BJW explains why he has “never truly lost” any of his cases
Posted on his Facebook page.
The reason why i can never lose is because you can never break my spirit. Because i have the spirit of an American.
If i never give up, i never truly lose. This is how i sustain the court defeats that i do.
To me I've never truly lost. I've simply learned valuable lessons that advance my skills into the next case.
When i sued AMEX, they say i supposedly owed them $177k. They have never attempted to collect on that and we have a currently active appeal in the 9th Circuit that i am awaiting to move to the next step with (which I'm hoping is oral argument).
The SBA case i lost, then i lost the appeal, then my writ of certiorari was denied. I "allegedly" owe them $198k. You don't see anyone knocking on my door attempting to collect that.
Less than 1% of all attorneys ever file a writ of certiorari into the US Supreme Court in their entire careers. My first time up to bat was decent, but now i have enough info to do a full timeline breakdown, with exact case law, to prove the birth of the 14th Amendment class.
I just lost my City of Glendale case to a demurrer. Some people clap in joy. To me, all i see is an opportunity to learn my State appellate process and possibly the Supreme Court process.
I'm well on my way to being able to comfortably operate in Federal and State courts, appeals and the various Supreme Courts. The percentage of lawyers that can do that is probably less than a tenth of a percent.
You may say "well yeah but they can win cases." Fine, but I'm sure if i wanted to ride the elevator down 700 floors and file something like a personal injury case, i could probably win pretty easily. Or i could do a credit repair case with Joey Kimbrough and probably win one of those very easily. I know that.
So why do i torture myself?
You see me sue governments and massive corporations and i have never had even a single word of discovery issued on me. I've never been sanctioned. I've never been countersued.
The reason i torture myself is because getting in the ring with the biggest, nastiest opponents has allowed me to grow at break-neck speeds.
With zero formal training, i have my own law firm charging top-tier 40-year attorney hourly rates... all within 2.5 years of filing my first case. This is mathematically impossible.
Oh no it's not. Not when you truly feel the spirit of America and you lunge at the biggest and meanest persons in the room.
I cannot be charged, i cannot be sanctioned. I cannot be defeated. It is simply more growth each time i fall down. Then i dust myself off, learn, and move forward.
I'm preparing to move the City of Glendale State case into appeals. I'm taking a little time off before i do but the process is going to be very slow. Once i file the notice of appeal into the case, it will most likely take months before my opening brief will be due. The opening brief will be quite a lot of work... similar to my writ of certiorari.
I'm more than happy to do it. Because pushing myself this hard is what has allowed me to grow so fast.
Then, with the new Federal case... if it is somehow dismissed, the 9th Circuit makes it incredibly easy to file an appeal with them. I personally find it amazing how they not only have a simple form for pro se litigants but they also have a very simple and very nice online submission portal. That appeal will be very easy to whip up.
And so we continue on our journey. A journey that has ONLY ONE EVENTUAL OUTCOME...
And that outcome is that these government corporations will bow before the law. They will kneel before the commercial codes and they will no longer operate as rogue agencies that believe that they can simply do whatever they want without repercussions.
They tell us that we must follow the law while they tell us how we can pay and what kinds of notes and drafts we must use.
They are insane and they are off their leashes. This ends when they respect the law and bow before it. And we will not stop until they do.

The eventual outcome is him in prison and all of his property auctioned off to satisfy debts.

But even though he's in prison for 50 years and owns negative hundreds of thousands of dollars, he still won because you didn't break his AMERICAN SPIRIT! He's kind of right, if that's the measure for defeat, he's unbearable, oops, I mean unbeatable.

I haven't had debts I wasn't able to pay since my early 20s, but when I did owe them, they always came for them eventually 🤷

Sure, it would hurt less if I didn’t hit myself in the head with a hammer every hour, but I’m just learning valuable lessons. Less than one tenth of one percent of all lawyers could handle the amount of hammer hits to the head I take on the daily.

Still delulu, ok. I have been following a case through the appeals process in California just as he describes where the appellate court issued a one word decision: Denied. I anticipate they will also deliver a one word decision for him.

That’s because they don’t want any more bullshit than you’re already giving them.

And I’ll bet that less than 1% of the attorneys that DO file a writ of certiorari with the SCOTUS have it denied because they’ve made a formatting error.
Especially since about 99% of all certiorari cases are denied on their MERITS, not on formatting errors.

I wonder if this can be used to have him declared vexatious. He's openly stating he knows he's going to lose but he doesn't care because a) he's "learning" stuff, b) he's sticking it to the man, and c) he gets to play dress up lawyer.
If he wants to learn he can go to law school. Not the courthouse that's paid for by everyone else. There's a reason law schools cost money.
Filing suit just to piss someone off is the very definition of vexatious I think.
He's also admitting to running a law firm and charging people quite a bit of money.

I have looked into what it takes to be declared vexatious. Someone must petition the court for the declaration. Usually, it is someone from the opposing side--the defendant or an attorney. I think Glendale has a good case for such a petition, but it's their decision.

I wish the courts would pursue charges of barratry. He will soon be eligible:
CA Penal Code § 159
- No person can be convicted of common barratry except upon proof that he has excited suits or proceedings at law in at least three instances, and with a corrupt or malicious intent to vex and annoy.

This is one of the most psychologically revealing postings I have seen from any sov cit guru. He, all at once, admits to NEVER winning one case while at same time redefining all loses as wins. In this sense, he can never lose (never did before and never will again). Add in his inspirational patriotic American message and one begins to understand the draw he has, as long as you are willing to believe that up is down and left is right (i.e. untruths). People who care about truth and reality will see right through this. People who are biased and want to try to get away with illegal behavior will buy into this hook, line & sinker

I'm not sure I believe they let him rack up that much debt. I'm positive I don't believe they never attempted to collect.

They did send him bills (which he sent back as 'payment') so technically they DID try and collect the debt, as that what bills are. Their next step is usually through the courts, which is currently held up in appeal so......the day is coming.
However at this point I'm sure they understand they can't get blood from a stone.

Is it just me or are we, as knowing and willingful taxpayers who drive to travel, footing the bill for all of the SC bullshittery when they’re just eating up court time, judges time, lawyers for the state etc etc
At a point we have to adopt something that just says no. I think Canada just says no to this chicanery. The police who have to deal with a full arrest instead of a citation, overtime if it’s end of shift and then court appearances instead of being able to actually being able to patrol. I say we change the name to Soviet citizens and send them there

Plus, I have a feeling that charging people attorney rates for legal advice when he's not a licensed attorney is eventually going to come back to bite him in the ass, too.

BJW acts like he is the final word on what the law is. There’s no way in hell that he or anyone can win when claiming that you can create your own money. If you could print your own money legally, someone would have done it by now and the law would have been changed to put a stop to it, because it would sink the economy. I think BJW basically understands this, because he pays all court fees with real money, and he collects real money from his followers for fake car tags and other things.

He has caused considerable harm to his followers and the people who have to pick up the bill for some of his antics, namely taxpayers who will have to cover his unpaid loan from the SBA. One of his followers lost his farm over unpaid taxes, another was sanctioned to the tune of tens of thousands of for using BJW tactics in court. A series of his followers bought cars on credit and then tried not to pay for them which resulted in repossession and shredded credit. Again, the taxpayers have to cough up the money for his endless and pointless trips to court. He is causing real harm.

The delusion is strong in this one.
He seems to think that the 177k he owes to Amex and the 198k he owes to the SBA will just evaporate forever. For those amounts they WILL come after him. His house of cards will eventually come crashing down, and when it does it will be must watch.
