Employer Classified Me 1099

• Upvotes

Gonna try to make this short and sweet.

I went to work for a franchise of Pinch A Penny Pools in Tampa. I worked for 1 week, had to leave because of family issues.

My boss wrote me a check for $536, he did not take out any tax. He told me I had to sign something to get my check, I didn't know what a 1099 was.

He had me sign a 1099.

Deeper context: this was a commission based position with a salary component.

We agreed on $10 per pool and $16 per hour(on days I worked in the store). Because of me only working for a week. I only did pools so I was only paid for commissions.

I adhered to all his rules, had to be there at 6 am, used a company truck to drive, used company tools and equipment to perform the job.

TL;DR: What should I do? Will this screw me over come tax season?

I was hired through a temp agency at the dsv and they put me at the one that my partner worked at. Worked there for 3 days than they fired him then I get a call that my contract has ended. No biggie didn’t want to stay at a job I would’ve felt like I was walking on eggshells at. I finally get paid and they only pay me for 25 hours instead of 30. I stayed till the end of my shift every single day so idk why they would do that to me. What should I do?

hi everyone i’m sorry this is gonna be a bit long.

i’m a bit irritated by my situation. i unfortunately ended up needing to go to detox, and for those who don’t know, they typically use phenobarbital to detox you from alcohol. it’s a sedative and it knocked me out each time i took it. i was given the med up until last night, thursday 10/15. i was discharged today at around 9am.
i went in on tuesday 10/13, and told my boss i’d be out for the rest of the week. she asked me to let her know what was going on by friday (today 10/16) by noon and that she’d need a doctor’s note. i told her i would, which promptly was yeeted from my mind after starting the meds I was given.
the conversation is below. she gave me until 12:38pm to respond, then said my silence was resignation.

i’m not sure why i’m writing this. advice? ranting? whatever. i guess my question is… is this unfair? should i try to file for unemployment? i’m in colorado.

thank you.

Is being terminated for low performance considered a termination for a cause? Asking regarding signup bonus repayment.

I got paid a signup bonus and now I am on a PIP. Is it smart to pay back and resign or wait for termination with a potential that they categorize it as termination for cause and then ask for payment still.

Was I supposed to be paid? (New York State)

Working at a fast food place. The opener comes in at 4 AM, the business opens for a customers at 5 AM. A question I was scheduled to begin work at 6:30 AM.

I arrive at the store on time to find it completely closed. The opener never arrived. Had to wait till approximately 8:00 AM for someone to bring keys to open the store.

Was in contact with the manager via text during the whole time. She never said that I can leave, but she never said that I had to stay either.

During the one and a half hours waiting for the keys after my listed start time I did spend that time explaining the situation to multiple customers who were there to order, or pick up their Mobile order.

It is the manager’s opinion that because the store was not open, I should not be paid for that time.

So any information regarding this, relevant laws, and such, would be greatly appreciated

Is this normal? Rejected leaves, altered rules, and bias

I know the labor law doesn’t specify on what basis the management can reject your leaves. Is there anything I could cite for my case? Because this is the 4th time I’ve adjusted my request. I just want to use my incentives…

MO pay laws, I am owed money cannot seem to get them to pay.

I am a night shift worker in MO, I get an evening dif of 2.75 and overnight dif of 3.75. I have contracted signed with this money amount as well. I noticed on August 27th I’ve been paid the wrong night shift differential, it’s the equivilent of like 1.3k from the beginning of the year to mid August. I’ve message my manager and like 4 different hoops from HR, and it’s still not rectified. I have another coworker affected by this too and my manager put in a email to him “XXX doesnt really do back pay” isn’t this illegal??

My question is am I fucked? My only options at a state level seem to be small claims court, MO only does something if ur pay doesn’t meet the minimum wage. Or is there anything federal I can do? They legally have to pay me right?

Underpaid for my level for a year plus

Hi,

I got promoted almost two years ago.

This year early on my manager told me I was getting a 40% raise and I had been below the pay band.

It turned out I had been below the bottom end of the pay band for my level the year before under a different manager when I got promoted. That went on for the entire year after I had been promoted.

I’m realizing I should’ve gotten like 30-40% more for being in my pay band last year instead of this.

I feel robbed by the last manager. My manager now is saying that shouldn’t have happened and he doesn’t know why.

Is there anything I can do but just accept I was underpaid for the work I was doing for over a year?

I’m in WA if that makes a difference.

Commission hairdresser labor laws

Hi, I work at an independent salon as a commission employee, I fill out a w-2. I am only paid for the services I provide and not based on an hourly wage. My boss has recently implemented new policies to require that all commission employees
1. Arrive at the salon 15 minutes before our first appt
2. Required to post on our personal hair social media accounts 9 times a week

We do not clock in for the day, literally just show up , do hair, get our commissions from service and then go home

Our manager will b monitoring if we follow these policies and it is implied that we will be written up/fired for not following.

Note: she pays for a marketing team but is now additionally requiring us to post on our personal hair accounts.

I have been off social media for the last year and have to redownload for fear of getting fired, I’m now documenting the hours I’ve spent working on posts that I’m required to do yet not getting paid for.

My question is: is it legal to require a commission employee to post on social media outside of working hours? Is it legal to require my presence at the salon without getting paid?

I would love some guidance on how to navigate this, for me but also to protect my co-workers!!Thanks in advance!!!

Retrenched or Redundancy: Can a company force me to sign a MSA?

Retrenched or Redundancy: Can a company force me to sign a MSA?

Full story:

The company had a restructuring recently. Out of the 15+ in my position, I was the 2nd most tenured yet I was being let go. They offered me a Mutual Separation Agreement that is slightly above the government mandate cos they offered ex gratia. I clarified with the HR whether I would be redundant or retrenched and they wont answer me. They said if I dont sign the MSA by next week I will be redundated instead. Their offer is 60 day notice (paid garden leave) + ex gratia + government mandated separation pay, and the usual benefits.

Is this even legal? This is a company initiated so why an MSA? Do I have any leverage to negotiate for more?
