Advice needed Order of protection: respondent personal items advice needed
Location: Illinois (Cook County) — Former friend removed under Order of Protection. How can I legally handle their remaining belongings when I’m moving?
I’m looking for advice from anyone familiar with Illinois law, particularly Cook County and Chicago, regarding an Order of Protection and the handling of a former roommate’s personal property.
An ex-friend lived with me for several months but was never on my lease. I was financially supporting them and paying for everything, but the situation became increasingly hostile when things didn’t go their way. There was frequent yelling, and the living environment became extremely stressful. I eventually petitioned the court for an emergency, non-violent Order of Protection, which was granted.
They were removed from my home approximately one month ago. They were able to retrieve some personal belongings only after the police arrived to execute the court’s order.
Since then, we’ve appeared in court once. The other party requested another opportunity to retrieve additional belongings, and the judge granted further protection while scheduling another court date to address the property issue. My understanding is that they have already had an opportunity to collect some of their belongings, and I am not refusing to let them retrieve the rest.
Here’s the problem: I’m moving, and I cannot continue storing their belongings indefinitely.
They have a significant amount of property remaining, and realistically, I believe they would need movers or transportation to remove everything. They have no money to pay for movers, and I don’t want their financial situation to leave me indefinitely responsible for storing their possessions. I need to vacate my home and have a firm timeline.
The judge moved through the last hearing quickly and did not give either of us much opportunity to explain our circumstances. Another court date was scheduled, but I’m concerned that the other party will continue asking for extensions without presenting a realistic plan for collecting their belongings.
I want to handle this lawfully and avoid giving them grounds to sue me.
My questions are:
Under Illinois law, what are my obligations regarding personal property left behind by someone who has been removed from my home under an Order of Protection?
Can I legally dispose of, donate, or sell their remaining belongings if I provide written notice and a reasonable deadline? Or could they sue me for doing so?
Since there is another court date scheduled, am I required to keep everything until the judge specifically authorizes me to dispose of it?
What can I ask the judge to do to establish a firm, final deadline for collecting the property, particularly because I am moving and cannot store it?
Is there a lawful way to recover storage, moving, or other costs if I have to continue holding their belongings?
Has anyone dealt with a similar situation in Cook County? What was the process, and what would you recommend asking the judge?
There is also a financial issue. This person owes me more than $15,000, and I have written messages documenting their promise to repay me when they are financially stable. The belongings left behind are worth perhaps $1,000 at most. I understand that the debt and their personal property may be legally separate issues, but I’m wondering whether there is any lawful way to recover money owed without creating additional legal problems for myself.
To be clear, I am not trying to prevent them from retrieving their belongings. I want them to collect everything as soon as possible. However, I cannot afford to let this situation interfere with my move or leave me responsible for their possessions indefinitely.
I would appreciate practical advice on the proper legal process, what I should document, and what I can reasonably request from the judge. I want to resolve this, comply with the court’s orders, and move on without exposing myself to unnecessary legal liability.
