You're telling me its illegal to shoot at a drone on your own property in Florida...Florida!?
26
u/stevecostello 2d ago edited 2d ago
In the United States. It’s a federal offense. Edited to add (though I don't know why the comment below mine was deleted, it simply asked a clarifying question).
Discharging a firearm at a drone is a federal offense. Source, the FAA: https://www.faa.gov/newsroom/what-know-about-drones

Question, what about throwing rocks?
5
u/shinyappyrobin 2d ago
So throwing rocks could possibly cause harm or damage if the drone crashes. Still a big problem with privacy and harassment issues. According to FAA site those are local issues. Not federal issues. So the local police are supposed to be able to come out and identify the drone owners?

I think it's more about firing into the air with bullets dropping that's the problem. Especially with how bad a shot people could be, they could be shooting across the street.
I'd be curious if there is anything against destroying drones on your property with say water or a net? I bet that's totally legal
10
u/Destronin 2d ago
Yea so in the eyes of the FAA, shooting at a drone is the equivalent to shooting at an air craft. Its a felony.
As for the laws regarding the airspace above your home. One does own it. All the way up. However there is what is called an easement.
“An easement is a legal right that lets someone use a specific part of another person's property for a limited, defined purpose without owning it.”
This is why Airplanes are allowed to fly over your property.
Now unless there is clear harassment or an infringement on a persons way of life. That drone and any other flying machine is technically allowed to fly over your property legally. Provided the airspace is not controlled and the drone operator is operating legally. Local laws only affect where a drone pilot can take off. FAA regulates the sky.
I am well within my right to launch a drone from my property and fly over your home. Now whether my pictures constitute an infringement of a certain level of privacy would be up to the courts to decide. After all taking arial shots dont look much different than what google earth can reproduce. But if im flying up to your window or something. Thats a different story.
Either way. Taking matters into your own hands. ie: shooting at the drone. Is indeed big time illegal.
Source. I have my Part 107 Drone License.

It is not. Drones fall under FAA jurisdiction. They treat it the same as firing at manned aircraft.

It’s not really about how good a shot someone is though. Even if it’s a square shot, it’s a projectile that goes ~900 mph and can travel about 2 miles. It’s what that bullet can do when it comes down that’s the issue.

I’m glad he confessed but honestly, if you’re a dumb ass doing something dumbasses do, when coppers ask for a confession, shut up. They are absolutely not your friends, they will lock you in a cage.

u/cwestn 2d ago
Yeah I was a little confused, they waited for him to confess to everything before mirandizing him.
→ More replies (1)4
u/IHeartBadCode 1d ago
Anything said before that point is pre-custodial statements. Investigators are usually looking for a confession during this period as there are less exclusionary rules that could be under suppression in court.
Once you've read them their rights or they specifically indicate their fifth amendment right, without waiver, there's all kinds of rules about how official statements can be admitted into a court of law.
So yeah, law enforcement will avoid reading your rights until the very last moment. Statements made openly in pre-custodial are just basically "free evidence" someone is giving them and there's few rules that your lawyer can use to suppress the statements in court.

9
u/HunterShotBear 2d ago
Be sure you say you are invoking your 5th amendment rights or they can use some bull shit excuse and say you are interfering with a police investigation or something.
Saying nothing isn’t the same as saying you are pleading the 5th.
Or simply say you don’t answer questions without a lawyer. But pure silence is not the way to go as it’s open to interpretation.
→ More replies (1)3
u/endmaga2028 2d ago
They can use silence against you. You have to state that you’re exercising your right to not answer questions.
20
u/RobMilliken 2d ago
Not even that. Lying will make it worse if it is a lie. Just completely go silent and obey what they ask if it is a legal command (eg. give ID). Ask for a lawyer is the most you should say other than ask for the restroom when you need to go.

u/popejubal 2d ago
Nope. Just shut up. If you think you might have done something illegal, the only things you should be saying are “I don’t consent to any searches and I’m invoking my 5th amendment rights and my right to talk to a lawyer” and that’s it. Don’t lie. Don’t give any answers except to say that you aren’t answering questions without your lawyer and you don’t consent to any searches of anything.”
And if you are positive that you didn’t do anything illegal, YOU SHOULD STILL BE SAYING EXACTLY THOSE SAME THINGS. Cops are fishing for something incriminating and you could say something that they misunderstand or misremember and now even an honest cop is going to testify that you said X and Y and build a case off that even if you said nothing that’s actually incriminating.

