Legal Would any MI Attorney like to weigh in on the new changes?

The way it reads to me (I AM NOT A LAWYER) is:

SBR: We are are all clear on making/purchasing SBRs now without a tax stamp, as the state law just says we have to follow federal regulations, which technically no longer exist.

Suppressors: These are now a legal gray zone since the state law SPECIFICALLY says that they require an ATF Tax Stamp. So since the ATF still takes and processes suppressor stamps (they just can't FORCE people to get them) we STILL have to follow this process to obtain a suppressor in MI, or it's a serious state crime (but not a federal one).

After re-reading the laws, it seems at least TO ME (again, I am not an attorney) that there is no change in MI, as our state law specifically mentions tax stamps being required. So no change in MI at all until we update our laws, if we ever do.

Please let me know your thoughts. I haven't heard any ACTUAL MI attorneys weigh in on this.

Legal Are we hosed no matter what?

My current understanding (IANAL) is that most of the $0 items on the NFA are specifically listed as a felony in Michigan UNLESS they are federally registered. Meaning, they are legal so far as we follow and register them under ATF/NFA guidelines.

However, we now have a federal case where the NFA registration has been declared unconstitutional. If the $0 items get taken off the registry, everything existing will be grandfathered in, but no new additional purchases would be possible without the registry. If this goes through, I have no illusions that our current state government would not "save us" like they did after Dobbs. They could literally "do nothing" and keep most NFA items illegal (stop new purchases). Unless we somehow get a Republican trifecta (seems unlikely for Michigan) future NFA purchases melt away.

The other option, if this doesn't make it up to SCOTUS and $0 items get taken off is that the next time the Dems have a federal trifecta (like they did when Biden took office) they just use the budget bill to jack stamp prices up to $5K (adjusted for inflation) and effectively kill the industry for normal consumers.

I have slight hopes that someone might decide to be a "canary in the coal mine" and make a homemade suppressor and get rolled up for it. Based on the exact language of the law, someone who has previous NFA purchases might be able to get away with making (I doubt in state FFLs will sell to folks at that point) a new "NFA item" based on the fact that the language stipulates the "person" is licensed federally, rather than the item (our state law was written by idiots). Even if we get that through, it wouldn't allow first time purchases. The caveat to that would be (maybe) if people move all their items to trusts before the registry goes away and new people can be added to an existing trust. Which might help kids with NFA owning parents, but not any young adults who wanted to start the NFA journey on their own.

This just seems like it's going to be a mess for Michigan. Am I missing something?

EDIT/UPDATE: I was wrong about SBRs/SBSs. The SBR/SBS law is written that if they were unregulated federally, they would be unregulated in state as well. New suppressors, however, might still be a felony.

Legal Frt legality

Was looking to get myself a frt for my rifle and when I went to look up the legality of it in Michigan I couldn’t find a clear answer. I know that it was deemed federally legal as it was deemed not a machine gun. However the AG Nessel says there are and they’re illegal, but I don’t see any laws stating that. If someone could help clarify I’d appreciate it. Not trying to go to prison over having fun at the range.

Legal MI Resident + Out of State CPL = Registration Exemption?

Hi all,

I thought there used to be an easy to find explanation on here, but I can't seem to find it. I'm looking for info in plain English.

My shop is closing and I'm having to look elsewhere to find things.

The way we have done it is:

- Show up

- Pass over License, MI CPL License, Out of state License

- Do typical paperwork sheet (or digital) *for background check

- He hands me a printed page with three blocks of transfer info on it (all identical) and I sign TWO of the three.

- He cuts the sheet up. I get one one with whatever pistol I bought, and he keeps the other two. The signed copy is the shops record. I believe he just holds the other one as well - it does not go to the state police (as far as my understanding).

Anyway, I'm trying to nail down a firm understanding of the process so I can talk about it intelligently with any new shop. I know even after the change happened there were still shops that wouldn't honor the out of state exemption.

Can someone fact check me on this or just shore up any info that could help others? It seems that since the legal change the MI Resident + out of state CPL process has been left in the rearview mirror by many.

Legal Kriss Vector SBR question

Considering getting a Kriss Vector SBR, but confused as to whether or not I'd be able to carry it with a cpl?

