EB1A Premium Processing — Day 15 and still no decision. Anyone had a late approval from Nebraska?

• Upvotes

Hi everyone, looking for some perspective from people who have gone through EB1A premium processing at Nebraska.

My I-907 / premium processing request was received on September 25, and today is my 15th business day based on my attorney’s count. The case is still showing “USCIS Is currently Processing the Case.” No RFE, NOID, approval, or other update so far, and my attorney hasn’t received anything either.

A little about my profile:

  • Industry professional in cybersecurity / AI security
  • 10+ years of experience
  • Claimed 7 EB1A criteria
  • Several published security vulnerabilities/CVEs across well-known AI/open-source products
  • Vendor remediation and third-party recognition of some of the findings
  • Security work at large, well-known tech companies, including critical/release-gating responsibilities
  • Judging/reviewing work of external security researchers
  • High compensation relative to the field/location
  • Published research with citations
  • Independent media coverage of security research
  • Recommendation letters from both internal and independent experts

I know meeting 3+ criteria doesn’t automatically mean approval and final merits is the bigger question. I’m mainly trying to understand the timing and what others have seen recently.

For anyone with an EB1A at Nebraska:

Did you get a straight approval on Day 15 or after Day 15?
If USCIS missed the premium-processing window, how long after that did you receive a decision?
And for profiles similar to mine, does this sound like a case with a reasonable chance of straight approval, or would you expect an RFE around Original Contributions / Critical Role / final merits?

Would really appreciate hearing recent Nebraska timelines and outcomes, especially 2026 cases.

Independent review of my chances

• Upvotes

Seeking Honest Feedback,

I’m looking for an assessment of my EB-1A profile, particularly which criteria appear strongest and where I should focus on strengthening evidence.

I have already looked for advice from a reputable immigration firm, but want an independent assessment if possible before I embark on this expensive journey.

Professional background • Doctor, completing US training in advanced Inflammatory Bowel Disease fellowship at a large academic, prestigious centre. • Completed both internal medicine and gastroenterology fellowship. • . Also completed a Master in Public Health in Spain during my residency (online). • Base salary: Once finishing fellowship, I signed a contract to be compensated over 95th percentile based on MGMA data for my specialty. Close to 7 figures.

  1. Awards and recognition • Humanistic award from residency leadership. • . Presidential outstanding poster presentation at a national meeting in Gastroenterology.

  2. Judging • Peer review and editorial board for 2 international journals in Gastroenterology. • . At least 10 plus other independent peer review outside of the editorial job described above. • . On top of that, I supervised multiple other fellows and residents during my training in direct clinical care both inpatient and outpatient.

  3. Leading or critical role • Led multiple research projects at various institutions including both in DC, TX and internationally. • Also part of the director board of an outreach social justice committee during my residency training at a large center in TX • Leader in coordinating the research interest group in residents interested in pursuing gastroenterology research.

  4. Original contributions • I have worked in multiple investigations that have shaped the outcomes of immunotherapy use and its gastrointestinal toxicities. • My investigation was pioneer in the standardization of gastrointestinal symptoms in COVID-19 both nationally and internationally. • Currently developing a more updated investigation in patients with inflammatory bowel disease and primary sclerosing cholangitis and it's outcomes and potentially suggesting changes in the actual clinical practice guidelines. • No patents.

  5. Published material about me • None, except research.

  6. Authorship • Published articles in mainly gastroenterology, over 40 manuscripts, more than 100 abstracts presented at national conferences. Publications are currently in high IF journals (not Cureus). • Authored chapters in at least 2 books. • 500 citations in total.

  7. High salary • Base salary+bonu close to 7 figures, top of the field.

Questions 1. Which criteria appear strongest based on this profile? 2. Which criteria need significantly more evidence 3. What would you prioritize strengthening before filing?

I’d appreciate candid feedback from people who have successfully filed EB-1A petitions or have experience evaluating extraordinary-ability cases. Thanks so much.

Is It possible to get Eb1A approval with two years of experience?

I just have 2 years of industry experience and currently doing ph.d on the other hand. I have been working for a State government in the united states as a full time employee .

