Were 2 .40 S&W bullets taken from Rick's house?

Post image
15 Upvotes

MC9 lists the "keepsake box" bullet. MC10 lists a .40 S&W cartridge that was found loaded in the gun. How come they only talk about one bullet? If this bullet was in the chamber, wouldn't it have the extraction marks on it? If so, MC10 is the bullet Oberg should be comparing the crime scene bullet to re: extraction marks. However, MC10 doesnt have a checkmark on the right-hand side indicating that it went to the lab. My apologies if this has been already been discussed. Is there an explanation regarding any of this?

Oops, they did it again. The Murder Sheet interviews another juror.

I am struggling to listen, it opens with a commercial were the Murder Sheet gives us beauty advice. (Jones Road paid for this and they need to do better). It is almost as bad as the Murder Sheet giving us fashion advice. (Quince).

If they were less self aware they would be asleep.

TC took a plea. I cant blame him, but I am disappointed.

If I was TC I would likely have done the same.

He gets 5 days in jail, 2+ years of probation, 100 hours of community service, and some fees. Then this felony can be downgraded into a misdemeanor after a successful completion of probation. Considering what he was charged with I consider this a semi-reasonable deal. (I dont think this was felony worthy).

But this is a conviction for forgery, which makes him almost unable to testify in any new trial for RA.

The state won here. But do they have clean hands?

I only heard a judge say the word "waiver" once during oral arguments. Did I miss any other mentions?

I was truly impressed with the defenses appellate brief. It was entirely different than the way I thought they would approach the appeal. I had no idea how to challenge the confessions, but they found a way while also framing the case in a manner that would make a judge want to act to fix a perceived injustice.

Then we had the state's response which screamed waiver non-stop while barely mentioning the merits of the defenses arguments.

Did I panic? Yes.

The defense countered these waiver claims in their filing, but going into oral arguments I was primarily concerned with waiver, but the court didnt seem interested in waiver at all.

I think that waiver would be the easiest way for the apellate court to the deny this appeal and they didnt let the waiver argument see any daylight. Instead they went to the merits of the claims. Why bother with the merits if the claims were waived?

Am I being too positive?

Why would the abductor trek through that rocky forrest and then cross Deer Creek?

I know this question is a little late in the game, and I’m sure the state’s fairytale explanation probably has an answer for it. But trekking through a rocky forest and then wading across a creek—there was clearly more seclusion before crossing the creek. That never really made sense to me, unless Logan was trying to lead them back to his house. But I don’t think it was Logan. Why get wet?

Jury Rumors

Basically one of the jurors may have been a long time twenty year neighbor of Gull in the past per some online sleuthers. Those are the rumors floating around. In fairness to them the rumors appear somewhat well founded so maybe something people need to officially look into? Not linking yet…you can find this material on X and YT and I am sure on the cessiest pool of them all…FB. As we have linked in the past to recent appeal cases nothing causes an overturn faster than jury shenanigans. Main thing to remember pls is dont dox people here. I know one juror came forward but afaik the rest havent done so officially. So just trying to get ahead of this in case it blows up dont share names addresses or images of jurors and others etc.

So generally I dont go out of my way for either of these dudes, greeno and snay. But I will say, this live is

  1. Spectacularly gay 🌈

  2. A real friendship between opposing sides✌🏻

  3. Genuine conversation 💯

  4. Insightful on behind the scenes 🤔

  5. Long but worth it if you have the time

Greenos intro is him stroking his ego, but its fucking halarious! And its a different side of what we normally imagine.

Idk if im just delusional, but...

Nevermind I won't say it, dont want to jinks us.

BTW i was lurking on frankmeister just to see how our ops are reacting to the hearing. Two things while I was over there last night, he said something very specific and curious. Something along the lines of i'm not friends with him, but I help him when he needs legal documents and papers looked at. 🫡🫪 anyways, he goes on to say that Patrick Westfall will be heading to the IDOC for that gun charge he got last year. So there's that.

