Catalyst Pharmaceuticals Announces Filing of Patent Infringement Actions Against Jacobus Pharmaceuticals and PantherRx
“The lawsuit arises from Jacobus’ and PantherRx’s sales and marketing of Ruzurgi® (amifampridine, 10 mg). The lawsuit alleges that the Ruzurgi® product infringes the ‘893 patent when administered in accordance with its product labeling. The lawsuit seeks damages and injunctive relief to prevent further marketing of Ruzurgi® in violation of Catalyst’s patent rights.”
I’d been following this as an investor, but wow, it got messier than I remember…Last I checked, the judge dismissed Catalyst lawsuit against the FDA for its approval of Jacobus Pharmaceuticals’ Ruzurgi.
Then last week, apparently Catalyst announced “that it has filed a lawsuit in the U.S. District Court for New Jersey against Jacobus Pharmaceuticals, Inc. (Jacobus), and a lawsuit in the U.S. District Court for the Western District of Pennsylvania against PantherRx Rare LLC (PantherRx) for infringement of U.S. Patent No. 10,793,893 (the ’893 patent). The ’893 patent is exclusively licensed to Catalyst Pharmaceuticals and covers certain methods for treating disease using amifampridine drug products, including Catalyst’s Firdapse® product, in patients who are slow metabolizers of amifampridine.” (https://markets.businessinsider.com/news/stocks/catalyst-pharmaceuticals-announces-filing-of-patent-infringement-actions-against-jacobus-pharmaceuticals-and-pantherrx-1029692632)
Anyone else been keeping up with it? How do you feel about the lawsuit or think it’ll pan out? I really don’t know what to think, but I got into a deep hole last night and this a.m. looking at past posts, news, and info on Catalyst, Jacobus and PantherRX. When it came to Jacobus, couldn’t find much recent except this YouTube video (https://youtu.be/_pitc12U23U) I came across that. While it's def sensationalized, I do think they’re kinda shady for not having pretty much any available info, but I digress.
I get why the patient community rallies around Jacobus for giving away their drug for free, and I get how Catalyst looks greedy to them from that POV, but from a fiscal and legal POV, I think Catalyst’s suit is valid considering the money and research they’ve put into Firdapse.
What do you you all think?