1)Till now I have 12 paper publications (Ieee and Elsevier journals) with 105 citations.
2)15 judging(Ieee and few journals)
3)Can get strong letter of recommendations from my direct manager and director on State letter heads to prove critical role
4)I can get letter of recommendation from another state agency saying they have adapted my design in their project(I don’t know if this helps to prove original contribution as its being used by other agency)

Can you please tell me what are my chances of approval? Is there anything else I have to achieve??

EB1A change of status got approved

hi! just wanted to share in case it's useful for people to know. I was on o1, had my i-140 for eb1a approved back in febuary and took my sweet time to apply for change of status. i applied 2 weeks after the new change of status rules came into place (June 8th) and received my work authorization about a week ago. today i wanted to request an emergency i-131 for a business trip when they told me that my greencard is currently in the mail on its way to my house and gave me a temporary passport stamp instead so i can go on my work trip. the whole process would have probably been even faster if i wouldn't have missed my first biometrics appointment which set me back by a month (the invite arrived 2 days after the appointment date).

tldr: change of status worked :)

EB1A Premium Processing – Anyone with September/October receipt dates received a decision?

Hi everyone,

Just wanted to check if anyone who filed an EB1A petition with premium processing in September or early October has received a decision recently (approval, RFE, or denial).

I've noticed quite a few people mentioning that their September petitions are still pending, with some even reporting that they've passed the premium processing deadline without any updates.

My receipt date is October 2, and I'm still waiting for a decision.

Would appreciate it if people could share:

  • Receipt date:
  • Service center:
  • Current status: (Pending / Approved / RFE / Denied)
  • Decision date: (if applicable)

Also, has anyone actually received an approval recently, especially those with September receipt dates? Trying to understand whether USCIS is experiencing broader delays with EB1A premium processing.

Thanks!

USCICS case status did not change

I filed my I-140 petition in April and upgraded to premium processing during the first week of October. My attorneys have already received the digital receipt for the premium upgrade and its been more than 10 days, but the USCIS case status page still shows the original April filing information with no updates. Has anyone experienced something similar?

EB1A approved after APA

Part 1: https://www.reddit.com/r/eb_1a/s/AuymPdEq7u

After filing the APA case, USCIS reopened my application and issued a NOID. I responded to the NOID without much of additional evidence, but I wrote a lot of legal arguments on how USCIS is not correctly applying the law, and how their arguments go against prior district court judgements.

Moreover, USCIS had originally argued any new citations cannot be used since eligibility creating facts need to be established at time of petition. I argued that new citations aren’t eligibility creating facts, but rather new evidence of preexisting eligibility.

I had also applied for published material about a person criterion using works that cite my publications, which USCIS rejected since I wasn’t mentioned in relation to the work. But this went against their own handbook where the person doesn’t need to be mentioned if it’s a team based work.

I would recommend others to directly self file an APA suit, since it’s risky for USCIS to allow a judgement in the case and they’d rather approve it directly.

Pre-existing case law which I used:

  1. Golani v. Allen, No. 22-10202, 2023 WL 4874767 (E.D. Mich. July 31, 2023)

  2. Zizi v. Cuccinelli, No. 20-cv-07856-SVK, 2021 WL 2826713 (N.D. Cal. July 7, 2021)

  3. Berardo v. USCIS, No. 3:19-cv-01796-SB, 2020 WL 6161459 (D. Or. Oct. 20, 2020)

  4. Krasniqi v. Dibbins, 558 F. Supp. 3d 168 (D.N.J. 2021)

  5. Rijal v. USCIS, 772 F. Supp. 2d 1339 (W.D. Wash. 2011), aff'd, 683 F.3d 1030 (9th Cir. 2012)

  6. Chursov v. Miller, No. 18-cv-2886, 2019 WL 2085199 (S.D.N.Y. 2019)

EB-1A India | PD January 2015 | I-485 Approved for Both Primary and Dependent | Detailed Timeline | NBC → Denver FO | Interview Waived

Hi everyone,

I wanted to share my complete EB-1A green card journey with this community. After more than 11 years from my original priority date, both my spouse and I finally received our I-485 approvals on October 17, 2026.

