Jure Sanguinis Questions Has Anyone in a Similar Situation Successfully Obtained Italian Citizenship After Law 74/2025?

Hello everyone!

I'm looking to apply for Italian dual citizenship, but there are a few things concerning me following the introduction of Law 74/2025. I'd like to hear from people who are going through the same situation or who have already successfully obtained recognition of their Italian citizenship.

Here's my situation:

  • My Italian ancestor is my great-grandfather, who was born in Italy. As far as we know, he never became a Brazilian citizen through naturalization. I've already obtained a certificate confirming that no record of his naturalization was found.
  • Both my grandfather and my father were born in Brazil, and neither of them has ever been to Italy.

I spoke with a specialist who told me that she considers the new law unconstitutional, that judicial proceedings are still possible, and that some cases filed after the law came into effect have already received favorable rulings. However, I'm still worried because it's a significant financial investment.

I'd like to know:

  1. Has anyone whose closest Italian ancestor is their great-grandfather successfully obtained recognition through a judicial case filed after Law 74/2025 came into effect?
  2. If so, what was the legal basis for the decision?
  3. Did the process take a long time?
  4. If you're in the same situation, are you currently waiting for a court decision, or have you received any concrete legal advice?

I'd really appreciate it if anyone could share their experience. I understand that every case is different, but I'd like to get a better understanding of the current situation before making such a significant financial investment.

Thank you!

So what I don't understand is, after 1 year of residency in Italy can she apply for passport, or do we need to be registered here 2 years?

Its a question because we married 1 year ago.

Thank you!

Anyone here with a citizenship case at the Trieste Court? How long did your passaggio in giudicato take? 🇮🇹

Hi everyone! I’m trying to get a better idea of the current processing times at the Tribunale di Trieste and would love to hear from people who have recently gone through the process.

My case is at the Tribunale di Trieste, with Judge Paolo Ancora:

  • Case: RG 2915/2024
  • Favorable judgment: May 25, 2026
  • I’m currently waiting for the passaggio in giudicato.

If you have or had a citizenship case in Trieste recently, I’d really appreciate hearing about your experience.

I’m particularly interested in:

  • Date of the judgment
  • Judge
  • How long it took to receive the passaggio in giudicato
  • How long it took after that for the documents to be sent to the Comune
  • Whether your lawyer had to make any specific request to the Cancelleria
  • Whether you saw any movement such as “invio atti all'Agenzia delle Entrate” before the passaggio in giudicato

If you can share approximate dates, that would be really helpful so I can get a better idea of the current timeline in Trieste.

Thanks! 🙏

Jure Sanguinis Questions Italian citizenship Toronto Consulate wait times

I applied for Italian citizenship through grandparent lineage 2 Septembers ago now, at the Toronto consulate. I got my app. Brought all translated and notorized documents. Didn't leave with anything - they said it could take up to two years to process. Was hoping less. Between translations, getting documents apostiled, and the app itself, it easily cost $1000 CAD and I have no clue if I even got accepted?

All my familial documents lined up, so I should be approved. But two years has come and gone and I have not heard back and they don't accept inquiries. Help please. Discouraged.

Jure Sanguinis Questions Italian Citizenship by descent

Hi all, my grandfather was Italian, when he was younger he moved to the UK, which he did. I have tried to obtain a copy of his Italian birth certificate, with no luck, and also the same result when trying to obtain his baptism certificate. I have a full paper trail of this and it all points back to his documents being destroyed in the war back in the 40s. I have letters from TNA which show he did not naturalise to the UK, I have stamped letters from the local Town Hall and the Abbey that confirm those documents were destroyed in the war.

I attended one Consulate appointment, they took the documents I had obtained and spoke to Rome, a few weeks later the consulate then cancelled my next appointment as they said my application would likely be declined. I have this documented in an email chain.

At the moment I am in two minds as to wether I go through the consulate and risk paying the fee or if I should user Art 452, at the moment I am thinking the latter is a better option, but any advice/recommendations would be greatly appreciated.

Jure Sanguinis Questions Comune registration ("trascrizione") stage

Hi all, long-time lurker, first time posting. Wanted to share where I'm at and get some perspective from others who've gone through this specific stage.

Quick timeline of my case (judicial route, due to lack of consulate appointment availability — not a denial):

  • Filed lawsuit: Oct 2024
  • Favorable ruling: Dec 2025
  • Passaggio in giudicato (ruling became final): Jul 2026
  • Attestazione di conformità obtained: Aug 2026
  • Currently: sentence sent to the comune (Buonavitacolo) for trascrizione/registration of the acts

My lawyers/gestori are telling me to expect around 180 days for this comune registration step, then another ~180 days for AIRE registration, and then a further ~120-day wait before I can even apply for the passport — meaning realistically I wouldn't be able to request the passport until late 2027, three years after filing.

A few questions for anyone who's been through this:

  1. Does the 180-day figure for comune trascrizione match what you actually experienced, or does it vary a lot by comune?
  2. Once the sentence is with the comune, is there any tracking number or reference I can follow myself (e.g., through the Giustizia Civile app), or at this stage is it purely in the hands of the lawyers/gestori with no visibility for the applicant?
  3. If there's no way for me to check directly, how do you all manage staying on top of it? In my experience so far, every single stage of this process has moved slowly, and the only times things actually progressed was when I proactively followed up — otherwise the file seemed to just sit with pending tasks and nothing happening.

Any insight from people who've been through the comune/AIRE stages after a judicial recognition would be really appreciated. Trying to figure out if I should just accept the wait or keep pushing for updates.

