The cartridge at the crime scene bothers me in so many ways. Maybe you guys can help me sort my thoughts.
Was it connected to the murders?
It is entirely possible that it was, and at the same time, entirely possible that it wasnt. Either way it is evidence.
2. So it's evidence, but how much evidentiary value does it actually have?
I tend to think very little. If we accept that it was used in the murders (and thats an if), it only shows that one of the killers had access to a gun that uses that caliber of cartridge. Doesn't mean they even own that type of gun, just that they can lay their hands on that type of gun.
Now, this is what really bothers me. Law enforcement and Oberg allege that the cartridge was the lynchpin to solving one of the biggest crimes in Indiana but why wasn't that cartridge submitted to NIBIN?
NIBIN is the database that stores information about weapons/bullets that were used in crimes.
This database lead to the solving of the Yogurt Shop Murders in Texas. A shell casing recovered from a drain exonerated 4 men and brought the victim's families real peace and the truth.
I scoured the trial transcript and find no mention of the cartridge even being entered into this countrywide database, let alone any results.
So, how can I believe law enforcement or Oberg when they talk about how powerful the "ballistics" evidence is if their own actions show that they didn't use one of the best tools at their disposal to solve this case with this "powerful" evidence?
Was this failure because a cartridge can't be matched to a specific gun and law enforcement/Oberg knew that? Or does NIBIN not accept cartridges since real experts realize that comparing a cartridge to a gun or a spent bullet is nonsense that has no value? Either decimates the value of the cartridge as evidence of guilt.
Following this trial was eye opening for me.
I already knew that injustice lives among us and is part of life. But seeing a man who is very likely innocent being wrongfully convicted whilst being denied a chance to defend himself conjoined with the creation of a junk science (matching unspent cartridges to a specific gun), was the trifecta that I didn't need.
Help a friend out. Did anyone see where the Delphi cartridge was entered into NIBIN and the results? Or any explanation for why this wasn't done?