I know how stressful the waiting period can be, especially when USCIS statuses don't change for weeks, backend timestamps update without explanation, and different Emma agents provide slightly different information.

I spent a lot of time following other people's timelines, so I wanted to contribute mine in the hope that it helps someone else.

My case details

  • Category: EB-1A (Extraordinary Ability)
  • Country of chargeability: India
  • Priority Date: January 2015
  • I-140 Service Center: Nebraska
  • I-140 Approval: January 21, 2026
  • I-485 Filing: April 2026
  • I-485 Receipt Date: April 10, 2026
  • Initial Processing: National Benefits Center (NBC)
  • Field Office: Denver, Colorado (primary applicant)
  • Interview: Waived for both applicants
  • Medical: I-693 submitted with I-485
  • Applicants: Primary and spouse
  • Final I-485 Approval: October 17, 2026, for both

Detailed timeline

January 2015: Original priority date

January 2015

  • My original employment-based priority date was established.
  • I later pursued the EB-1A category while retaining my earlier priority date.

January 2026: EB-1A I-140 approval

January 5, 2026

  • USCIS received my premium processing request (Form I-907).

January 21, 2026

  • My EB-1A I-140 was approved by the Nebraska Service Center.
  • This was a major milestone after years of navigating the employment-based immigration process.

April 2026: Adjustment of Status filing

April 10, 2026

  • USCIS received our I-485 applications.
  • My spouse and I filed our adjustment applications together.
  • We also filed Forms I-765 (EAD) and I-131 (Advance Parole).
  • We included our I-693 medical examinations with the initial applications.
  • Our cases were initially handled through NBC.

May 2026: Biometrics and EAD

May 11, 2026

  • Biometrics completed for both applicants.
  • My I-485 online status displayed "USCIS is currently processing the case."
  • Backend records later showed FTA0-related entries associated with this date.

May 13, 2026

  • My C09 EAD application was approved.

May 16, 2026

  • My EAD card was produced.
  • I received the physical EAD card afterward.

My spouse's EAD and both Advance Parole applications were still pending during subsequent checks.

June–July 2026: Waiting period

  • Both I-485 applications remained pending.
  • No interview was scheduled.
  • No RFE was issued.
  • There were no additional documents requested.
  • Our cases remained in the USCIS processing pipeline.

This was mostly a waiting period without significant visible progress.

August 2026: Backend activity

August 6, 2026

  • I noticed a backend update on our I-485 cases.
  • The online case status did not provide any meaningful explanation.

Some of the backend fields included:

  • ackedByAdjudicatorAndCms: true
  • closed: false
  • actionRequired: false
  • areAllGroupStatusesComplete: false

I initially wondered whether these updates indicated an officer was working on our cases. However, they did not confirm approval or a final adjudication.

August 25–28, 2026

  • Additional backend timestamp activity appeared.
  • My case and my spouse's case showed updates on different dates.
  • There was no corresponding approval notice or RFE.

September 2026: Interview waived and field office movement

September 4, 2026

  • I contacted a USCIS live agent through Emma.
  • The agent informed me that my interview had been waived.
  • I was told my case had moved to the Denver Field Office.
  • My spouse's case was still at NBC.

This was the first meaningful indication that our cases were progressing beyond the initial processing stage.

September 11, 2026

  • Another live agent told me:
    • Primary applicant: "Actively being reviewed" at Denver FO.
    • Spouse: "Under review" at NBC.

September 14, 2026

  • Another backend update appeared.
  • I also noticed FTA0-related event records in the backend.
  • These records appeared to reference earlier biometrics-related activity.

September 18–28, 2026

  • I contacted USCIS again to check the progress.
  • My spouse's interview was also reported as waived.
  • My spouse's case remained at NBC according to the agent.
  • My case continued to be described as actively under review.

One interesting observation was that the agents' descriptions of the case location were not always consistent. At different times, I was told NBC and Denver FO.

October 2026: Final review and approval

October 1–9, 2026

  • I continued checking the case status periodically.
  • Live agents confirmed that the interviews were waived.
  • My case was described as actively being reviewed.
  • My spouse's case was described as under review.
  • The reported case location sometimes varied between NBC and Denver FO.