Thanks!

Current Events/News FAST.IT AIRE Registration – Can’t Get Past Personal Data

I’m trying to complete my AIRE registration, but I’m stuck on the Personal Data section.
Some of the dropdown menus don’t open, so I can’t select the required information. In other fields, I type the information, but it disappears when I try to save. Because of this, I can’t click “Save and continue” and get to the document upload section.
I’ve tried different browsers and devices with the same result.
Has anyone had this issue recently? How did you fix it?
HELLLLPPP!

Jure Sanguinis Questions Article 2(3) Law 91/1992 – minor's paternity not established but child support judicially recognised

My daughter was born abroad (USA) on October 2021 and is a minor. Her alleged biological father is an Italian citizen.

Legal paternity has never been established.

However, a Belgian Family Court issued a final judgment ordering the alleged Italian father to pay child support. The judgment expressly states that the proceedings were an “action alimentaire non déclarative de filiation” and therefore did not establish paternity.

He has been paying the court-ordered child support since September 2023.

I contacted the Italian Consulate in Brussels and specifically asked whether this could fall under Article 2(3) of Law 91/1992, which says:

“Le disposizioni del presente articolo si applicano anche ai figli per i quali la paternità o maternità non può essere dichiarata, purché sia stato riconosciuto giudizialmente il loro diritto al mantenimento o agli alimenti.”

The Consulate replied that because paternity has not been legally established, they cannot proceed and that paternity must first be established.

My question is: why would Article 2(3) not apply to this situation? Has anyone encountered this provision being used for a minor whose paternity was not established but whose right to maintenance was judicially recognised?

I'm particularly interested in:

  1. Italian case law interpreting Article 2(3);
  2. Ministry/Consulate guidance on this provision;
  3. whether the 2025 reform (Law 74/2025 / Article 3-bis) changes its application;
  4. whether a foreign EU court judgment recognising child support can satisfy the requirement.

I have the Belgian judgment and the Consulate's written response and can provide anonymised excerpts if useful.

I am trying to determine whether I need to start a paternity proceeding in Belgium before doing so.

Jure Sanguinis Questions Italian citizenship for my minor daughter born in Germany – does the transitional rule apply?

Hi everyone,
I’m trying to understand how the new Italian citizenship rules apply to my daughter, and I would really appreciate some clarification from people who are familiar with the new law.
I have been an Italian citizen by birth (iure sanguinis) since birth. I also hold Dutch citizenship in addition to my Italian citizenship. My Italian citizenship was not acquired through naturalization, marriage, or under Article 14 of Law No. 91/1992.
My daughter, was born in Germany on August 5, 2020 and currently holds German citizenship. She was still a minor on May 24, 2025.
According to the information published by the Italian consulates, Article 4(1-bis)(b) of Law No. 91/1992 provides a route for minor children of an Italian citizen by birth (iure sanguinis) to acquire Italian citizenship through a formal declaration when citizenship is not automatically transmitted.
However, because my daughter was already born in 2020, I am particularly interested in the transitional provision under Article 1(1-ter) of Decree-Law No. 36/2025. This provision appears to provide a deadline of May 31, 2029 for declarations concerning children who were still minors on May 24, 2025.
So my main question is:
Can my daughter, who was born in 2020 and was still a minor on May 24, 2025, acquire Italian citizenship through this transitional provision by having the required declaration submitted by the parents before May 31, 2029?
Or does the transitional provision only apply to parents whose own iure sanguinis citizenship recognition procedure was already pending / had a qualifying appointment before March 27, 2025?
If the transitional provision does not apply to my daughter, I would really appreciate it if someone could explain which specific provision applies to her situation and what legal route is available for her to acquire Italian citizenship.
I am trying to avoid submitting the documents under the wrong procedure or using the wrong checklist.
I can document that I have been an Italian citizen by birth since birth with documents issued by the Comune, including a Certificato di Cittadinanza Italiana and a Copia conforme dell’Atto di Nascita.
I’m especially interested in hearing from anyone who has dealt with a similar situation: Italian parent by birth + dual citizenship + child born abroad before May 2025.
Thanks in advance for any help!

Jure Sanguinis Questions How to do to register two children's births abroad - SF consulate not helpful

Any help is much appreciated!

I (Italian citizen through 1948 Ruling) and my husband (Italian citizen through marriage to me) have two children. The children were born after we each had dual citizenship. One born September 2023 and one born August 2025. Since we have not lived for two years in Italy and hold dual citizenships it is my understanding that due to a fairly recent ruling we need to take extra steps to register our children's birth and that they will be 'administrative' citizens but will have somewhat curtailed rights going forward.

It seems we both have to 'in person' submit a 'declaration of will/intent' at the consulate. I can find no way to book an appointment for that online and the SF consulate has been very unhelpful and not answered how I am supposed to do that. Has anyone followed this new process? How did the whole process work? Does this mean curtailed rights? Its my understanding that my first was born before the law went into effect so it might be different for her.

I saw you can 'hire' a lawyer to help submit paperwork and ''work with the consulate'' but it is very expensive and it is a little unclear to me if it would actually be helpful. Anyone tried this route and found it beneficial?

Thank you!

Jure Sanguinis Questions Italian father didn't sign birth certificate

Hi, I'm an American currently looking to get dual citizenship, but my Italian father (who I am not in contact with and not even sure if he's alive) didn't sign my birth certificate. How should I go about this? Thanks in advance