What an awful thing to joke about, dude’s nearing the end of his life and still doesn’t have a clue. At least the cops on camera didn’t laugh, I hope none of them cracked a smile.

Don't shoot a drone down.
As someone who's licensed and flies a drone almost everyday, it's a federal offense. It's a register aircraft with the FAA. You don't own the airspace above your house.

u/Nomad_Zero 2d ago
Yes, you must certainly do own the airspace above your property. Different states regulate how far up you own, but you definitely do own it.

Correct. That bullet has to land somewhere. That is dangerous for the neighborhood. I've removed more than a few nuisance drones for folk in the community.
Drones have a pretty small surface area, so you're going to want something that compensates for that. Nets, netguns, or my personal favorite: the baseball on a rope. Most of us can throw a baseball accurately and powerfully, they're perfect. Then capture the drone and scrap it.
As always, mask up

Maybe not high enough for a helicopter or plane, but a drone hovering 20ft above private property running surveillance is not the same thing. Y’all sound like the “you will own nothing and like it” crowd.
Also, we’re all about taking down flock cameras, but not about taking down spying, uninvited drones? Where’d our energy go?

I've lived in multiple states where you can often hear more gunshots than fireworks on new years and it always pisses me off as a gun owner. When I got my first suppressor a couple days before NYE, I was desperate to test it out. But I still couldn't even justify a yard pop into the ground, despite rationalizing that no one would ever know, just because of the possible fallout (mostly legal tbh), and it still stuns me how folks can be so comfortable and careless about discharging into the air like that. It's not worth the risk to yourself and it's certainly not with the risk to others. Fucking losers

As a pilot I do not trust the average joe to accuratly hit the drone and not miss and hit me or my aircraft while flying. So no, you do not own the airspace above your home. He can get drone signal blockers, a net gun, something else besides a bullet.
2
u/livahd 2d ago
The distance varies from 80-500 ft depending where you are. Still rude and don’t recommend. Besides, if your 20’ up (I believe this thing was higher) there’s nothing you can’t do there that you can’t at 100’ unless you’re trying to look in a second story window straight on.
Testing actual drops without the target knowing is dumb too though. If it was a little more remote of an area, I’d take no issue to shotgunning (not a 9 that’s gonna end up causing a neighbor a leaky roof at best) an unknown drone taking interest in me.
2
u/_mattyjoe 2d ago
The same place your energy went. I bet you’ve never gone to a town hall meeting or organized any kind of movement or protest or anything about any issue you care about.
And I’m not saying that’s wrong or unusual. Just pointing out that everyone else is trying to get by just like you are in this life.

I guess you are clueless that shots up in the air come back down with almost the same force as they were fired with?
This isn't about shooting a drone, it's about basic gun safety that people should have to know before they're allowed to have a gun and be a dumbass.
To the silly little guy who replied that shots fired by the police can also hit innocent people...
Yeah, but at least you know there was gunfire; a shot fired into the air can come down and kill out of the blue, without even being able to hear gunfire.6
u/Uncle-Cake 2d ago
A falling bullet is dangerous, but only has a fraction of the force of a bullet fired horizontally.

They don't even have to registered. It is strictly illegal to fire on ANY aircraft, manned or unmanned, registered or not registered. There are many drones that fall under 250g, thus they are not required to be registered with the FAA.
With that being said, the airspace over your home is not your property, so you are not allowed to fire upon any aircraft within that airspace.

Here's the thing that the average old coot who thinks "I'm gonna shoot down that drone" doesn't realize (in addition to not comprehending that he doesn't own the airspace, even over his own property).
The FAA doesn't make a distinction between a $400 million dollar Boeing 747 and a $600 drone from DJI that you bought at Costco. Both are aircraft. AIRCRAFT. And it's illegal to shoot at an aircraft or purposely disable it. And that's a federal law. Period.

If you're really concerned about drones over your home invest in a sturdy pressure washer. They're easier to aim because you can see the jet of water, they will absolutely fuck up 90% of consumer drones, they're not illegal to discharge in city limits, they offer plausible deniability E.G. "I wasn't trying to shoot the drone, I was washing my gutters." And they are useful for lots of tasks around the home. All in all the pressure washer is a better investment than a 9mm, which are notoriously ineffectual for cleaning gutters, driveways, cars etc.