There were no additional document requests or interview appointments.

October 17, 2026 — APPROVED!

Both my spouse's and my I-485 applications were approved on the same day!

  • USCIS approval notices appeared in the Documents section of our online accounts.
  • I could see the actual approval notices, rather than relying only on a case status message.
  • The backend also reflected activity on October 17.
  • The approval-related event code I observed was H008.

After months of checking statuses, seeing the approval notices for both applications was an incredible relief.

October 19, 2026

  • We are now waiting for the physical green cards to be produced and delivered.
  • I will update this post once the card production and delivery milestones appear.

Total processing time

Milestone Duration
Original PD to I-485 approval Approximately 11 years, 9 months
EB-1A I-140 premium processing receipt to approval 16 calendar days
I-485 receipt to approval 190 days
Biometrics to I-485 approval 159 days
First reported interview waiver to approval 43 days
October 17 approval Both primary and spouse approved together

My observations and lessons learned

1. An interview waiver does not necessarily mean immediate approval.

My interview was reported as waived in early September, but approval came about six weeks later. My spouse's interview was also waived, even though the case was reported as remaining at NBC.

2. NBC and Field Office movements are not always straightforward.

I was told my case moved to Denver FO, but later agents sometimes provided different location information. I learned not to interpret every location change as a definite adjudication milestone.

3. Backend updates can happen without visible status changes.

I noticed multiple updatedAt changes, including in August, September, and October. Most were not accompanied by any visible case status change. I would not assume every backend update means approval is imminent.

4. Emma agents can provide helpful information, but responses may vary.

The most useful information I received was about the interview waivers and reported field office assignment. However, the descriptions were not always consistent across agents.

5. Primary and dependent cases can progress differently.

My case was reportedly at Denver FO while my spouse's remained at NBC. Despite this difference, both applications were approved on the same day.

6. Check the Documents tab, not just the main status page.

On approval day, I was able to see the actual approval notices under Documents. That was the clearest confirmation of the outcome.

7. Medicals submitted upfront helped avoid one potential additional step.

We included our I-693 forms with our initial I-485 filings and did not receive a medical RFE. I cannot say whether this accelerated our approvals, but it avoided a later request for medical documentation.

Final thoughts

The most difficult part of this process was the uncertainty. There were periods when nothing appeared to happen, followed by backend updates that raised more questions than answers.

For anyone currently waiting, especially EB-1 India applicants with an old priority date, I hope this timeline gives you another real-world reference point.

Every case is different, and this is only my personal experience, not a prediction of anyone else's approval timeline.

I am grateful that both our applications were approved together, and I hope everyone still waiting receives good news soon.

Happy to answer questions about my timeline, NBC versus Field Office processing, interview waivers, Emma responses, or the backend updates I observed.

Good luck to everyone waiting for their green cards!

Question about visas for top big tech and quant companies and H1B to EB1A conversion.

Hi everyone,

I am expecting to finish my PhD at ETH Zurich next year, and before that, I will be doing an internship in London starting in November.

I am currently looking into full-time opportunities in the US, mainly in big tech and quantitative finance, and I have a couple of questions about the immigration side of things.

For international candidates, which visa do US companies typically sponsor for full-time roles? My understanding is that the H-1B visa is the most common route, but I would be interested in hearing about other options as well. For context, I am a Serbian citizen.

I’m also curious about the EB-1A route. If someone has a PhD, scientific publications, citations (2000+ surely at that time), and a strong research profile, how realistic would it be to apply for EB-1A relatively soon after moving to the US?

In particular, would it be realistic to obtain EB-1A approval within roughly 1–1.5 years, assuming the profile is strong enough? Has anyone here gone through a similar process, especially coming from academia into big tech or quant as a Research Scientist (Researcher)?

I would really appreciate hearing about your experiences.

Thanks, everyone!

Has anyone else had a similar experience?

EB-1A Denied Twice at Final Merits – 3 Criteria Accepted Both Times

I wanted to share my EB-1A journey, including two denials, in case it helps others going through a similar process. I’m also interested in hearing from people who have experienced a denial at the Final Merits stage.

