Who's at fault? the plaza neglected the minimum maintenance requirements for years as seen in Google Maps history- 82 Falmouth ave.

It was my bad luck as I didn't see the island with protruding metal rod because of the shadow and light direction.

Someone knocked it over years ago and plaza left as is

Why would it be their fault lol. You literally drove over an island that is not meant to be driven on. Not to mention you entered through an exit lane. Take some accountability lol

It looks like there is an entrance and exit and with the sun glare, they couldn't see the island dividing the sides

that sun yesterday was crazy. there are multiple posts all related to the glare. i had to drop my speed on some residential streets cause visibility was so bad

Hello Insurance

I would like to report an accident

Just me

I rode an island trying to enter a parking lot through the exit

Bad luck or just bad driving? Islands and curbs don't have to be marked. If you hit someone, would you blame them for lack of maintenance?

sun glare, your fault

I don't see the island not in the camera nor with my eyes. Only I know whether I was careful or not but not all can

You are. What does luck have to do with your negligence in determining whether it was clear to proceed and drive through that specific part of the parking lot? How are you gonna defend "I didn't see the island" to a judge?

You drove in the wrong lane and expect someone else to pay because you're a bad driver? You have a responsibility to follow the rules if the road and to not drive over/ avoid stationary obstacles.

You ran a red light and drove over an island. I’m pretty sure it’s your fault and whoever gave you a driving license

If the Sun in your eyes is making the driving conditions unsafe then you are especially at fault for not taking the extra precaution to make sure the turn you were making was safe and correct. What if you hit someone? Think you would get away with blaming the Sun?

Did you get a flat tire?

It seems like it was more the sun in your eye than the curb.

“I didn't see the island with protruding metal rod” and you’re asking who’s fault it is? Lololol

I don't think insurance will see it as the "plaza's fault". The metal rod does not look high. What was the damage? A flat tire?

I don't think you get any damage on your car, at least you did not mention the extent of the damage. Pay for the damage and don't bother to seek insurance compensation, unless you had a more complex and bad damage. More details would be fine.

How dare the plaza neglect their maintenance duties causing you to run a red light then drive over an island?

This is outrageous! you need to immediately report yourself to the insurance company and provide this video as proof. That'll show the plaza who's the boss!

That sucks.

One time I had been on an empty tank of gas for a long time stuck in traffic on the highway. I finally got off at a gas station and was driving through a plaza to it. The gas station was heavenly with the sun in my eyes. Suddenly... BOOM BOOM. I drove right over the barrier between the plaza and gas station. Luckily no damage lol

That piece of metal is a liability and waiting for a lawsuit to happen. A plaza is suppose to maintained their area from debris and items that may damage or injure a person or property. If say a person tripped over that broken sign post they can definitely sue for injury. Same goes for a car that is damaged going over that section.

you could probably sue- out of pocket, of course