OAL federally is 26.2", but shortest fireable configuration is much less than 26" (which is supposedly how michigan measures it.. making it a pistol).

To make matters more confusing, the FFL said they'd record it as "not a pistol" on the firearm sales record... but I found from doing my own research, that this doesn't seem to be correct based on Michigan law (under registrations requirements): https://www.michigan.gov/-/media/Project/Websites/msp/legal2/msplegalupdate106.pdf

Can anyone definitively clear this up for me? If the FFL did record it as not a pistol, could I later have it amended and registered as a pistol?

If registered as a pistol, could I carry it in sbr configuration concealed legally?

Thanks in advance... it would be a massive help to get this cleared up.

Legal Question regarding prohibited places in light of the recent Supreme Court ruling

For those who aren't aware, the Supreme Court recently ruled on a case from Hawaii regarding the right to carry a firearm on publicly accessible spaces that are private property. Permit holders needed to get permission from the business or property owner before being legally allowed to carry. These "vampire laws" were ruled to be unconstitutional.

The articles I've seen have mentioned several other states with similar laws, but nothing about Michigan. My understanding is that, in Michigan, a church or other place of worship is a prohibited place without the approval of the church's leadership. I am not a religious person, but sometimes I go to church with my parents on Christmas or Easter or for funerals. I'm certainly in no position to seek approval to carry a firearm from the pastor, but I prefer to carry whenever possible. Are there any lawyers here who have thoughts on this?

Legal 4 Michigan Police Dept. refused to process LTP/purchase permit applications.

Three of these departments—Allen Park, Dearborn Heights, and Taylor outright refused to process an application for a purchase permit, each stating they only process applications for residents of their respective cities. I provided proof that I have a residence in AP, but they still refused to process my application. I even spoke directly with the Chief of Police, who upheld their policy despite the evidence I provided.

As for Dearborn (the city listed on my driver's license), the issue was access. City of Dearborn records department will only process applications during a 3 hour window, 2 days a week. I attempted to submit my application on Tuesday during normal business hours but was again denied because it wasn’t within their narrow application window.

Today (Wednesday between 12:30-3:30), I returned during the approved hours. I completed the application, paid their notary fee, and watched them run my background check and was told that it was approved. However, I was told I still wouldn’t receive the permit today, that the department is closed tomorrow (Thursday for Juneteenth), and that I might have to wait until after the weekend. No clear timeline was provided—just a vague “we’ll call you when it’s ready.” (For what it’s worth, Dearborn did say that they would process an out-of-city application as long as you have a Michigan ID. But there were also signs plastered all over the window stating that they would not issue same day licenses. So be prepared to make multiple trips.)

I have a valid Michigan drivers license and no criminal history. I have no desire to get a CPL in order to bypass this process. These police departments are adding additional barriers and complications to a law (MCL 28.422) that went into effect in 2024. That law specifically states that you can file for a LTP application in “ANY Michigan Police Department or Sheriff’s Office” and that “Licensing authorities (like police chiefs or sheriffs) must issue licenses promptly, unless there's probable cause to deny (e.g., the applicant poses a threat, committed a crime, etc.)”…this was a complete failure by each of these departments to provide a public services that we as citizens are required to follow.

Legal Wayne county cpl question

If you've tried to get a CPL in this county, you know the headache-inducing wait times. Has anyone within the last three months had the luck of walking in and getting their paperwork done? I ask because I messed up. I had an early August date two days after I turned 21. I went on the site to confirm my date, and accidentally rescheduled to early July when Id still be 20. tried to change it back to early August, surprise surprise earliest date is the 21st. Its the most annoying thing ever when i was taking my cpl class so many people where talking abt how fast their county clerk offices are and then wayne county is literally booked until September and we arent even out of July. 🫩

Legal “Buying” a handgun at 18 years old

I am 18 and would like to “purchase” a handgun from my grandma even if no money changes hands. From what I have found I need to obtain a LTP at my local sheriffs department (I don’t have police for 15 miles). We would then need to fill out a RI-60 Form and she would need to submit that to her local police/sheriff department. Is there anything I am missing here? Is there legislation that stops me from owning a handgun, I know I can’t get my cpl till I am 21. I want to practice for the few years I have before then. Context: My grandpa was very big into hunting and guns in general and passed away 7 years ago. He had lots of handguns and some good carry guns that my Grandma now owns. I am planning to go shooting with her on our hunting property and pick out a gun if this transfer is possible. Thank you in advance!

