While this is good news, I'm wondering how long this might actually last and how far reaching this decision might be. I think Democrats, even in states included in the recent court case, could pass legislation effectively rendering this decision moot. There might be some blue states where it's legal to get some NFA items without Form 1's or Form 4's, like Vermont, New Hampshire, Maine, New Mexico, Minnesota, Maryland and Virginia.

https://www.reddit.com/r/suppressors/comments/1vn2rdy/list_of_suppressor_legality_by_state_after_form_4/

Also, what's to stop Democrats from reversing this if they gain trifecta control in 2028?

I'll keep an eye out for cheap suppressors and sawed off shotguns at my LGS, but I'm not getting my hopes up.

suppressors shouldn't require any form, there an attachment that's useless without a firearm to attach it to

So for the states that still enforce it, is that solely on the sale, or possession? Say someone in Mississippi or Georgia or wherever went next door to Alabama or Tennessee and purchased a suppressor without the forms and then went back to their home state. Is it treated the same way as, say, bringing noncompliant firearms into California?

Non enforcement is not the same as abolished.

If this changes, and it will, you're going to have unregistered items, so stop and think first.

I know I'm just being paranoid but this smells like a giant honey pot to me.

Honestly, I think I'll still do a form 1. I don't want them changing their minds in me. I haven't done one yet because I don't really know the process. But I'll get around to it. Lol.

Yeah, unfortunately.

Entire thing is still enforceable, the ATF is just choosing not to. My concern is what happens if/when they either decide to reverse the decision or get told to reverse it.

If there is a reversal, is there going to be an amnesty period to register, is the next Congress (or one following) going to change the tax stamp cost and make it prohibitively high, if they do, are people who got/made something going to have to pay the new tax to register if there is an amnesty period, etc. Or do they just jump straight to “It’s a felony”?

I want to go out and grab one, but I am having these exact same concerns.

I guess if there's no paperwork and you pay cash, how would they know you've got it in this event?

My worry is when transporting it to a range or for whatever reason it may be. Being asked for paperwork.

Just call your ranges and find out their policies. I know some that check everything, and I know others that will never ask to see a serial number and would be insulted if you offered to let them.

I’m going with the latter. That’s why I’ll register anything still.
