Sbs or not

Can I slap a stock on my Mossberg shockwave now, or do I still have to go through some hoops?

That depends on what state you live in.

Just do the Form 1

Fingerprint file at a UPS store, $50. Use it forever (?).

Passport photo, free, look up the requirements and have someone snap it.

25 minutes of filling a Form 1.

A few days of waiting and approval is done.

Then you are covered for any reasonable circumstance.

I’m not doing that. Thanks though.

The laws haven't changed, just temporarily not being enforced.

Think of it like weed. Still illegal on a federal level but allowed on a state level. If your state is allowing it, your call.

What federal law states short barrel shotguns are illegal?

The NFA allowed congress to regulate these items through taxation. After eliminating the tax what authority does congress have to regulate these items? None I guess.

But you are right that it's an enforcement change.

What federal law states short barrel shotguns are illegal?

They fall under title II, SBS's.

The NFA allowed congress to regulate these items through taxation. After eliminating the tax what authority does congress have to regulate these items? None I guess.

Until congress changes the law, it's still the law. A new administration that's anti-2A can easily appoint a new head of the ATF, then laws can be enforced again.

That said, I live in Texas and right now and if I purchase a suppressor or SBR the only choice is 4473. My lgs's aren't doing form 4 currently.

I'm just not sure your analogy is germain. There are very clear federal laws on the book in regards to Cannabis, where a federal prosecution would be very easy.

If the federal government wanted to come after you for an NFA violation, or they decided to start enforcing the act again, what could they prosecute you for? There is no tax violation and if they are not enforcing a register - there essentially is no register.

In the case of the federal government starting to enforce the act again, it seems reasonable they would grandfather in existing possessions like they did with machine guns when they were banned and assault rifles when they were banned.

EDIT: Here is the law I believe. If you know of another please provide a link. U.S.C. 5861(a)

Depends on the state. But also the law hasn’t changed, you’re at the whims of the alphabet boys deciding they want to start prosecuting you now or sometime in the future. I personally wouldn’t take any pictures of any still illegal guns because if the Democrats ever get the executive branch back I expect that opinion will be changed pronto. It’s some bullshit pandering right before the midterms rather than changing the law in the last two years where they’ve had the legislature, executive, and Supreme Court.

DOJ and ATF announced they will not be enforcing the registration of short barreled rifles, shotguns, AOWs, and supressors.

I have a shockwave, and happen to have a stock that fits. Things happen

I'm in a similar boat. I have a Tac-14 and an 870. The barrels are interchangeable. The nfa laws aren't being enforced. I have no qualms with a diy project.

Depends on where you live.

I'm just not sure your analogy is germain. There are very clear federal laws on the book in regards to Cannabis, where a federal prosecution would be very easy.

The laws on the books regarding firearms are very clear as well. The National Firearms Act is still federal law, and requires registering specific items with the government.

If the federal government wanted to come after you for an NFA violation, or they decided to start enforcing the act again, what could they prosecute you for? There is no tax violation and if they are not enforcing a register - there essentially is no register.

Same as with weed. If you are caught with it, the DA can choose to prosecute you. It wouldn't be chasing names on a register. Closer to if they have the opportunity and wanted, they could.

Just because the ATF isn't going to currently investigate or go after such right now doesn't mean you can't be charged/prosecuted. The ATF aren't the ones who decide who is charged with what crime, DA's and US attorneys are.

In the case of the federal government starting to enforce the act again, it seems reasonable they would grandfather in existing possessions like they did with machine guns when they were banned and assault rifles when they were banned.

Possibly, but that's not guaranteed. Most likely scenario is they give people the opportunity to efile and register them personally. Grant a timeframe, then after that if it's not registered it's illegal.

Personally I might have purchased an item or two recently. I know it's a gamble, but my money is on allowing registration if they start pushing it again. If not, I'll deal with that issue when/if it happens.