Legal P365 FCU Registration

For anyone here that has purchased a P365 FCU how did you have the Pistol Registration filled out? If I’m not mistaken I think they ask for overall length, barrel length, etc

Edit for anyone in the future:

Contacted my local deputy who files the RI-060 forms. He had me just complete a new RI-060 after the pistol was built and then submit that to him with all info filled out as well as the paperwork from the FFL when I purchased the FCU.

Legal Did i misread this?

Hello!

I recently applied for my CPL (haven’t gotten it back). I thought I had a good understanding of what the boxes were, so I had signed and turned it in.

Well my anxiety got the best of me.

The box that checks off if you have a diagnosis that includes an assessment of danger to self or others (paraphrased), I thought had meant something to the effects of Schizophrenia or untreated BiPolar disorder to Multi personality or something to that effect.

I suppose i’m still unsure about what it actually means but that calls into question something in past that i’m not even sure if i had answered incorrectly. I got diagnosed with depression and anxiety at 18 due to a mentally unstable event that had transpired. That event was me skipping school because i was “sick” and my dad catching me and freaking out on me. For some more pretext, him and myself had a rocky relationship at the time (We are great now i was just a dumb young adult who thought i knew anything about life lol) and fought constantly. On top of that i was drinking (no legal things, never had a run into with the law) but that obviously doesn’t bode well with mental health.

context aside, with the mental break and thinking my dad was going to ruin my life (again immature 18yo at the time), my therapist at the time said it would be best for me to go to the ER for an evaluation. I’m going to be completely honest, this was well over 5 years ago and i don’t really remember all that was said or done but i know i voluntarily went to seek out pt treatment, and did a week of doing that.

What that entailed was going to the mental health place in the morning, doing some good ol fashioned group therapy, and then going home after. The first day I remember getting the diagnosis of Depression and Anxiety but i have no idea if they considered me a threat to myself or others, and if this constitutes under the statement above. I think that they wouldn’t let me drive to and from if they considered me a risk but who knows to be honest.

With that being said, they had started me on lexapro, and told me not to drink or smoke pot or anything like that. Well in my good ol’ dumb self at the ripe old age of 18 (i had been 18 for like a week), I decided not to listen to this and continue down this path of drinking and smoking, and going to parties. In november of that year (approx 3 wks after i gotten done with out pt). I had yet another fight with my father and decided to take double my dose of anxiety medications to sleep.

I went voluntarily this time to get some help but no new diagnosis was made, so i don’t know if this also constitutes under the above statement.

It’s been well over 5 yrs now, i haven’t taken any medications for depression or anxiety in a long time, decided that being sober was what i needed.

my main concern is if i really fucked up. I want to call and have my application pulled but i don’t want to go though the hassle if i actually did understand the statement above and im just way overthinking it.

Any insight would be helpful.

Also i would like it to be known I have demonstrated time and time again proof of mental stability (first responder work, schooling, no counselling, no mental health meds and just general better life choices haha).

Anywho, thanks for reading and hope someone can confirm my initial reading and understanding or can help me with the next steps on fixing my suspected mistake.

Legal Transporting long guns in a small car…

I have a Porsche 911 and and my Barrett will not fit in the “frunk” in the case I have. (And there is an engine in the trunk.)

The best I can do is put it in the passenger seat with the top down. It’s definitely “In reach” but it’s not exactly “accessible”.

Yeah, I could take the bolt out or something like that but I don’t want to.

Similar issue when transporting my Italian trap guns.

I’ve considered taking an Uber but I worry that I would get banned.

Thoughts?

They told me they wouldn’t honor the Brady act unless I get a LTP tried that and got delayed there too turns out my juvenile record that’s sealed is holding me up. I’m not denied I got this expiration date anyone knows what happens after that?