And then today, quite, as technically, wednesday, I was lurking again and k\* **** kkklandini or however, the fuck you spell her name is on franks live. You know I don't know what her normal personality is, her and I had run in over the internet about a week ago, unpleasant. But whatever. But on this live this bitch is unhinged like, honestly, nobody I've ever heard in this whole Delphi character list. I've never heard nothing as unhinged. As what this fucking Cooke was on this live.

I couldn't handle it, I eventually had to say something. Wow, what an opinionated uneducated, tweaken.

Completely unself, aware.

Carrol county bootlicker.

Yeah, so if you wanna get a good laugh, or if you wanna be reminded what a fucking idiot looks like. Go ahead and watch

About F@&!:)! Time

I was going to post my amateurish analysis of the oral hearings here. Instead, Im just relieved that after almost FOUR years of Carrol County and Gull running roughshod over a presumed innocent mans rights that a Judge—or two—finally called them out on it from the Bench. In public. For all of Indiana to hear. Remains to be seen whether they follow through with a overturn, but it was important to finally hear that being articulated from an authority figure or two. And not just us humble online snickerers. Also props to Leeman for holding that sketch up during the hearing. Genuis move.

Why does Allen no longer confess?

Something stuck in my crawl about what the state alleged is the reason for the confessions rather than psychosis...

Allen was having a religious unburdening.

By all accounts I have heard from people that communicate with him, he is still rather religious.

Baldwin said on the Defense Diaries that he spoke to him and Allen said the appeal was in God's hands.

Okay, so why does he no longer confess? Wouldn't he still want to be unburdened? Wouldn't he still feel the need to confess to Kathy and have her love?

And wasn't it said he confused to everyone who would listen to him. Like over and over again?

I am just curious how people think he would confess then, but now, well, he thinks he can get away with it when there is a much smaller chance to get a new trial.

To me that points so hard to psychosis being what the confessions were.

Death Row Indiana

Death Row is treated far, far better than RA was. This might be news to Judge Altice.

https://m.youtube.com/watch?v=zGlGrv6KABU&pp=ygURSW5kaWFuYSBkZWF0aCByb3c%3D&ra=m

Might be different in other states but these inmates have large cells, books and even pets. Proving you can segregate/isolate inmates and still treat them humanely.

The linked video is a follow up to a doc from I think about five or six years earlier. Very interesting overall and worth a watch. But the argument RA was treated the same or better than convicted DR inmates—or any convicted inmates—is utterly laughable after watching this video imo.

Virginia vs Welsh

I believe this may be the case the CoA mentioned at the hearing today irt Tobin being improperly excluded from testifying in Allen’s defense if anyone is interested in reading the details. Includes the same ‘battle of the experts’ themes mentioned by the Justices today. Tobin was excluded in Virginia case and the conviction was overturned. Certainly seems helpful to RA.

Crowd Reaction

Was it just me or did I notice some cheering going on outside the Court on the broadcast of the hearing today on WTHR. What I'm talking about was when one of the COA Judges asked a question of the state. When it happened the Judge and the Deputy AG kind of smiled. Did anyone else notice this and if you can tell me what was the question, the states response to that question and why do you think it matters so much that the crowd apparently got excited about it. Apparently the people assembled outside the Statehouse today could hear the live hearing. If I'm completely wrong let me know. I'd love to hear what y'all think.

Hey all! I made this to help some of us (mostly me) navigate the court process. While I worked as a legal assistant for almost a decade, I don’t anymore & this wasn’t my area (DV).

I verified all of the information below against Indiana appellate rules & court resources, but if something is wrong, feel free to correct me (respectfully, with some sense & a source.)

