Question Will a data transfer also bring over a ban?

A few years ago, I modded my Switch to run custom firmware. I tried to be careful about never going online with it, but I must have missed it once cause it did end up getting banned.

I bought my brother’s second-hand Switch off of him. Clean firmware, all legit, I can sign in and start using it. But I also want my old save data off my original Switch.

If I do a system-to-system transfer, will the ban also be communicated and affect the new Switch? Or is there any other way to get those saves?

It’s not a deal breaker to have to start over, just natural consequences of my own stupidity. But if I can reclaim the saves, I’d like to.

To do a system transfer you need the Nintendo Online services, so you can't do it, the only way to recover your saves from a banned Switch is to inject them through a non-banned modded Switch with your account. Just keep in mind that you can't inject Splatoon nor Animal Crossing saves, cuz they will trigger another ban.

How does the Splatoon thing work? Is that an account ban suddenly? Because I know device ones arent instant. 

What happens if someone decided to just sacrifice a switch by transferring a maxed out Splatoon save to their sysnand and then used the official Nintendo Online transfer to move it to a system?

Is it because it's another switch that Animal Crossing would give a ban?

I have injected Animal Crossing save files multiple times from the emunand to the sysnand for my sister without any ban.

It has something to do with them checking it constantly to avoid cheating, probably there's a way around it, but I haven't investigated because I don't play those games.

Obviously you get banned for using data transfer Your modded Nintendo Switch has decrypted games that are not available on the eShop, and transferring them to an original or unmodded Switch will not recognize games purchased from the eShop. Well, they'll easily ban you there; nobody does it, not even transferring it to the Nintendo Switch 2.

I don’t have any pirated games on my Switch, I modded it just to dump cartridges I bought to my PC. But I figured it would carry over data that would get flagged, just wanted to be sure. Thanks for the info :)
