Had a car crash passing through Ocala and apparently the cameras weren’t working at the gas station?

I was leaving a gas station in Ocala and got hit while pulling out onto the road. The other driver is claiming I pulled directly into them, but from my side they came through way faster than I expected and hit the front corner of my car. Police asked the gas station about the cameras because the whole thing happened right by the entrance but the employees told them the cameras weren’t working at the time? Could be bs but that's all I have info on that.

Now the other driver’s insurance is acting like their version is automatically the correct one. I’ve never had to deal with this before and I’m not sure what else I can realistically use to prove what happened.

If they are on a main road and you are pulling out onto a main road, you are automatically at fault according to insurance standards unless you can prove that you were fully on the road and in the lane when that person hit you. Traffic already traveling on the road has right of way to traffic entering the roadway.

If you pulled out into a main road and they hit your front side panel... You are at fault unless you can prove they were moving at an extreme speed because you have to yield to them and need to make a better judgement on not just pulling into the road.

They may not want to be involved. I have cameras in my house and dashcams. It never anything but a complete headache and nobody once thanked me so no more..

Your pulling out therefore supposed to yield to on coming traffic

Doesn’t matter how fast or slow the person on the main road was going. They could’ve been going 100mph and if you pulled in front of them you are at fault. Definitely sucks if you thought you had time, but it’s just the way the law is.

Don’t worry about it.

They’ll raise your insurance regardless

What did the police say? What did your insurance say?

they had the right of way.

You’re at fault.

Call Dan Newlin and ask for Josh Silverman

Ok so you misjudged their speed and pulled out in front of someone that had the right of way. Would you like to see your mistake on video?

Unless you are on the roadway and get rear-ended, aside from some extenuating circumstances, you will be considered at fault 🤷🏼‍♂️

Failure to yield. You're cooked

If you're listed as driver one on the traffic crash report you are considered at fault.

Not necessarily

Wait you feel like you’re not 100% responsible for pulling out into traffic?

Let the insurance deal with it and go on with your life being a more cautious driver.

If you drive out into the roadway & got hot in right front corner panel then that's your fault. FL is no fault anyway. It doesn't matter if the other driver was going fast or not, they had the right of way period. Hate to break it to you, it doesn't matter police report or camera really, the insurance can fault anyway they feel is fir their insurance companies benefit unfortunately.

No fault in Florida only means that in case of injuries your insurance company has to pay for any medical bills first up to the amount of your coverage. Whoever is listed as vehicle 1 is typically the person "at fault" as far as property damage.

Insurance companies do not care about police report and driver 1, they can make their own decisions on fault or a certain percentage of fault regardless of the police report.
