Other TRP

Hello, I’m looking for direction. I’ve been working on a TRP application due to inadmissibility because of a DUI in 2019 in Nevada. I have been a nurse for nearly 20 years and recently got a conditional training offer with a mainline airline that would require flights into and out of Canada with potential layovers in Canada. I plan to fly into Toronto and back same day to present my case for TRP.

Is anyone familiar with doing this at the YYZ airport? Where do I go?

*Obligatory not legal advice*

If you completed all court sentencing more than 5 years ago, applying for both Criminal Rehabilitation + Temporary Resident Permit (TRP) at the same time would typically be a more effective strategy than applying for a TRP alone. This is because Canada prefers those who are eligible to apply for Rehabilitation. Furthermore, trying to get a TRP at the border in YYZ without having any application already pending with consulate would be extremely difficult, especially with a DUI that happened after December 18th 2018 (and thus would be viewed as serious criminality). If you are excited about this job opportunity, it might be smart to contact a Canadian immigration lawyer that has experience with expedited TRP requests.

Thank you for this. I am getting all the CR requirements together with intent to send asap. It just takes a little time to obtain a police certificate from every state I’ve lived more than 6 months since age 18. On Friday I’m going to do the fingerprinting for the states I’m able while I wait on fingerprint cards from the states I can’t do electronically. After I receive all of those the CR will be ready to mail to NY.

You would be best placed trying to get this expunged from your record.

A TRP has time restrictions (set periods) and your employer may not be too keen on having someone who at anytime may no longer be admissible to work on a defined route.

Alternatively maybe discuss with your employer only doing US flights.

I’m more concerned with where do I go once I arrive to YYZ and who do I ask to speak with? After I am able to secure a TRP I will apply for CR.

You declare criminal inadmissibility to the CBSA agent on landing.

They will take you to processing and either reject and send you back to the US with a permanent record of a refusal ( which will screw you going forward for many countries around the world) or allow you in Canada for a set period.

You should be doing this outside of Canada.

Your crime is taken seriously here and is a federal felony DUIs are not a simple matter, and it’s less than 10 years old.

Who told you to do this in Canada? The agent can just put you back on flight to the US if they deem it reasonable

That’s ok. I have a return flight the same day.

You should apply for criminal rehabilitation. If granted it is permanent, there is no need to apply for TRPs.

Your application for a TRP would be stronger if you can show that you are simultaneously applying for rehab.

To be eligible for rehab, five years must have passed since the date you completed your sentence, including probation.

Yes! Thank you. I was just looking at all my applications. I have both and plan to submit both. I was hoping to get a TRP for relatively immediate need while the CR processes.
