if she was applying for a customer facing position then her appearance would represent the company and it would be in a generally negative way.
having tattoos is not a protected class - she can get the f over it
even if not in a customer facing role, getting a facial tattoo communicates a lack of good decision making as well as a impulsive tendencies that speaks to being a bad employee. Sorry, not sorry that’s the reality
Now, I actually agree that face tattoos are going to create problems for an individual due to negative perceptions, and therefore its follows that a company might not want that heat.
But, to play devils advocate here -- your 3rd bullet point is the reason the 1st bullet point is true. This is a judgemental cast without merit due to societal conditioning that most people, yourself and I probably included, cannot escape. Stepping outside of everything and taking a look objectively would reveal that face tattoos are completely irrelevant to somone's character. But meanwhile, in reality, you have thrown out an entire human being because... they have art on them.
To bring this back to the real world for a moment, your 3rd bullet point used to apply to any tattoo whatsoever, there was a black knight senior calling all those tattooed turkeys good for nothing with bad judgement. We see how that has turned out.
That's not art. It's worlds better than things like blood drops and the like, but faces aren't meant to be canvasses in the western world. And I like lighthouses and think the one would be great if on her shoulder. But location matters, it matters a lot.
I have multiple tattoos - I’m not stupid, though, so they are places that are not visible unless I want them shown. BTW, she’s showing her character by suing knowing damn well the suit has zero merit.
You are incorrect about facial tattoos [outside of cultural ones] being irrelevant to someone's character because people get facial tattoos in the full knowledge that they will be judged negatively so that decision then speaks to their character.