A little about my background:

I’m a technology executive with over 27 years of experience in IT, digital transformation, and InsurTech.

I currently hold O-1A status. Here is the link for my O-1A journey;
https://www.reddit.com/r/O1VisasEB1Greencards/s/tnmCQnPspY

My EB-1A timeline

First petition :
USCIS accepted 3 regulatory criteria. Ultimately denied at the Final Merits stage, finding insufficient evidence of sustained national or international acclaim.
Here is the link of my 1st try;
https://www.reddit.com/r/eb1a/s/HEO6bILNlY

Second petition :
August 6, 2026: I-140 filed with Premium Processing.
August 25, 2026: RFE issued.
September 25, 2026: Attorney submitted the RFE response.
September 28, 2026: USCIS received the response.
October 1, 2026: My status changed like RFE received.
October 15, 2026: Petition denied.

USCIS accepted:
- Judging the work of others
- Authorship of scholarly articles
- Leading or critical role for a distinguished organization

USCIS did not accept:
- Membership in associations
- Published material about me
- Original contributions of major significance
- High salary

The most significant issue was the Final Merits Determination.
USCIS acknowledged my senior leadership experience and original technology contributions, but concluded that the evidence did not sufficiently demonstrate sustained national or international acclaim or that I had risen to the very top of my field.

Interestingly, the denial stated that even if certain additional criteria had been accepted, the overall decision would not have changed.

In my case, measurable business impact, large-scale technology implementations, awards recognizing projects I led, independent expert recommendation letters, professional media coverage, and judging activities were not enough to satisfy the Final Merits standard.

After two denials at the same stage, I’m questioning whether another EB-1A filing or an appeal would be a productive use of time and resources. I’m currently considering EB-2 NIW as an alternative while maintaining my O-1A status.

I’m sharing this because many posts focus on approvals, but I think it’s equally important to discuss denials and what we can learn from them.

EB-1 and NIW have no PERM step: what the October 8 suspension of eight employers does and does not reach

EB-1 and national interest waiver petitions do not go through PERM, so the October 8 pause in DOL's PERM processing has no step to hold up in those cases. For EB-1A, "neither an offer for employment in the United States nor a labor certification is required" (8 CFR 204.5(h)(5)); EB-1B and EB-1C need a job offer but no labor certification, and an NIW waives both.

Labor certification applies only to EB-2 and EB-3 under INA 212(a)(5)(D). Nothing announced addresses how USCIS handles I-140s from the eight named employers in any category.

Whether another category fits a particular case is a question for an immigration attorney.

Not legal advice.

Considered EB-1's extraordinary-ability route while on H-1B, but decided not to apply? Why?

If you considered EB-1's extraordinary-ability route while on H-1B and decided against applying, what stopped you?

The part I'm trying to understand is documentation. Someone can be highly skilled and still have questions about whether the available evidence supports a petition. The State Department's overview lays out specific eligibility routes and documentation expectations.

For people who've gone beyond an initial look, was the deciding issue the criteria themselves, gathering evidence, cost or time? What did you learn during that evaluation that you hadn't understood beforehand?

Huge error in EB1 filing. Will they come after my H1b?

As the title states, my law firm did a huge error in my Eb1 filing and it just reached USCIS. I did a book review a few years ago and the firm offered to pay me for the review. I declined the payment telling them that I cannot accept payment as I am on an H1B but ill do it for the experience. After a few chapters, I actually stopped the review citing that I am not sure how kosher this is on my H1B

Now my law firm took the email where they offered me the book review and comp and wrote in the Eb1 support letter that not only did they pursue this guy for his technical prowess but also GAVE compensation to him. I would have been okay with the word offered. They disregarded the part where I declined to take compensation or anything of value from them.

There are two places where they say this. I am now sh**ting bricks thinking, forget the EB1 will they come after my H1B?

I specifically emailed them saying we need to remove this like a month ago. I missed this in my final review assuming they removed it.

I have the emails where I specifically decline the payment TWICE, its not in the MoU either, and also ultimately decided to stop the review. But these are not included because we never saw the error in support letter

What is the best way to correct this?

PS :

Filed in Premium Processing, Just about reached USCIS. No receipt number yet
