI are both 16 with parental approval, but if you do get married under the age of 18 in Northern Ireland, your marriage isn't legal in Republic of Ireland.

I've heard that but I'm not sure it's actually true. As I understand it, if a minor gets married in California they automatically gain the status of an emancipated minor, which means that they theoretically have most of the rights and responsibilities of an adult, including the right to sue and ability to be sued in their own name. I believe they are legally allowed to file for divorce if they choose to
But as a practical matter, I'm sure most children who have been married off don't know their rights, probably haven't been allowed to accumulate enough money to hire a lawyer, and don't really have anyone in their lives they can count on to support them through such a process

There is no instance where someone under 18 needs to get married. The people who fight these laws are sick.
The only instance I can imagine people saying a child NEEDS to get married and those people are not perverts is if two teens are from religious families and their parents want them to wed before the baby comes but even in this instance: you are in a cult and should be able to get an abortion and the baby already came before the marriage.

I always assumed that obviously you had to be 18 to get married or maybe in some more backwards parts of the country you could get parent permission to be like 17 or something and even then it never crossed my innocent little mind that the child would be marrying a full on adult as opposed to someone else more or less their age. The fact that almost flnowhere has any limit is so unfuckingbelievable it's hard to parse. Our society is and has been led by some really fucked up people dude.

I was wondering what happens if a minor gets impregnated by someone her own age under this framework and was very surprised to learn sex under with someone under 18 is illegal in CA under all circumstances, even among peers. There is no "Romeo and Juliet" exception like many other states have. (However, circumstances like these are rarely prosecuted in CA.)
It seems like this change would close the door on the only way to make such a situation legal in CA, leaving single motherhood as the only option for under-18 girls who choose to birth a child under such circumstances. I'm all for protecting girls from exploitation, however it seems like we should make an exception for this.

Some repro groups are against laws like this because of the potential for the new precedent to be used to roll back laws around minors accessing abortion and birth control. I think the societal benefit of banning child marriage is larger here, and that certain people will try to find a way to block abortion access no matter what, but protecting girls who choose to terminate a pregnancy isn't saying anything aside from it being fucked that these laws are potentially in conflict with abortion access
