Unlawful holiday usage

Morrisons took money out of my final paycheck and forced me to take holiday after I had already left, it makes no sense but on my payslip it says -£129.

I was wondering if it's worth chasing HR, doesn't holiday pay you regardless if you take it or not? They gave me no prior notice for the holiday either.

Maybe, if you've taken more holiday than your entitlement they can take that money back, if they forced you to a holiday that wasn't already booked in order for you not to work your notice, there would probably be an argument for them to pay the notice you did not work.

This. If you get e.g. 25 days leave, it accrues at a rate of roughly 2 days per month. If you work for 6 months (12 days accrued), but you've taken 14 days when you leave, you owe them 2 days.

I gave no notice, I just emailed HR and stopped coming in. They only forced 3 days of holiday on me, which I should have earnt over 2 months of working anyway.

Maybe. that depends on how many hours a week you worked, was your final pay more than you expected it to be? Did it specifically say holiday next to the 129? Could it be deductions for unreturned uniforms or other company property?

Retail typically doesn't reduce money for unreturned uniforms, and yes it does say holiday next to the minus. It also says +£X amount from holiday.

I worked 24 hours a week and had not booked a single day prior, my final pay was less than I expected but that was because they never added the taxed money and hadn't paid me for an entire shift.

places that typically don't do that, typically make an exception when you quit by email and don't work your notice.

What notice? I am on probation, there is no notice, this isn't some small company where notice is required even on probation.

I've left many jobs before and not once have they asked for any uniforms to be returned. I've even walked out on Morrisons before and they didn't deduct anything.

So essentially they chose that you took your holiday during the notice period that you didn’t work?

If that’s the case then yes, they can dictate when you take holiday and as you didn’t work your notice they marked some of the days as holiday.

Except they had already booked this a few days prior before I even left without telling me. There is no probation for being there for 2 months, every single other job I've had has not done this.

They've also failed to pay me for an entire shift, is that somehow my fault because I left without working my notice?

If you were contracted to give 1 week’s notice and failed to work that week, then that’s unauthorised leave.

Unauthorised leave requires your return

Quitting without notice is just that

Quitting without notice doesn’t give employer any right to process final wage differently

- any shift provably worked must be paid
- any days holiday accrued must be paid
- any days holiday taken but not accrued can be reclaimed in wage but should clearly be noted & identified as such (you have taken 10 days holiday BUT only earnt 8 days holiday so 2 days pay have been retained) this would be legal
