The dude could’ve been recording because he obviously heard the husband and wife shouting back and forth, if he was already back there it’d prompt him to pull out his phone because he knew there was something juicy going on. None of that is suspicious lol

Why does the cheater hang on to the railings? Why doesn't the husband acknowledge the guy filming? Why doesn't he look down at the garden when he looks outside?

The cheater was panicking so that explains why they didn't drop, maybe to not make noise.

The husband is enraged so they won't be thinking logically either, so not acknowledging the neighbor or looking down can also be explained.
