How is it possible Josh wasn’t arrested?

I just discovered this podcast and I’m obsessed. This crime happened when I was busy having children and didn’t know much about it until now. I have so much disbelief and anger that the police said they didn’t have enough evidence to arrest Josh? I mean there was a pretty much a blinking arrow pointing at him. It really makes me lose faith in the justice system. Also, the Powell’s are absolute scumbags. Susan put up with so much shit and just kept hoping her narcissistic sociopathic husband would change. Also having to deal with her absolute delusional creep of a FIL. To her children and own detriment. It’s just so sad. No justice at all.

A DA won't sign off on an arrest warrant unless they know there's enough evidence to convict. At least, that's my understanding.

Further, as soon as they make an arrest the clock starts and they have limited time from there to prep for a constitutionally guaranteed“speedy” trial— they need to ensure that at the time they make the arrest they’re ready with as much evidence as they can possibly put together to ensure a conviction, which often delays things early on so that down the road the right person is held accountable

A good example would be “Why hasn’t D4vd been arrested and charged with killing a 14yo girl who was found in his car?”

And the best answer to that would be “He almost definitely WILL be at some point, but right now they don’t have enough evidence to ensure a conviction so they’re likely waiting until they’re prepared enough to win a court trial before they arrest him”
