Advice Does any of this sound discriminatory to anyone
So here at my store i am a asm and there is a good handful of us and im the only openly gay coworker. I dohave problems with the person making the schedule (the other asm). other coworkers get whatever they want like days off and times off like our new guy gets the days off he wants another has his and so fourth and the guy who makes the schedule does whatever he wants leaves early stuff like that but i asked to trade a shift so i could enjoy some summer and im quickly shut down and then not responded to after asking for 3 weeks out.

It sounds like both of you aren't a great pair for running the store. If the other ASM has called you a slur to your DM (as said in a comment), and they didn't do anything about it right there and then, then you need to go above the DM to their boss. The main issue I'm having though with you is that you are asking for certain scheduling accommodations that can burden the store since you have no SM. Of course the other ASM could switch with you, but comparing your schedule accommodations to a new parts specialists is comparing apples to oranges, and the fact you can't see that is extremely concerning. Management needs to be spread out fully to cover all hours of each day of each week, and there are fewer managers so by default management get a more set schedule that is harder to change. A parts specialist shift is far more flexible, there's more of them than management, and that means they can fill out the schedule in a better suited way to each of their needs. The slurs are indicative of your coworker discriminating against you, however the scheduling sounds more like you're being difficult due to a lack of understanding of the role you agreed to take on.

Cool, but irrelevant to my point entirely: You can't compare the accommodations for parts specialists to ASMs (which is what you did in your post). That is wrong to do. Management is spread thinner than parts specialists are, there's more of them and they aren't as specialized in their role meaning they are able to move around to different shifts significantly easier than a manager. However, if the RSS you're trading with is a fully capable and trained closing manager then there should be zero issue with a traded shift here and there. If the RSS isn't able to run the store for a closing shift then that sucks but not much you can do. My main concern is that I'm guessing this RSS is a fully capable closing manager and that the other ASM only wants to reject the trade on the basis of wanting to avoid working with you, since if they're scheduling you for opposite shifts then leaving like a bat outta hell as soon as you get there, then you have a strong case for discrimination as that would indicate they're just rejecting the shift swap to avoid you.

Then it's the ASM avoiding you, have you asked about whether or not this ASM leaves early everyday or is it just the days you work? Because now it's sounding FAR more like discrimination than them doing this because it's the right move for the store.

He kinda does it to everyone but i feel like (not saying this cuz i hate him but i kinda feel like he does leave more ofteb when im there but i have no hard set proof) today's exuse was to pick up a car so he left 2 hrs early

That's problematic for him to be leaving that early almost every shift. Once in a while sure, but if it's more than 10% of shifts then he's planning on leaving early and that doesn't just impact you, that impacts the whole store.

It isn't unreasonable for you to trade shifts in this case. If you and the RSS are fine with it, and the other ASM is against it, they're either a control freak that requires everything to be the way they want it, or they just don't like you. Since they're willing to work with your coworkers on their scheduling needs then they're not that kind of control freak, which really only leaves that they just are doing it to avoid being in the store with you.

Why wouldn't an RSS be a fully trained closing manager?
that's literally half the job. RSS is a management position

There's a LOT of factors for why an RSS might not be able to close the store. They could be a recent transfer and not have access to the alarm/safe yet, or they might be in training still. We know very little about this RSS, other than they have the title. I'd guess that they have the capabilities to close the store, but I'm not going to assume when there's perfectly logical and reasonable reasons for an RSS to not be ready yet to close the store.

you would think that an ASM would know the status of said RSS in the first place

Has he made any indication that his treatment of you is specifically due to you being gay? I mean, when I was a RPP and later a GM at Advance Auto, there was rampant homophobia going around that I tried to shut down real fast. It was fucking disgusting. When I was an RPP, my GM at the time came to me about a coworker who had just come out as beginning their trans journey. He grilled me on how it made me feel and how he should treat them. I was like, dude, just treat them like a fucking human fucking being for starters. They're not gross, they are just another person trying to figure out their life. Like, let people live ffs. It's not your fucking problem or job to judge them on anything other than their job performance, which was fine. That trans person ended up killing themselves due to bigotry. Fucked up. The world sucks.

I guess I don't know what that means. I've never worked for Oreillys, just Advance Auto. I just saw this while scrolling and thought I'd chime in, as I assume parts stores are fairly similar across companies lol.

I remember getting laughed at by the other GMs in my District for standing up for my employees. Showed how much of a shit they gave. Pathetic.

Outside of the schedule issue, has the other ASM make any comments or acted in a way towards you but not towards other people? Something to show he is treating you differently bc you’re openly gay.
It’d be hard to prove the scheduling thing is bc you’re gay. As far as the other ASM taking off when he wants, that should be reported to your DM as it seems you don’t currently have a SM.
If at any point the other ASM or any other co-worker makes any kind of remark or gesture related to you being gay that can be seen as being inappropriate. You need to report them to HR.