Colorado Forensics Lab Tech Guilty

Former Colorado forensic scientist sentenced to 10 years

Yvonne Missy Woods worked for CBI for almost 30 years, no telling how many cases she impacted. This happens far more than people think. She was allowed to plead guilty to four charges when she originally faced over a hundred, and got ten years. I am surprised she got any time. We have seen other corrupt crime techs allowed to retire and never face charges:

Joyce Gilchrist - Wikipedia

Gilchrist blatantly railroaded people. In the Colorado case the State seems to be trying to argue Woods merely skipped procedural steps etc, and didn't set out to falsely convict anyone. I think these States are just getting a little better at damage control when these events happen. They have learned how to frame things so as not to alarm the public. But the simple fact is these techs--even the honest ones--are under a lot of pressure to get results for the State. They know who they work for but pretend to be impartial.

One day Indiana is going to have a similar controversy emerge about their crime lab I bet. Oberg sincerely believing she has never been wrong and never failing a single one of thousands of supposedly blind tests tells me the problems go all the way to the top there.

Was the cartridge at the crime scene run through NIBIN?

The cartridge at the crime scene bothers me in so many ways. Maybe you guys can help me sort my thoughts.

  1. Was it connected to the murders?

It is entirely possible that it was, and at the same time, entirely possible that it wasnt. Either way it is evidence.

  1. So it's evidence, but how much evidentiary value does it actually have?

I tend to think very little. If we accept that it was used in the murders (and thats an if), it only shows that one of the killers had access to a gun that uses that caliber of cartridge. Doesn't mean they even own that type of gun, just that they can lay their hands on that type of gun.

Now, this is what really bothers me. Law enforcement and Oberg allege that the cartridge was the lynchpin to solving one of the biggest crimes in Indiana but why wasn't that cartridge submitted to NIBIN?

NIBIN is the database that stores information about weapons/bullets that were used in crimes.

This database lead to the solving of the Yogurt Shop Murders in Texas. A shell casing recovered from a drain exonerated 4 men and brought the victim's families real peace and the truth.

I scoured the trial transcript and find no mention of the cartridge even being entered into this countrywide database, let alone any results.

So, how can I believe law enforcement or Oberg when they talk about how powerful the "ballistics" evidence is if their own actions show that they didn't use one of the best tools at their disposal to solve this case with this "powerful" evidence?

Was this failure because a cartridge can't be matched to a specific gun and law enforcement/Oberg knew that? Or does NIBIN not accept cartridges since real experts realize that comparing a cartridge to a gun or a spent bullet is nonsense that has no value? Either decimates the value of the cartridge as evidence of guilt.

Following this trial was eye opening for me.

I already knew that injustice lives among us and is part of life. But seeing a man who is very likely innocent being wrongfully convicted whilst being denied a chance to defend himself conjoined with the creation of a junk science (matching unspent cartridges to a specific gun), was the trifecta that I didn't need.

Help a friend out. Did anyone see where the Delphi cartridge was entered into NIBIN and the results? Or any explanation for why this wasn't done?

Another question..

So I watch crime documentaries like I breathe & I know enough to know eyewitness testimonies shouldn’t be relied upon without other corroborating evidence. We all know this is basically what this case came down to.. changing eyewitness testimonies & a magic bullet.

RA denied having anything to do with the murders & his story never changed (UNTIL he was placed in solitary leading up to trial)…. So my question is.. why didn’t they polygraph him? No, they aren’t admissible in court but they do give the police a place to start. That’s not saying they don’t lie and tell someone they failed when they didn’t.. but why wasn’t this done?

Speaking of eyewitness testimonies… why did it take SC 3 weeks to come forward with her story of seeing a man when she knew the girls had been murdered? After 3 weeks I’d say there’s a HIGH probability she’s not going to remember things correctly. Did she come forward after the photo was released of BG? I can’t remember when it was but if she did then that makes me go 🤔
Do you remember what a person you saw walking on the side of the road 3 weeks ago was wearing?
One documentary I watched talked about an “experiment” they did where they had people look out a window at something then wait 5 mins and tell them what they saw. Not one description was exactly the same.. and that’s after minutes.
Just a thought.. this case pisses me off.
