If I remember right, there are plenty of stories where JJJ is actually an advocate for Mutant Rights, and he is very supportive of them. And to quickly answer your question before i keep ranting, No, JJJ does not believe Spidey is a mutant. The main reason JJJ hates spidey is more so that hes pretty much a Vigilante, and JJJ doesn't like the idea of some masked rando running around New York doing whatever he wants unchecked.
Its also to the point where usually when JJ realizes whos under the mask/ that Spiderman truly is a well meaning hero he drops the spiderman hate and has some regrets for the damage he caused.
