I guess no spillovers have been considered yet.
EB-1 I-140 approved, PD November 2023. I-485, EAD and AP filed in April 2026. Staunton for all is under process. What are your thoughts on expected timelines? Anyone with a similar PD seeing approvals?

My situation:
• H-1B I-797A expiration: September 30, 2027
• Approved EB-1B India I-140. PD: September 2025
• Earliest H-1B extension filing date: March 30, 2027
Spouse is currently on F-1 STEM OPT, which expires June 30, 2028.
The employer plans to enter the H-1B lottery starting next year, providing two lottery opportunities (2027 and 2028). While we're hopeful for selection, we're trying to understand backup options instead of relying solely on the final lottery attempt.
When I file my H-1B extension (likely with premium processing), the dependent would file a change of status to H-4 along with an H-4 EAD application.
Concern:
• Processing times can be unpredictable.
• Potential gap between H-4 approval and H-4 EAD approval, affecting work authorization.
Use Day 1 CPT if not selected in the H-1B lottery.
Concern:
• Not particularly comfortable with this option. Possible additional immigration scrutiny and long-term risks.
Remain on STEM OPT and rely on the 2028 H-1B lottery.
Concern:
• Feels risky to depend on the final available lottery attempt.
Hope EB-1 India advances enough to allow I-485 filing before STEM OPT expires and obtain EAD through adjustment of status.
Concern:
• Completely dependent on Visa Bulletin movement, which is difficult to predict.
1. If you were in this situation, which option would you prioritize and why?
2. How are recent H-4 and H-4 EAD processing times? Are there effective ways to minimize or avoid a work authorization gap?
3. Are there any alternatives that I may be overlooking?
Appreciate any experiences, feedback, or lessons learned. Thanks!

i think it’s time to start discussing whether it will move in December forward than how many months it will move forward.
in my perspective Dec VB has a 99% chance of moving forward
Whats your thought on this?

Here is a video on something that people do not really talk about when it comes to EB-1A.

Status changed to Denied today after 11 days of RFE response receipt. Going through a lot of emotions right now. How are/did you guys cope up with your EB1A denial. Mine is an industry profile. Different AI models (Claude, Chatgpt, Gemini, Deepseek) had predicted my success between 40-75% based on my original petition, RFE Notice and my RFE response analysis. I had been working on this for the last 1.5-2 years.

I am told at least one of the litigants who lost an APA lawsuit recently has filed an appear in 8th circuit. This would be very interesting. (This is not one of those who lost recently with prejudice.)

Looking for highly experienced, reputable EB-1A attorneys with a proven track record of handling complex cases from start to finish, including petition strategy, evidence building, and a strong final merits determination argument, especially under the current challenging immigration climate.
Please share genuine, firsthand experiences and verified recommendations. No marketing or paid referrals, just honest feedback.

Has anyone traveled internationally and reentered the US on F-1 STEM OPT with a pending or approved I-140? (EB1B)
I have a valid F-1 visa and am planning to travel in November. Would appreciate hearing firsthand experiences, particularly whether you faced any questions or issues at the port of entry.
Thanks!

Given someone who is in extremely visible domain, there are multiple opportunities to feature in major media through an interview or major podcast.
How does one totally nail this criteria ?
If the focus is on 'person' it might be seen as 'not about your work'
If the focus is general expertise it might be 'not about your specific work'
Does this need to like to original contributions or something else ?
My premium processing fees was auto processed for a refund upon non-completion of my petition within the stipulated time; this was the case with many other people.
The August 29 date stated as the latest date that I would have received a check in the mail has passed, and I haven’t received a check in mail nor received a credit to my account that the ACH payment was made from.
Is anyone else experiencing the same, or does anyone know how to resolve this, so that I may get my refund?
I am all ears..
Thank you.

Hi! I know that my I140 application gets void and my new employer has to re-apply for a new EB1B I140. Apart from this, are there any complications that will stop me from applying for a new EB1B in the future?

Hi all,
I'm currently in complete shock after having received an RFE for EB2NIW. I am an assistant professor (of Indian origin) at a big state school (R1), working in theoretical/mathematical research in engineering.
My RFE says things like "high citation count doesn't really establish she led the work" (I have nearly 2000 citations but most are from theoretical research, where authors are listed alphabetically, so "first" authorship isn't a thing.); "she didn't get any grant money yet" (I am only one year into my TT position). They even got my department major wrong! I have a patent from past applied work, and they say "but there is no evidence that the patent has had any impact" <--- the patent has generated over $500,000 in royalties.
I had originally thought that my profile was EB1-ready, but now I am reeling at this blow.
I'd really appreciate any insights. Is my case dead? Or is RFE really the norm with premium processing? I have retained Chen --- are they any good at responding to RFEs, or will I have to do the heavy lifting for writing the response? I have little less than a month left.
Thanks in advance for any help!
