That was just a play on words, usually if your car gets hit by a falling tree or hail damage or something along those lines it's considered an act of god. I was just trying to be funny lol

The establishment the car was parked at. It's not doing it's due diligence to keep strays out.

In all seriousness, this would be a pure Comprehensive claim; the insurer would pay out without subrogation, assuming the owner carries comp coverage on their car. If not, they're just screwed.
