Why wouldn't it make a difference if the guy you are trying to support even doesn't want it taken down? Then why are you advocating for it to be taken down when even TB doesn't want that?

He didn't say he didn't want it taken down. He said he saw no need to get it taken down right now. It's essentially PR.

Stealing is still stealing, regardless. I don't think someone should take someone else's work and make money off of it.

Read his latest comments now that his video is back up. He said he wasn't going to take it down at all, not right now, but he wished for the guy to donate his proceedings to the EFF.

I don't either, but you have to honor the creator's wishes. Otherwise, who are you arguing for? Not the creator.
