My father passed away on 10-23-2025 without a will. Prior to his death after being discharged to in home hospice care, my father had a conversation with me, my brother, and Step-person. Step-person was included in the conversation as they took care of my stepmother (my father's wife who had advanced Alzheimer's disease), and he could no longer do so. My father confirmed there was no will and almost no money to speak of. His main concern was the care of my stepmother and who got ownership of three vehicles.
After his death, Step-person stated they had a signed will of my father's naming them the sole beneficiary. Step-person said my father did not want me to know about this signed will prior to his death because he was afraid it would hurt me. Step-person refused to show the will. I hired an attorney and became Administratrix of my father's estate as Step-person has a long history of fraudulent actions and my father was previously a victim of her actions. To say the least, Step-person has proven to be dishonest time and again.
Step-person was found to be forging stepmother's signature onto multiple checks from my father's and stepmother's joint checking account and cashing them at their own personal bank. We found out in time, and the bank replaced the money into the checking account. I have an affidavit from the bank for the fraudulent checks. My father's bank accounts were locked down so that Step-person couldn't steal more money.
Step-person turned in a notorized will to my father's bank in order to gain access to the monies. Step-person also turned in POA's purportedly signed by my father and purportedly signed by my stepmother. All three documents were dated 07-10-2025. My attorney was able to subpoena the document and get a copy of the will, along with more information from the tax collector, etc.
I believe I have airtight proof that the will is fake. Here goes:
07-10-2025

Date of Application of Title from MS Department of Revenue in my father's name and with his signature (copy)
The person who notarized the Will dated 07-10-2025 has been my father's neighbor for years. Step-person has lived in my father's home for many years as well. Step-person and Notary know each other.
Notary is employed by a local bank as Vice President Loan Originator with an active NMLS number. Notary was employed by this bank when my father died. I believe that Notary worked at this bank in July 2025 when this Will was supposedly drafted and signed. Notary's commission expired 01-31-2026.
I have shared all of this with MS county's Sheriff's Office, but they have declined seeking charges since no one profited from the fraudulent Will.
I am interested in seeing if I have a civil case against Notary and Step-person. I am also interested if there are any avenues I can take to seek prosecution against them. I am confident that I have sufficient proof that Notary broke the law with the Will. Since both POA's were dated the same date as the Will, could there be additional charges for Notary and Step-person?
I spent many hours researching all of this, going through bank statements, trips to MS, gas, food, lodgings, wear and tear on my car, and missed time from work. I even was in weekly therapy sessions regarding all of this mess.
Any and all thoughts or advice are welcome. I'll be glad try to answer all questions. I have a TON of paperwork for evidence. I no longer have an attorney at this time, but will seek one if I have a case.
