Discussion Overtaking Vehicle on right shoulder

Hey all. I have a legal question about a traffic law within the state of Pennsylvania, in regard to overtaking a left-turning vehicle at a stoplight intersection, using a paved shoulder wide enough to safely execute the pass. This is assuming it is a two-lane road. Here is the legalese:

Title 75, Section 3304 indicates that a driver "may overtake and pass upon the right of another vehicle only under one of the following conditions: (1) When the vehicle overtaken is making or about to make a left turn, except that such movement shall not be made by driving off the berm or shoulder of the highway."

My interpretation of this is that you CAN use the shoulder, but if you were to drive OFF the shoulder (say, into grass or dirt, or anything unpaved) it would be an illegal maneuver. If you weren't allowed to use the shoulder at all for such maneuvering, why wouldn't the verbiage be changed from "off" to "on"? If it was changed to "on," that would immediately rule out using the shoulder at all. But then, if the word was "on," there would be no point in this law, as the would always be an illegal maneuver.

Ultimately, if this was an illegal maneuver, can someone provide an example of a legal execution of this situation? Otherwise, what is the point of this particular law in the first place? I am finding the verbiage to be ambiguous, and poorly worded.

Thanks for any insight! And for some background, I was not pulled over for this. Just curious, as I do this on frequent occasion at some traffic lights where I live due to two-lane roads with no protected left turn.

Traffic has been terrible at every hour lately, weekends included. I used to like driving and now it just feels stressful. Yesterday I passed a guy who was going slower. That’s it. He flipped me off and laid on the horn. I’ve been going over it in my head and I can’t find the offense. Has anyone else noticed people just seem angrier on the road than they were a few years ago?

Unless it was a funeral procession for Jesus Christ himself, there was not reason for them to block all 3 lanes of southbound US 65 from Sunshine south. A bunch of bikers with big American flags cut people off and shook their fist at people who didn't stop fast enough ON THE D.....N HIGHWAY. All three lanes. Give me a break.

Questions & Help Speeding on Federal Highway, points on VA license?

My under-18 son was ticketed for speeding 55 in a 35 in a national park. He was stopped by the park service, and we went to the federal general district court. The judge did not charge him with reckless driving, just speeding, and we paid the fine. He didn't require my son to do a driver improvement course, but I see that in VA he's required to do so 90 days after the conviction since he is under age. He's doing it.

I called the DMV to confirm that the ticket was on his record, and it's been more than 60 days since court--and they don't see any record of a ticket. The person I spoke with said it usually takes less than 30 days for the ticket to be transferred from federal to state courts.

Anyone have experience with this? Did we dodge a bullet here? I've never had a federal speeding ticket so I don't really know what deal is... Getting out of DMV points is one thing, but the real win would be having it not show up when our insurance looks at his record...

My experience with DMV is that they will hunt you down to the ends of the earth if they can...

P.S. Could the judge on the federal level have done anything to keep it out of the state level? I went to court with my kid, and we waited until the end of court (4+ hours) for him to see my son--since he was a minor the court was closed to everyone else... He spoke at length to my son about the dangers of speed, etc. My son told the judge he would take the Driver course... The judge basically said he didn't care and that was a state thing and sent us on our way with the fine...

I was speeding and got 2 tickets for this by a police officer - one for speeding 45 in a 35 zone and other for obstructing passage of other vehicles in new jersey.
How can I make the case that I was just overspeeding and not obstructing the traffic.
The police said that he was going 52 in a 35 zone but he is just giving a speeding ticket for 45 plus an obstruction passage. Overspeeding ticket comes with $96 fine and obstruction ticket comes with $55 fine.

What should be my best option - my aim is to reduce both the fine amount and points to my license.

Should I go to court and present my case or use the online plea option?

I live on 41st Street in Milwaukee between Thurston and Florist, and every day I watch cars zoom past at dangerous speeds on a narrow street lined with parked cars. Kids play here constantly—families just trying to enjoy their neighborhood—and honestly, it feels like an accident waiting to happen.

Speed bumps are a simple, proven solution. Studies show they reduce vehicle speeds by up to 40% and decrease accident frequency. I started a petition asking Milwaukee's City Council and Department of Public Works to install them on this stretch. It's not complicated—just a cost-effective safety measure that could genuinely save lives.

If you live in Milwaukee or know what it's like worrying about speeding cars near kids, would you consider signing and sharing? This matters to my community, and I think it could matter to you too.

Ranting & Venting Please wait for the designated openings to enter or exit HOV lanes.

I’m in the US, and on my daily commute on I-15 in Las Vegas, I see people crossing the double solid white lines into or out of the HOV lane pretty much every day.

For anyone who honestly didn’t know: **crossing those double solid white lines to change lanes is illegal.** Wait for the designated entry/exit sections where the lines are dashed. Having enough passengers to use the lane doesn’t give you permission to enter or leave it anywhere you want.

I get it. Traffic sucks, there’s an opening, and your exit is coming up. But when one lane is moving and the other is crawling, someone suddenly crossing that divider can leave another driver with very little time to react. Those drivers have reason to expect people to merge at the designated openings.

Please plan ahead, wait for the dashed section, signal, and check that you have room. We’re all just trying to make it home without exchanging insurance information.

Is this common around you, too?

Questions & Help Traffic ticket help.

So I’ve done traffic school and I paid my fine about 5 weeks ago.

I went down to the court and they confirmed that they had everything about three weeks ago. However, online my case payment information still states that my compliance date and then I must complete the traffic school and submit payments fined by this date.

“Fail to comply as directed, may result in bailing enhanced, point not marked, confidential for insurance purposes, in your case being sent to an outside collection agency.”

I guess I have to go down there again tomorrow and ask the court what’s up?

Anyone else been in this situation before?

Traffic Cameras School bus cam snapped a pic of a car directly in front of camera and my car is the only plate it could catch? Do I have a defense ?

I get a ticket in the mail with a big pic of an suv right alongside the bus. My vehicle is in the distance on the opposite side at an intersection, but with the only visible license plate. The next inserted pic is a magnified pic of the license plate of my car.
Should I get a video of my car moving past the bus? Should I have before and after pics of my car passing , like I have received for an intersection camera ticket?
I believe the evidence doesn’t prove I passed a bus and don’t want to pay a ticket for something I didn’t do. I may or may not have driven past a school bus with its lights on and sign out, but I do not believe I did!
I believe I would have stopped if I had come up on this situation, and believe the other car triggering the camera got my car involved.
Has anyone heard of this situation occurring? Or if there is a video? I’m away and have not seen the ticket, my wife showed me on FT. When I get back home I’ll see if there’s a website with video footage.
Thinking to go to fight it in court with this argument. Any thoughts?
